guard planned to kill as many people as possible. who was on his hit list. and pope francis kicks off the first-ever vatican summit to address scandals and sex abuse within the catholic church. ♪ good morning from the studio 57 newsroom at cbs headquarters here in new york. good to be with you. i'm anne-marie green. chicago police are working with jussie smollett's attorneys on a plan for the actor to turn himself in after he was charged yesterday with making a false police report when he said he was attacked last month. meanwhile, cbs chicago station wbbm obtained store surveillance video of two brothers buying items possibly worn in the alleged assault that smollett is accused of orchestrating. marc liverman has the latest. marc, good morning. >> reporter: good morning. if smollett is convicted of those felony charges, he could face up to three years in prison and be forced to cover the cost of the investigation. we're also learning more and more about how police say he

pulled it off and the men he used to do it. the charges against "empire" actor jussie smollett are for disorderly conduct and allegedly filing a false police report. it's a stunning turn of events after smollett said two masked men attacked him in chicago last month. >> i can't tell you what color their eyes were, i can't tell you -- and i did not see anything except the second person i saw running away. >> reporter: as the case drew more national attention, smollett refused to meet again with detectives. last week two brothers were questioned and held after they were seen on surveillance video the night of the alleged homophobic and racist attack. ola and abel osundairo said smollett paid them to stage the attack. >> they say he's lying. what do you think of that? >> i think jussie should come clear because the truth will set him free. >> reporter: the brothers were questioned for more than two hours before a cook county grand jury while smollett met with

prosecutors and detectives. sources tell cbs news detectives plan to look through smollett's bank and cell phone records. his lawyer said their client enjoys the presumption of innocence and that they intend to thoroughly investigate and mount an aggressive defense. the fbi and postal inspectors are also examining a threatening letter mailed to smollett. they're looking into whether the actor was behind that, too. anne-marie? >> marc liverman here in new york. thank you very much. for the first time, nearly 200 church leaders around the world are meeting with pope francis this morning to formally address the clergy sex abuse scandal. the four-day summit at the vatican is intended to focus on responsibility, transparency, and prevention. survivors met with organizers yesterday insisting on zero tolerance for abuse. they also want religious leaders to be held accountable if they cover up for priests who rape and molest children. back home a u.s. coast guard lieutenant who prosecutors are

calling a domestic terrorist is due in federal court in maryland today. christopher hasson is a self-identified white nationalist. agents found a cache of weapons and a hit list targeting lawmakers and journalists when they raided his home last week. david martin reports from the pentagon. >> reporter: the motion to keep coast guard lieutenant christopher hasson in jail until he's brought to trial warns that he intends to murder innocent civilians on a scale rarely seen in this country. it quotes a draft e-mail in which he says, "i am dreaming of a way to kill almost every last person on the earth. start with biological attacks followed by attacks on food supply. institute a bombing sniper campaign." when federal agents searched his basement apartment in the suburbs of washington, they found 15 firearms and over 1,000 rounds of ammunition. they also found a hit list which reads like a who's who was liberal politics.

speaker of the house nancy pelosi, senate democratic leader chuck schumer, and presidential contender senator kerstin gillibrand, elizabeth warren, kamala harris, and cory booker. the list includes television anchors from msnbc and cnn. according to court documents, hasson, who once served in the marines, described himself as a longtime white nationalist who supports the idea of a white homemade. he read the writings of a norwegian terrorist who eight years ago went on a rampage which killed 77 norwegians. many of them teenage summer campers. david martin, cbs news, the pentagon. special counsel robert mueller's final report on russian interference in the 2016 presidential election may be coming soon. sources tell cbs news the report is expected to be delivered to the justice department before deputy attorney general rod rosenstein leaves his post in march. there's no legal requirement for a newly installed attorney general, william barr, to share

the findings publicly. house democrats have threatened, though, to subpoena the full report if it's not released. an isis bride who claims to be an american citizen will not be allowed to return to the u.s. hoda muthana ran away to join isis in syria several years ago but now wants to come them to. -- to come home. holly williams has more. >> reporter: president trump tweeted that he'd instructed secretary of state mike pompeo not to allow hoda muthana back into the country. the state department said muthana had no right to return because she, quote, is not a u.s. citizen. but muthana's family say she is an american citizen. they've given us a copy of what they claim is her birth certificate showing she was born in hackensack, new jersey, in 1994, and they say she held a u.s. passport. muthana even seems to have tweeted a photograph of it in 2014 claiming she was going to burn it. hasson shibley is the family's

lawyer. >> at the end of the day, she's a u.s. citizen. whether americans make crimes or not, that doesn't deprive them of their citizenship. >> reporter: if she's been stripped of u.s. citizenship, it's apparently news to her family. >> she's literally trying to turn herself in to the u.s. government, to be held accountable to our laws, to pay any debts she may have for society. >> reporter: hoda muthana was studying business at the university of alabama in 2014 when she told her family she was going on a school trip. instead, flying to the middle east and crossing into isis territory in syria. she's now in a refugee camp with many other isis wives and children and apparently remorseful. >> i know i've ruined my future and my son's future. and i deeply, deeply regret it. >> reporter: if the u.s. government won't recognize her as a citizen, she may be there for some time. the family lawyer told us that they will challenge the u.s. government in court asserting that hoda muthana is an american citizen and has the right to go home where she would

oakland public schools. >> teachers in oakland, california, expected to become the latest educators to go on strike. union officials representing 3,000 city teachers say that a strike will start today after negotiations with the school district fell apart yesterday. teachers say their salaries are not keeping up with the expensive cost of living in the san francisco bay area. officials say schools will stay open staffed by nonunion employees and substitutes. nike is feeling the heat after a sneaker failure, and a new data breach. those are some of the headlines on the "morning newsstand." "the seattle times" reports a university of washington medicine web server mistakenly exposed the information of nearly one million patients. officials say the data was exposed on december 4th and was visible on the internet for three weeks. they blame it on an internal human error. the organization says the files contain patients' names and medical record numbers but no medical records, financial

information, or social security numbers. some of the files contain the name of a lab test or the name of a research study. "usa today" reports a member of the federal jury that convicted mexican drug lord joaquin "el chapo" guzman says that at least five jurors looked at media coverage of the trial despite the judge's order not to. the unidentified juror said fellow jurors checked twitter and other media outlets for reports. the juror says that several panel members read about allegations that guzman drugged and raped underage girls even though that evidence was kept out of the trial. a lawyer for guzman called the report deeply concerning and distressing. "the chicago tribune" reports a lawyer for singer r. kelly says the musician is moving out of his chicago recording studio. that's after a judge ordered him to not be creative between 9:00 p.m. and 9:00 a.m. the studio is facing 67 building code violations including that it is being used as a residence.

threw her a baby shower at the mark hotel. among the guests were amal clooney, her former "suits" tv co-star abigail spencer, and "cbs this morning" co-host gayle king. this is her first trip back to the u.s. since her marriage to prince harry. the baby is due in april. the face of the boy scouts is changing. this month for the first time in 100 years, the boy scouts of america began accepting applications for all-girl troops between the ages of 11 and 17. girls across the country are becoming part of what used to be called the boy scouts. the new name of the organization is scouts bsa. girls in indiana recited the oath along with the pledge of allegiance. they are now earning the same awards, recognition, and badges as the boys. girls can now earn the rank of eagle scout, the highest level in the program. and visitors to the los angeles federal courthouse are getting a chance to see abe lincoln like they have never seen him before -- on display is a statue of a young, shirtless lincoln.
