good morning from the studio 57 newsroom at cbs headquarters here in new york. good to be with you. i'm anne-marie green. a budget deal to avert a government shutdown is headed to president trump's desk after being approved by congress. while mr. trump is expected to sign it, he announced that he will also declare a national emergency to get more money for a border wall. marc liverman is here with reaction. good morning. >> reporter: good morning, anne-marie. a national emergency declaration may come as a surprise to some lawmakers, but the president has been talking about it for months to get his wall. the move is already coming with a lot of pushback from democrats and even some republicans. president trump is planning to declare a national emergency today, arguing the situation at the southern border is a humanitarian crisis. >> the yeas are 83, the nays are 16.

>> reporter: overwhelm congress overwhelmingly approved a spending package to avoid a government shutdown. >> the yeas are 300, the nays are 128. >> reporter: included is $1.4 billion for border fencing, far short of the $5.7 billion president trump wanted for a wall. >> he's prepared to sign the bill. he will also be issuing a national emergency declaration at the same time. >> reporter: declaring a national emergency would give the president the authority to redirect funds from other projects without congressional approval. >> taking from far less -- really from far less important areas. >> reporter: democrats are expected to challenge the order. >> we will not have an end run around the congress of the united states. >> reporter: president trump himself has argued against it. in a 2014 tweet he said president obama was subverting the constitution because he's unable to negotiate with congress. >> what if it's bernie sanders and he declares climate change? >> reporter: the precedent it sets for the future democratic

president. >> if the president doesn't do it we'll have a lot more problems than this. >> reporter: in a cbs news poll two-thirds of americans said president trump should not declare a national emergency. democratic leaders haven't said how they'll challenge the president's emergency declaration, but it is expected to be immediately contested in federal court. anne-marie? >> all right, marc liverman here in new york. thanks a lot, marc. there's new fallout from explosive comments by former deputy director of the fbi andrew mccabe. in an interview with "60 minutes," he describes why he was so concerned in a meeting with the president after fbi director james comey was fired two years ago. paula reid reports. >> i was speaking to the man who had just run for the presidency and won the election for the presidency and who might have done so with the aid of the government of russia, our most formidable adversary on the

world stage. and that was something that troubled me greatly. >> reporter: mccabe says days later he opened criminal and counterintelligence investigations into the president. >> i wanted to make sure that our case was on solid ground, and if somebody came in behind me and closed it and tried to walk away from it, they would not be able to do that without creating a record of why they made that decision. >> reporter: mccabe told "60 minutes" correspondent scott pelley that following comey firing, deputy attorney general rod rosenstein brought up the 25th amendment which gives the majority of the cabinet and the vice president the power to remove the president from office. mccabe says he was also part of discussions with the deputy attorney general when he said rosenstein offered to wear a wire inside the white house. in the interview, he said the proposal was so serious he took it to the general counsel of the fbi. in a statement the justice department said rosenstein never authorized a wire, although it does not deny it was discussed.

the president punched back on twitter writing, "mccabe is a disgrace to the fbi and a disgrace to our country." in poland, vice president mike pence called the suggestion to remove mr. trump from office absurd. >> i have never heard any discussion of the 25th amendment by members of this government, and i would never expect to. >> reporter: mccabe was fired last year after an inspector international investigation found he lacked candor in relation to a leak to a reporter. his case was referred to the u.s. attorney in d.c. for possible criminal charges. paula reid, cbs news, the white house. today is william barr's first day on the job as attorney general. he was sworn in yesterday after the senate confirmed him in a 54-45 vote. barr will overview the remaining work in special counsel robert mueller's russia investigation. democrats are pressing him to make the report public when it's finished, but he has not committed to it.

lawmakers in new york are weighing in on amazon's decision not to move there after all. there had been mounting opposition in recent weeks to the tech giant's plan to build part of a second headquarters in new york city. wendy gillette has that story. >> reporter: amazon decided it's not going where it's not wanted. the company reversed plans for building a new york city headquarters after opposition from the community. >> there was no conversation about how the infrastructure of new york city would be able to handle amazon's presence here. well, the news for amazon is that they're not bigger than new york city. >> reporter: amazon's new faclity would have brought 25,000 jobs to the city. but local politicians were infuriated the company was offered $3 billion in tax breaks. in washington, newly elected democrat alexandria on, casio -- alexandria ocasio-cortez called it a

victory for everyday new yorkers. >> we were looking at a deal that was not primarily putting the community first, and i think th wabsotely come together to create an economic plan that actually invests in new yorkers. >> reporter: this is the queens neighborhood where amazon was planning to build its headquarters. new york competed against more than 200 cities to land the project. new york governor andrew cuomo had argued the company would transform long island city into an invigorated, high-tech powerhouse. he accused the state senate of doing tremendous damage and of losing an economic opportunity. it would have benefited rockaway brewing company across the street from where the headquarters was planned. what was positive about amazon coming here? >> i think the attention the city was going to give us in terms of new sewers, infrastructure for trains, you know, schools. dit thchanf amazon says it's more than 5,000 employees in new york and promises to add more. wendy gillette, cbs news, long island city, new york. two people are being questioned as persons of interest in the investigation into the alleged attack against actor jussie smollett. chicago police raided the home of two brothers last night.

cbs chicago station wbbm reports police took bleach, shoes, electronics, receipts, and other items from the home. a source tells wbbm police are looking into whether the men helped smollett stage the attack. this comes amid reports smollett was being dropped from the show "empire" which writers of the series dispute. chicago police say allegations about the attack being a hoax on unconfirmed. smollett told "good morning america" in an interview that aired yesterday that he's angry some people do not believe he was attacked. >> if i had said it was a muslim or mexican or someone black, i feel like the doubters would have support me a lot much more, a lot more. >> the men being questioned are reportedly of nigerian descent and have appeared on "empire." smollett has told police two white men attacked him. he was questioned again yesterday and is said to be

several traffic lights fell at the same time at a busy intersection yesterday in the boston suburb of burlington. one vehicle was forced to slam on the brakes to avoid hitting the lights on the pavement. police say it appears a cable broke. officers spent hours detouring traffic. nasa is planning to return to the moon, and a new r. kelly sex tape has emerged. those are some of the headlines on the morning newsstand. "variety" says prosecutors are moving to indict r. kelly as a new sex tape surfaced. attorney general michael avenatti said he gave new york prosecutors a new video purportedly showing kelly having sex with an underage girl. avenue neat has been retained by multiple people bringing allegations that kelly sexually assaulted minors. for years he and his lawyers denied sexual misconduct allegations involving women or underage girls. "the new york times" says the fbi is looking into whether singer ryan adams committed a

crime by engaging in sexually inappropriate communications with an underage teen. she claims the communication with adams began when she was 14 she's now 20. until she was 16.- adams denies having inappropriate online sexual communications with someone he knew was under age. several women have accused adams of sexual misconduct. and "the atlanta journal constitution" reports 28 students at a georgia middle school were taken to hospitals after eating candy and snacks on valentine's day. several students at sandtown middle school in south fulton county complained about feeling sick after ingesting the items. they were checked by paramedics and sent to hospitals. they are being monitored. an investigation is underway to find the cause of the illness. now our partners at cnet report nasa is looking to get back to the moon perhaps as early as this year. the space agency said it intends to partner with private companies to land a u.s. spacecraft on the lunar surface

♪ on the cbs "money watch," facebook is facing a record fine, and the first major u.s. bank is launching its own cryptocurrency. diane king hall is at the new york stock exchange with that and more. good morning, diane. >> reporter: good morning, anne-marie. pepsico reports its fourth quarter earnings before the opening bell today. pepsico's biggest rival, coca-cola, got hammered yesterday. shares of coke had its worst one-day performance in over a decade. as for the broader markets, stocks finished mixed. the dow lost 103. the s&p 500 fell seven, while retail sales fell in december, turning in the worst performance since september, 2009. that's what rattled the market. the government report says sales at stores, restaurants, and on

line fell 1.2% in december from november. the performance was so poor some analysts questioned the report's accuracy. on average, retail sales during the holiday season have risen about 4% from november to december. facebook is allegedly facing a record-breaking fine for its recent privacy lapses. the "washington post" reports the company is negotiating an agreement with the ftc that would result in a multibillion dollar penalty. an investigation into facebook's privacy practices began last year following the cambridge analytica scandal. this could amount to the largest penalty ever levied against a tech company in the u.s. meanwhile, general electric is downsizing its world headquarters. the company has been restructuring its boston operations amid sagging profits. g.e. will also return $87 million massachusetts spent in an incentives package to lure the company there from connecticut three years ago.

♪ relentless rain in southern california is causing major problems on the roads. sinkholes are prompting closures and detours. people in riverside county were told to shelter in place because of unsafe road conditions yesterday. according to the california highway patrol, one part of the highway was actually washed away by the storm north of idlewild. some monks in arkansas are tapping into the beer business. a monastery about 100 miles from little rock is brewing and selling its own beer under the country monks brewing label. it received a brewing license just two months ago. the monks make three types of beer, pale ale, amber, and stout, and say they enjoy the beer themselves, and the profits go to helping elder monks. and a colorado man is sharing a frightening story about his sudden encounter with

a mountain lion. mireya villarreal has more on the life-and-death struggle. i remember looking down and seeing the claws. >> reporter: travis kauffman says he was alone on a midday run along the trails of horse tooth mountain park when he heard a noise. >> i turned around, and just was bummed out to see a mountain lion chasing after me. it grabbed on to my hand and wrist. and from there, it started to claw at my face and neck. >> reporter: kauffman who is 5'10" and about 155 pounds says his fear became a primal struggle to survive. >> i stepped on its neck with my right foot. finally stopped moving, and then jaws opened, and i was able to scramble back up the hill and get the heck out of dodge. >> reporter: parks and wildlife officials have captured two more juvenile mountain lions they believe are the siblings of the one involved in the attack on

our top stories this morning -- president trump plans to sign a massive budget deal that will prevent a government shutdown. the bill, however, does not give the president the funding he's demanding for a border wall. mr. trump is expected to declare a national emergency to get that funding. and president trump is calling andrew mccabe a disgrace. the former fbi deputy director told "60 minutes" he launched an obstruction of justice investigation involving the president after the firing of former fbi director james comey. mccabe also said justice department officials discussed constitutional procedures for removing a sitting president from office. each year nearly 12,000 very low birthweight babies are born with a common heart defect.

now the fda has approved a new device that can treat the tiniest of babies. tracy townsend has details. >> reporter: irie and judah felkner are typical toddlers according to their mom, crisa. >> they're fighters, both of them are. >> reporter: the twins have been through a lot. you haven't been able to hold them. >> no, no. >> reporter: more than 13 weeks early they were fighting for their lives, then the diagnosis that irie, one pound, 13 ounces, had a heart condition, pda. >> i was truly scared that we were not going to bring her home. >> reporter: a potentially life-threatening opening between two blood vessels leading from the heart which increases blood flow to the lungs making it hard to breathe. doctors told the couple about a new device to close the opening called the piccolo. smaller than a pea, the device from abbott can be implanted in

i am michelle griego . >> good morning. i am kenny choi. authorities in sonoma county are keeping a close eye on the russian river which crested this morning and above flood stage. the sonoma county sheriff department is asking people to evacuate living along the low- lying areas of the russian river and its tributaries. these are advised orders and not mandatory. we will have a live report in the next half hour. the levy breach in novato has shut down westbound highway 37. the closure will likely last throughout the morning. all of the rainfall overwhelmed the creeks, sending rushing water through the levy. the water was so strong it washed away the foundation of this railroad bridge. the crumbling roadway, you can see chunks of the be
