good morning from the studio 57 newsroom at cbs headquarters here in new york. good to be with you. i'm anne-marie green. a wisconsin teenager who disappeared last october after her parents were murdered has been found alive. investigators found jayme closs yesterday about an hour away from her hometown, and a suspect is in custody. marc liverman has more on this mystery. good morning. >> reporter: good morning. still a lot of unanswered questions in this case. we don't know exactly where jayme was the entire time she was missing or what she went through, but the most important thing is she's safe and alive. nearly three months after she went missing, 13-year-old jayme closs has been found alive. the wisconsin teenager was last seen october 14th at a family member's birthday party. early the next morning, a garbled 911 call was made from her mother's cell phone.en polis home about four minutes later, they say jayme was gone, and her

parents were found dead. yesterday afternoon, jayme he cbs station wcco spoke to the woman who found her. she says she was just walking her dog when jayme approached her and said she needed help. according to authorities, a suspect was taken into custody 11 minutes later. jayme's aunt spoke to wcco. >> oh, my gosh. i don't know -- there's rumors earlier today. and i prayed and prayed they were true and they come not to be true. and i just shut myself totally down because i thought today was going to be the day. and to find out two hours later she was found, i just cannot believe this. >> reporter: allard says her niece is recovering in the hospital. in the weeks that followed her disappearance, thousands canvassed miles of fields, forests, and more in search of the young girl. jayme's family never gave up hope. >> we all love you to the moon

and back, and we will never stop looking for you. >> reporter: yesterday barron county sheriff chris fitzgerald wrote on facebook, "we promised to bring jayme home, and tonight we get to fulfill that promise." and there were rumors circulating that jayme had been found earlier hundreds of miles away in another county, but law enforcement debunked that rumor on twitter. they plan on holding a press conference later this morning. anne-marie? >> i can't wait to hear what they have to say. this is incredibly good news. marc liverman here in new york, thank you very much, marc. ahead on "cbs this morning," adriana diaz is in barron, wisconsin, with the latest on the jayme closs investigation. it's day 21 of the partial government shutdown. it's now lasted the same number of days as the longest shutdown in american history. president trump flew to south texas yesterday to push for border wall funding. sources say he is laying the groundwork to declare a national emergency. about 800,000 federal workers stand to miss paychecks today. major garrett reports from hidalgo, texas.

we need a barrier. >> reporter: president trump surveyed the u.s.-mexico border near mcallen and the people who protect it. part of his ongoing campaign to portray the border as overrun by migrants, drugs, and human trafficking. >> so we're going to get this straightened out hopefully. hopefully the democrats are going to come to their senses. >> reporter: before leaving for texas, the president, frustrated by democratic opposition to wall funding, said he is seriously considering declaring a national emergency and seizing unspent pentagon construction funds. >> i have the absolute right to declare a national emergency. the lawyers have so advised me. i'm not prepared to do that yet. but if i have to, i will. >> reporter: presidents have declared national emergencies nearly 60 times since 1976. president bush invoked one after 9/11, and president obama declared an emergency in response to a flu outbreak. mr. trump would use the declaration to free up billions in unallocated military

construction money. but such a move would almost certainly draw a legal challenge, and some senate republicans cautioned mr. trump not to sidestep congress. >> i don't want to see a declaration of national emergency. i think that's an action that would be taken in the most extreme circumstances. >> reporter: the president also backtracked on his famous campaign pledge that mexico would pay for the wall. >> i never meant they're going to write out a check. i said they're going to pay for it. they are. they are paying for it with the incredible deal we made called the united states, mexico, and canada -- >> reporter: during the campaign, mr. trump said he would tax money sent to mexico. his campaign website said mexico could pay through, quote, a onetime payment of $5 billion to $10 billion. there was also rhetoric like this -- >> so a lot of politicians said "you can't get mexico to pay for the wall." i said, "it's going to be so easy. going to be so easy." >> reporter: on capitol hill,

there was no sign of compromise. >> not only was the president unpresidential -- surprise, surprise -- yesterday in his behavior, i think the meeting was a setup so he could walk out. but i'll say just that. >> reporter: the idea of declaring a national emergency is being given serious white house consideration. it has a ways to go, but it's also a pressure point on congress with the white house essentially saying negotiate with the president or risk seeing him get the border wall funding and you be left out of the equation. the president also announcing he was canceling a trip to the january 22nd world economic forum in davos, switzerland, suggests he's preparing for a long partial government shutdown ahead. major garrett, cbs news, hidalgo, texas. president donald trump's former lawyer, michael cohen, will testify publicly before a house committee next month. a federal judge in manhattan sentenced cohen last month to three years in prison for lying to congress.

he has admitted to facilitating hush-money payments to two women who claim they had sexual encounters with mr. trump. the president has denied those affairs. cohen said that he's looking forward to providing the american people with answers. a winter storm is threatening a 1,500-mile stretch from the rockies to the east coast. snow and ice are expected through the weekend. st. louis could get up to a foot of snow, and washington, d.c., could also get buried. areas farther south will be preparing for freezing rain and sleet. a criminal defense attorney representing r. kelly is responding to sexual assault allegations against the singer. the accusations resurfaced in a new documentary. and while there have been some protests against kelly's streaming, his music is actually up more than 100%. jericka duncan has more on how the latest claims don't be affecting r. kelly's night life. reemerged. ♪ my body >> reporter: kelly, who celebrated his 52nd birthday at a club in chicago, seemed unconcerned about the docuseries "surviving r. kelly" in which multiple women accused the three-time grammy winner of sexual and domestic abuse. >> it's very painful to have to talk about it again. >> it's a bunch of disgruntled people who are looking for their 15 minutes of tmz fame. >> reporter: kelly's attorney, steve greenberg. do you believe all of these women are lying? in this era of me too, we know that a lot of people have not come forward about sexual assault or sexual misconduct allegations for years. >> i believe that all of these women did exactly what they wanted to do, and because there's now some hash tag that's not going to change. >> reporter: right now, prosecutors from at least two counties, one in illinois where kelly is from and one in georgia, say they are asking alleged victims to come forward. in cook county, illinois, the

state's attorney's office tells cbs news they have received calls related to this matter. have you had any contact with the district attorney's offices that are looking into alleged victims? >> i haven't heard from a prosecutor's office. i have never heard from an attorney for a victim or an alleged victim. i haven't heard from anyone because there's no facts to back up these claims. >> reporter: greenberg also says r. kelly is disappointed other musicians are now distancing themselves from him. lady gaga announced she's removing the song she collaborated with him from streaming music platforms. jericka duncan, cbs news, new york. an arizona woman who delivered a baby while in a vegetative state apparently had a medical exam nearly nine months before giving birth. the 29-year-old was impregnated after being sexually assaulted at a long-term care facility and gave birth last month. court documents show she received a physical exam in april, and it found no signs of pregnancy. medical experts say it's

"the houston chronicle" has the story of a 12-year-old girl who launched her own fashion line and became a messenger of hope after being the target of racial bullying.

chain tumbled more than 17% after it reported weak holiday sales and cut its sales and profit outlook for the fiscal year. the plunge pulled down other retailers, as well. and at&t says it will stop selling customers' location data to third-party service providers amid calls for a federal investigation. this follows a report from the website motherboard earlier this week that showed how bounty hunters can track phone locations using carrier data. senators including kamala harris of california and roy wyden of oregon are calling for government action to restrict location data sales. and fiat chrysler is recalling more than 1.6 million vehicles worldwide due to the risk of potentially lethal exploding airbags. the italian american automaker says front passenger airbag inflators made by japanese maer. it includes vehicles manufactured between 2010 and 2016 including jeep wrangler
