captioning funded by cbs good morning. from the studio 57 newsroom at cbs headquarters here in new york. pleased to be with you. i'm anne-marie green. virginia's governor ralph northam is facing new pressure to resign over a racist photo. and his lieutenant governor faces misconduct allegations from his past. marc liverman is here with details on both of the accusations, marc, good morning. >> good morning, anne-marie, the controversy keeps getting worse and worse for the governor as more political leaders and protesters call for him to step down, but governor northam said he didn't do anything wrong here. >> i am not the person in that photo. >> reporter: the photo governor ralph northam is referring to shows a man in black face. another person can be seen dressed as a member of the ku klux klan. the image resurfaced last week

after first appearing in northam's 1984 medical school yearbook page. on friday, northam apologized for the photo, and then a day later, he denied being in it and refused to step down as governor amit protests. >> what we're saying, his actions in his past and continuing to stand forth as our governor is not welcome. >> he's lost the authority to continue to governor. >> reporter: both democrats and republicans have been calling for the governor's swift departure. >> regardless of the veracity of the photograph, the governor has lost the confidence of the people and cannot effectively govern. >> reporter: northam met with his cabinet and senior staff yesterday to hear their assessment of whether it was feasible for him to stay in office. that's according to several published reports. this as the lieutenant governor in line to replace northam faces allegations of his own. justin fairfax denies accusations he sexually assaulted a woman at the democratic national convention

back in 1984. those allegations are from the same website that exposed northam's yearbook. >> obviously, you don't have to be a political genius to understand that this is a complete smear. >> reporter: fairfax says the encounter was consensual. and while denying being in that controversial photo, northam did apologize for once darkening his skin while dressed as michael jackson for a dance contest in 1984, president trump is also weighing in on all of this, in a tweet, he called the allegations, quote, unforgivable. anne-marie. >> marc liverman, thanks a lot, marc. president trump is expected to call for optimism and unity in tonight's state of the union address. the speech comes the government shutdown. natalie bland is in washington with the details. natalie, good morning. >> reporter: good morning, anne-marie, this speech really comes at a critical time, right in the middle of congressional negotiations over border security and immigration. that expected to be a key part of the speech tonight.

president trump is expected to call for unity as he speaks to a divided congress tonight during his second state of the union address. >> a looming question is just how many falsehoods, distortions and madeup facts will appear in the president's speech. >> reporter: the president and democrats have remained at odds over border wall funding, a $5.7 billion sticking point that caused the recent 35-day government shutdown. >> we're going to have a strong border. and the only way you have a strong border, you need a physical barrier, you need a wall. >> reporter: lawmakers have just ten days to strike a deal and avert another shutdown. aides to president trump said they'll preach bipartisanship. >> you'll also see the president call on congress and say, look, we can either work together and get great things done or fight and get nothing done. >> reporter: the president may

circumvent that by declaring a national emergency to build his wall. >> you'll hear the state of the union and then you'll see what happens right after the state of the union. >> reporter: some members of his own party aren't sure he should go that far. >> i think there's dubious constitutionality. >> and this will be just another erosion of congressional authority in this particular area. with that being said, the president is absolutely right, we need better barriers. >> reporter: and delivering a democratic response to the president's speech will be stacey abrams who narrowly lost herred her bid to become georgia's first black governor. and in the house chamber tonight there will be dozens of invited guests, between the president and congress. they will highlight the various debates in congress from immigration and border security to gun violence. we know that some members of congress are also bringing federal workers impacted by the recent record shutdown >> natalie brand in washington. thanks a lot, natalie. cbs' live coverage of the state union begins at 9:00 tonight.

8:00 central. after the president speaks all four co-hosts of "cbs this morning" will be on a special live edition of steven colbert right here on cbs. cbs news has confirmed federal prosecutors in new york have issued a subpoena seeking documents from president trump's inaugural committee. they're investigating possible financial crimes relating to more than $100 million in donations the committee raised. the federal law prohibits foreign contributions to federal campaigns, political action committees and inaugural funds. the subpoena also asks for information about inaugural event it's and attendees. the committee says it will cooperate with the inquiry. the u.s. is preparing to begin construction of more border walls and fencing in texas. u.s. customs and border protection will start building on federally owned land this month. last year, congress approved more than $600 million, for 33 miles of new barriers. in the rio grande valley.

president trump and top democrats remain in a standoff over the president's demand for $5.7 billion in border wall funding. the deadline to reach a deal is next friday, or face another government shutdown. jury deliberations continue today in the federal trial of drug case of joaquin "el chapo" guzman. the new york jurors had the case for about three hours yesterday. the jury of eight women and four men have been on the case for almost three months. guzman has pleaded not guilty to 17 counts including drug trafficking and money laundering charges. if convicted he faces life in prison. winter storm warnings are posted across the west coast and more snow is expected today. snow and strong winds are expected to batter the northern and southern part of california. heavy rain in malibu is causing mudslides and flash flooding. some ski resorts in tahoe area were closed yesterday because they got up to nine feet of snow. and about half a foot of snow in

he lived in nevada. the twin-engine cessna crashed in loma linda sunday after taking off from fellowton airport. pastini's daughter said he was a veteran pilot. the cause of the crash is under investigation. "people" reports on actor kristoff st. john. >> it sounds like you needed to confess. it's tough to find a sympathetic ear. >> st. john played a struggling alcoholic and ladies man neal winters for 27 years on the cbs soap opera. he was found sunday dead at his los angeles home. there's no word on the cause of death. st. john won nine daytime emmy nominations. he won an emmy in 1992. for outstanding young actor in a drama series. cbs and sony pictures called his death heartbreaking. kristoff st. john was 52.

the trump organization has fired at least 18 undocumented workers from at least five trump golf courses in new york and new jersey in the past few months. the president's son eric confirmed the firing. it began after a series of news report about the club's employment of workers of illegal status. the trump organization the e-verify electronic system to check the status of all employees. britain's independent reports that actor liam neeson is facing allegations of racism after he wanted to kill a, quote, black bastard, after he find out someone had been raped. in an interview, neeson said after being told the person was black, he hoped a black person would come out of a club and have a go at him about something so he could kill him. he made the comment on the set of a movie about a father with revenge. neeson looks back on the incident with shame and regret and called his reaction horrible.

after the close today. now, on monday, dow rallied 175 points. the s&p 500 added 18 and the nasdaq rose 83. a federal bankruptcy judge has approved a major debt restructuring plan for puerto rico. the deal allows puerto rico to cut its sales tax back debt by 32%. it's expected to help the government save an average of $456 million a year in servicing debt. the government will have to pay $32 billion in the next 40 years as part of the restructuring. in 2015, puerto rico's governor declared it was unable to repay its public debt. on the retail front, charlotte russe filed for chapter 11 bankruptcy and plans to close 94 stores. the young woman's clothing chain becomes the latest mall retailer to file for bankruptcy protection. charlotte russe suffered from dramatic reduction in sales and instore traffic. chicago o'hare airport is

to gillette stadium with the lombardi trophy. a new study finds cancers linked to obesity are on the rise among millennials. the findings were just released by the american cancer society. adriana diaz reports. >> reporter: in young adults ages 25 to 29, over the last 20 years, kidney cancer rates increased 6.2 every year. pancreatic, gallbladder and endometrial cancers are also rising. when baby boomers were younger, their risk of some of these obesity-related cancers were half the rate than 30 somethings today. >> millennials are seen as health conscious, but this study would suggest that might not be the case. >> reporter: excess body weight is a known carcinogen. this doctor researcher. what is it specifically about fat cells that might be contributing to cancer? >> those fat cells over time
