good morning from the studio 57 newsroom at cbs headquarters here in new york. good to be with you. i'm anne-marie green. a high-profile republican lawmaker says the senate judiciary committee will investigate bombshell claims made by former deputy director of the fbi andrew mccabe. senator lindsey graham says that he will subpoena mccabe following claims that he discussed the possibility of ousting president trump through the 25th amendment. mccabe made those claims in an interview with scott pelley on "60 minutes." mccabe also detailed a conversation he said he had with deputy attorney general rod rosenstein. a conversation rosenstein says never happened. >> the deputy attorney general offered to wear a wire into the white house. he said, "i never get searched when i go into the white house, i can easily wear a recording device. theyn's there." >> ahead on "cbs this morning," more on andrew mr. speaker cabe's interview

on "60 minutes." multiple states are considering suing president trump over his national emergency declaration. the move was to secure funding for a wall along the southern border. marc liverman's here in new york with the challenge the president's emergency plan faces in congress. marc, good morning. >> reporter: good morning, anne-marie. that challenge in congress won't be the only one. it's been just a couple days since president trump's emergency declaration, and it's already beginning to face several legal challenges. and we will likely hear of more in the coming days and weeks ahead. president trump appears prepared to issue his first veto if congress votes to block his national emergency declaration along the border with mexico. >> he's going to protect his national emergency declaration, guaranteed. >> reporter: white house senior adviser steven miller said on "fox news" sunday the president has the right to take action on the border under the national e. >> if the president cannot defend

this country he cannot fulfill his oath of office. >> reporter: the president declared the national emergency friday. lawmakers refused to give the billions of dollars he demanded for the border wall. the move would free up $8 billion for the wall by shifting it away from the defense department and other agencies. >> sadly, we'll be sued, and sadly it will go through a process, and happily we'll win -- i think. >> reporter: democratic senator chris coons said on "face the nation" that congress needs to defend its power over the budget. >> we should not set the terrible precedent of letting a president declare a national emergency simply as a way of getting around the congressional appropriation process. >> reporter: california's attorney general told abc's "this week" his state would sue to block the emergency order. >> there is enough evidence to show that this is not the 9/11 crisis that we faced back in 2001. it's not the iran hostage crisis we faced in 1979. >> reporter: house democrats have said they plan to introduce a resolution to stop the emergency declaration.

the american civil liberties union and public citizen also say they are planning to bring legal action against the emergency declaration. anne-marie? >> all right, marc. marc liverman here in new york. thank you very much. the state department says president trump will make an announcement about a new u.n. ambassador nominee very soon. heather nauert announced that she was withdrawing her name from consideration. cbs news confirms a nanny issue came up during her background check that may have caused a problem during congressional hearings. "bloomberg" reports the immigrant nanny was in the u.s. legally but was not authorized to work. the president announced that he was picking nauert in december, but her formal nomination still needed senate confirmation. chicago police want to re-interview actor jussie smollett after new evidence emerged about the attack against him. sources tell cbs news two brothers told police smollett paid them to stage the attack. tony dokoupil has the details.

>> reporter: a celebrated young actor -- >> regarding a friend that was assaulted and battered. a noose was placed over the friend's neck. >> reporter: a heinous crime. but was it staged? according to a chicago police source, authorities are investigating that very question. just four weeks after "empire" star jussie smollett first described a racist, homophobic attack that shocked the country. >> i see the attacker -- masked, and he said, "this is maga country [ bleep ]," punches me in the face. >> reporter: days after smollett went public with new details. >> i noticed the rope around my neck, and i started screaming, i said, "there's a [ bleep ] rope around my neck," saying, quote, he was pissed off some people didn't believe him. >> it's the truth. >> reporter: new evidence shifted the trajectory of the

investigation after detectives arrested two nigerian brothers. they were seen on surveillance video the night of the incident, and police found rope, masks, and bleach in their apartment. but they were released friday after the brothers told police they bought the rope at a nearby hardware store and participated in the attack at smollett's request, according to a chicago police source. smollett also allegedly paid them. glorious schmidt is the brothers' attorney. >> now evidence that was brought to their attention. obviously i had it, obviously my clients had it. >> reporter: through his lawyer, smollett said he's been angered and devastated by reports that he played a role in his own attack adding, "nothing is further from the truth." police have more investigative work to complete. one of the nigerian brothers had been an extra on "empire," and one was also smollett's trainer according to his attorney. smollett for his part has said he will be forever changed by the incident. tony dokoupil, cbs news, new york.

the illinois manufacturing company where a gunman killed five employees is set to reopen today. mourners gathered at the henry pratt company in aurora over the weekend to remember the victims of friday's mass shooting. the shooter, 45-year-old gary martin, used a gun he was not allowed to have. a neighbor of one of the victims expressed his anger at the government for not properly protecting citizens. >> you need to step up your game. you want everybody to pay more money and pay more taxes and do all of these things, and yet you can't stop people from going into work buildings and -- and shooting people up. and you can't keep people from going into schools and shooting up schools. like, where is this extra money going? we need to put it in the right places. we need -- we need stuff done. we need it done now. >> six people including five police officers were hurt. the gunman was killed in an exchange of gunfire with police. a winter storm warning is in effect in parts of the northeast this morning.

the storm already hit the midwest causing dangerous travel conditions over the weekend. up to five inches of snow was reported in madison, wisconsin. sarah wroblewski from our boston station wbz has the forecast. >> reporter: tricky travel expected across the northeast as the storm system will pass to the south providing some light snow. rain from the mid-atlantic down across the southeast. watching for scattered snow showers across the rockies, as well as parts of the southwest. additional accumulation there. also about three to six inches of snow across parts of the northeast where temperatures will be borderline near the freezing mark. improvement, though, from d.c. to atlanta on monday. and then if you're headed to the northern tier states, temperatures, 20 to 35 degrees below average. we'll also be watching as a storm system develops during the middle part of the week on tuesday through the plais and moisture from the gulf of mexico. this storm system will push into the missouri valley, ohio valley, by wednesday. and eventually pushing snow into the northeast before a

the pilot says high winds were blowing the balloon toward power lines yesterday when he was forced to set it down in a marshy area near vallejo. rescue helicopters carried the pilot and passengers to safety. at least one person reportedly suffered minor injuries. a new york police commander is accused of threatening rapper 50 cent, and a disgraced ex-politician is released from prison. those are some of the headlines on the "morning newsstand." "the new york times" reports former new york congressman anthony weiner is out of federal prison. weiner was released from the massachusetts prison after serving 15 months for allegedly exchanging sexually explicit texts and photos with a 15-year-old girl. he was supposed to serve 21 months but was granted early release for good behavior. he was transferred to a re-entry center in brooklyn. weiner is scheduled to be released in may. he must register as a sex offender for rest of his life. "the new york daily news" reports police sources say a new

york city police department precinct commander is being investigated for allegedly threatening the life of rapper 50 cent. deputy inspector emmanuel gonzalez allegedly made the threat last june. he reportedly told officers if they saw 50 cent at a boxing match, that he was expected to attend to, quote, shoot him on sight. gonzalez had an ongoing beef with the rapper. the rapper had accused him of shaking down a club. the police department says the incident is under internal review. our partners at the bbc report a british teenager who ran away from home to join isis has given birth to a baby boy. 19-year-old shamima begum is living in a syrian refugee camp and says that she wants to return home. she was one of three schoolgirls from london who went to syria in 2015 to marry isis fighters. she gave birth to another boy and a girl during her time living with isis. >> i was sleeping outside. and there was no medical care.

so i was always getting sick. kids died because of the sickness. >> begum and her new baby are reportedly in good health. when asked if she to syria, she said she doesn't have any regrets. the "los angeles times" reports despite the area's mild temperatures, more homeless people die of the cold than they do in new york city. five homeless people died of hypothermia-related causes last year. new york and san francisco reported two such deaths. authorities say it's because the homeless in l.a. live outdoors. there are 39,000 homeless people there. the most of any metropolitan area in the country. and the "washington post" reports british lawmakers accuse facebook of intentionally violating the country's privacy and competition laws. parliament issued a report saying for years facebook was willing to override users' privacy settings to monetize the personal information it obtained. it also said facebook put its competitors at a disadvantage by

on the cbs "money watch," hundreds of passengers are stranded after an airline shuts down, and director james cameron dominates the box office. tom hanson is here in new york with that and more. good morning, tom. >> reporter: good morning. good to be with you. asian markets finished higher this morning with trade talks between the u.s. and china set to continue is wee washington. both parties reported progress following negotiations last week in beijing. now president trump says the u.s. is close to reaching a deal. the president also discussed the possibility of extending the march 1st deadline. that's when additional tariffs on chinese goods would go into effect if a deal isn't reached. and a british regional airline ceased operations leaving hundreds of passengers stranded across europe. british midlands regional limited, the airline that operates as fly bmi, made the announcement after filing for

bankruptcy over the weekend. the company says the decision was made because of inflated fuel costs and uncertainty over britain's departure from the european union. and a jury has awarded more than $151 million to a man paralyzed in a 2015 rollover accident involving a ford explorer suv. travaris smith was riding in the suv when its driver swerved to avoid an animal and the vehicle rolled over. the jury found the 1998 ford explorer did not meet ford's own safety guidelines and that ford acted wantonly in designing the vehicle. ford plans to appeal. the sci-fi fantasy "alita: battle angel," topped the box office in its debut. >> she is threatening the natural order. i need you to destroy her. alita, he will come for you. >> i'll have to face him head on. >> the james cameron-produced film outperformed expectations and earned more than $27

here's a look at the forecast in some cities around the country. ♪ a group of florida inmates out on work release turned into rescuers to get a baby out of a locked suv. the 1-year-old girl's parents accidentally locked her in the vehicle last thursday. they said they couldn't afford a locksmith, and the father planned to break a window. five inmates repairing a parking lot nearby offered to help.

they helped pry open the front door, and one of the inmates used a coat hanger to unlock the suv. the baby was just fine, and the parents thanked everyone for their help. a lot of scoring and not much defense on display at last night's nba all-star game in charlotte. team lebron james defeated their opponent 178-164. team lebron was down in the second half by 20 but battled back in the third to take the lead. kevin durant scored 34 points and was named mvp. it's the second all-star mvp award for him. giannis antetokounmpo led everyone for the bucks with 38 points. and sad news from within our cbs news family. award-winning longtime former cbs executive producer perry wolff has died. wolff won numerous peabody
