"empire" actor jussie smollett remains out on bond this morning, charged with filing a false police report. chicago police say smollett staged his own attack, and they offered a motive. marc liverman is here in new york with the latest on this bizarre investigation. marc, good morning. >> reporter: good morning, anne-marie. police say smollett wasn't happy with how much money he was making on the show and wanted to bring attention to himself. that attention might have cost him his freedom. >> anything to say? >> reporter: police say jussie smollett was upset with his almost $2 million-a-year salary on "empire" and staged an assault on himself to get publicity. >> you do such a disservice when you lie about things like this. >> reporter: in recent weeks, smollett went from victim to suspect.

ie johnson expressed anger. >> bogus police reports cause real harm. they do harm to every legitimate victim who's in need of support. >> reporter: authorities say smollett staged the early morning attack last month, paying two brothers to make it look like a racist, homophobic assault by trump supporters who draped a noose around his neck. in a statement last night, smollett's legal team says he feels betrayed by a system that apparently wants to skip due process and proceed directly to sentencing. as for the attack, police say it was all an act, one he planned and rehearsed. >> the brothers had on gloves during the staged attack where they -- they punched him a little bit. but as far as we can tell, the scratches and bruising that you saw on his face was most likely self-infli self-inflicted. >> reporter: smollett faces a felony disorderly conduct charge that carries a maximum of three years in prison. he remains free on $100,000

bond. and according to a source close to the fox tv network, after smollett was leased he went to the "empire" set in chicago where he denied the charges and apologized to the cast and crew. anne-marie? >> very interesting. marc liverman here in new york, thank you so much. north carolina's elections board has ordered a do-over in the last congressional race in the nation that is still undecided. no date has been set for the new election. republican mark harris ended his fight to be declared the winner after evidence of ballot fraud. david begnaud reports from raleigh. >> reporter: nobody expected this announcement. it was met with audible gasps. >> i believe a new election should be called. it's become clear to me that the public's confidence in the ninth district seat general election has been undermined to an extent that a new election is warranted. >> reporter: that is republican mark harris who beat democrat dan mccready by 905 votes last november. the race was never certified because the guy harris hired to

get out the vote was accused of built on fraud. specifically hiring works to illegally collect absentee ballots and request forms, forging voter and witness signatures, and even filling out some ballots for republican candidates. harris says he never knew about that, but his son, john, testified he repeatedly warned his father that mccray dallas was a shady character, referencing a particular phone conversation. >> in the phone call that i thought they were illegally collecting the ballots. >> reporter: the son's testimony was damaging. >> it was painfully clear to me that your son was saying, daddy, don't mess with this guy. >> understand, and i know he's judgmental and has a taste of arrogance. and in all truthfulness today he was right. >> reporter: he said that before shocking everyone and calling for a new election. >> say aye -- >> aye. >> reporter: a call the board of elections approved unanimously. >> you look broken. >> i feel that way. >> reporter: that's dallas

woodhouse, the head of north carolina's republican party. >> this is not the outcome we expected. it's obviously not the outcome we desired. >> reporter: mark allias represents mr. mccready. >> the process worked. they will have an opportunity for a free and fair election that is not the product of fraud or taint. >> reporter: the democrats think they won. but you know, the board of elections in deciding to have a new election said that the old election was tainted with criminal activity and illegal behavior. and they believe that the real winner here is the voter of north carolina. if you're wondering whether mr. harris is going to run again, he got the heck out of dodge as soon as he made the statement. he got out of the building. i asked him "are you going to run again," and he didn't answer. his wife looked up and said, "he's going to think about it." david begnaud, cbs news, raleigh, north carolina. a judge has tightened the gag order on roger stone, president trump's former adviser, after stone posted a controversial photo of her on instagram. the image showed federal judge

amy berman jackson with what appeared to be cross hairs. stone is now not allowed to speak publicly about the criminal case against him. he's pleaded not guilty to crimes related to robert mueller's russia investigation. an unprecedented vatican summit addressing church sex abuse resumes today. pope francis is proposing a number of ways to punish predators and keep children safe. seth doane reports from the vatican. >> reporter: the pontiff set the agenda with a piece of paper. 21 proposals including establishing worldwide protocols for handling accusations against bishops involving lay experts in investigations and developing rules for screening seminarians. many of the points are familiar to priests in america where similar rules were imposed nearly two decades ago. >> what i'm hoping is that some of the things that we've slowly learned in the united states might be carried to other places to save them some of the pain that we've had to go through.

>> reporter: in the u.s., nearly 7,000 clerics have been accused of sexually abusing minors since 1950. video testimony from sex abuse survivors has been played including one from a woman who started having sex with a priest at the age of 15. she said the priest forced her to have three abortions. while victims are at the heart of this, their role in the summit has largely been on the sidelines. seth doane, cbs news, rome. ahead on "cbs this morning," survivors of church abuse. we will hear from a nun about her call to end the abuse. two more women are speaking out about alleged sexual misconduct by singer r. kelly. the women claim kelly picked them out of a crowd at a -- in baltimore after a party in the mid 1990s when they were under age.

he allegedly exposed himself and had sex with one of the teens. >> being a mother with children, i feel i was taken advantage of when i was a teenager. i just want justice for anyone that was hurt or violated. >> r. kelly has denied allegations of misconduct. the white house says it plans to leave about 200 american troops in syria. the troops would be based in northeast syria, as well as at a small outpost in the southeast near its border with iraq and jordan. president trump had previously said that he would withdraw all 2,000 troops after saying isis was defeated. a powerful winter storm that slammed parts of the southwest will spread to the plains and upper midwest this weekend. the storm brought rare snowfall to the las vegas strip yesterday. snow has buried parts of northern arizona with as much as 36 inches. snowfall at the flagstaff airport broke an all-time daily record set more than a century ago with more than 31 inches. several interstates in california were closed due to the wintry conditions.

michael jackson's estate is suing hbo, and new details in an alleged terror plot. those are some of the headlines on the "morning newsstand." the "washington post" reports prosecutors say a u.s. coast guard lieutenant used computers at work to allegedly research and plan a widespread domestic terror attack. christopher hasson was ordered held without bail yesterday. he was arrested last friday on gun and drug charges. federal agents seized a stockpile of guns and more than 1,000 rounds of ammunition from his maryland apartment. prosecutors say hasson had a list of democratic politicians and tv journalists he wanted to kill. "rolling stone" reports the estate of michael jackson is suing hbo for more than $100 million over its plan to air the controversial documentary "leaving neverland" next month. the film is about two men who say jackson molested and swore them to secrecy when they were children. the new lawsuit claims hbo is breaching a 1992 contract to not disparage jackson for the rights

to air a concert film. hbo says it still plans to run the documentary. the "los angeles times" reports a year-long opioid prescription investigation by federal drug agents led to the arrest of four doctors and other medical providers. they're accused of writing bogus prescriptions or selling painkillers and other drugs on the black market. the investigation targeted dozens of health care professionals in california, nevada, and hawaii. more than two dozen people identified as drug dealers were also arrested. authorities say 15 people who died from drug overdoses were linked to those targeted in the investigation. california's "east bay times" says oakland's 3,000 teachers are expected to continue their strike today. the teachers walked off their jobs yesterday over pay, class size, and other issues. they held a rally at city hall and picketed at dozens of schools. schools remained open, staffed by nonunion employees and substitutes. many students stayed away. negotiations are supposed to continue this morning.

"reuters" reports the two sides are starting to sketch out an agreement on structural issues. the u.s. and china are trying to reach a deal before a march 1st deadline. that's when we could see tariffs on $200 billion in chinese imports increase from 10% to 25%. officials from the federal reserve will speak in new york city later today. a key topic on the agenda -- short-term interest rates. several earnings reports are also expected today. they include auto nation, cabot oil and gas, and wayfair. stocks lost ground yesterday. the dow fell 103 points. the s&p 500 lost 9, and the nasdaq declined 29. kraft heinz has revealed it received a subpoena from tcompss

nearly 200 church leaders are taking part. cardinal blase cupich organized the summit and spoke about extending the meeting. >> reporter: chicago archbishop blase cupich tells cbs news pope francis asked him and other catholic leaders to stay after the summit ends to discuss ways to implement concrete steps addressing clergy sex abuse. >> there's going to be not only concrete aspects of this that will be clear to people, but i can tell you there are going to be concrete steps. >> reporter: cardinal cupich was one of five bishops in wednesday's historic vatican meeting with 12 victims who are calling for zero tolerance, particularly removal of catholic leaders who cover up sexual abuse. how much of this will be handled by the law versus the church? >> if there is an investigation by the civil jurisdiction, we back off. >> reporter: the bishops have to first not block the allegations
