rain is looking unsettled with dark clouds leaned looming. >> tracking showers across the bay area. unsettled weather, not just today, but through the week. so, rain chances every single day this week. here is a live look over treasure island, raindrops are on our live camera. here is high def doppler. you can see showers for the north bay, stretching from novato, down through written word, and san rafael. for the east bay, right over venetia, martinez, as well as the tri-valley, san ramon, dublin, right over 580 down through fremont, as well as showers across the peninsula. redwood city, palo alto, and sunnyvale into the south bay. we are not done yet with a wet weather, we will time out the rest of the day into tomorrow

on future cataa few minutes, michelle? >> all right mary, thank you. the crumbled orville spillway is back to its full glory today. it reopened about an hour islif now, where water is rushing through the spillway for the first time in two years. real wilson? you can see it over my shoulder there, this accidental budget project that no one in california asked for, but boy did we end up needing it two years ago. as he said, $1.1 billion to get the new spillway built here. just before 10:00, they finally let that thing go. as you can see from the video here, this is on their way up to about 8300 cubic feet per second. that is what they will let through the gates, through the new spillway, which will in total, get the river up to about 20,000 keep it feet per second, which is not a high flow. s e

spillwayollapsed,kind forced them to shut everything down out here. the only water that has been moving through this project has been the hydro electric facility, which allows some flow. but the spillway is equal for flood control, and managing the kind of winters we find ourselves in now, where you have got to manage that lake level in anticipation of runoff. some questions today for the department of water resources about this rebuild. and, the new structure here, and what they have learned since the disaster in 2017. here you go. the independent forensic teams report, as well as many other studies, as to what caused the failure of the main spillway in 2017. we have made those to adjustments and improvements based on those reports. much of that was addressed in using 24's lway

has been redesigned using today's best modern technologies and engineering to accommodate for what led to february 2017. >> reporter: the spillway has been rebuilt. the emergency spillway, remember the hillside they were got going to let the water flow over 2017, but it started to erode, they have been working on that as well. the rest of this dam is still 51 years old. there is still a lot of questions about this project as a whole, beyond the new $1 billion spillway. it is time to put that thing to the test, it is a critical part of this project. as of today, it is functional again. who knows, we might need to see more flow through the spillway, depending on what the weather looks like over the next couple of weeks as we move through spring. >> wilson, it is a good site to see what is going on right behind you. you mentioned earlier, the lake levels being important, what will be expect to see in terms of those?

>> it is t the lake will continue to rise. this is this big equation between rainfall, snow runoff, and what they can let out of the lake. even with the releases now, the lake is expected to continue to rise just a little bit. again, what happens in the weeks, maybe a month or two or head, could change all of the math here a little bit. they might have to let more water through here. we will see. this is a big day, just making sure that still date spillway is operational in regaining control of the lake. new at noon, we are getting our first look at the man accused of a violent beating in the east bay. this happened in fremont after the suspect allegedly edified himself as a jordache employee at the denny's restaurant on amari avenue. and lack of because there. >> reporter: police said this morning they have confirmed

with jordache that the suspect in the fight was not a jordache employee. but, even workers that i spoke with today here in this denny's still believe he was. if that was at all part of any sort of ruse, he convinced some people. here is the surveillance image fremont police are hoping will help them catch the man responsible for a bloodied fight at this denny's, early sunday morning. the collateral damage, this man, fred bonnie's, faced. >> the minute he just got there, the guy smashed his face in. >> reporter: paula a body was fred's mom, she says fred was waiting for a pick up order, when a man came in, identifying himself as a jordache delivery person, picking up food. friday says the alleged dasher became combative with a denny's worker, and he stepped in. >> he was just trying to help. apparently we can't do that. >> reporter: fred ended up with almost all of his teeth knocked out, and $25,000 in medical bills. his mom is hoping these photos will help catch the culprit.

>> just a lunatic out there. he goes in and intimidates the staff, to give them food to make him go away. >> reporter: if you have any information on the suspect, please call the fremont police. and east bay engineer accused of poisoning and trying to kill his coworker just faced a judge for the first time. jackie ward has an update from court. >> reporter: david xu allegedly tried to kill a woman he worked with, by putting a toxic substance in her food and water over the course of more than a year. david xu's attorney accompanied her clients family out of the courtroom this morning, and explain how she plans on defending tran37. >> he is presumed innocent, these are only allegations. charges have been filed, and i think all of you the public knows, that once charges are brought, an individual per our constitutional system is presumed innocent, and that is exactly how i intend to receive this case. >> reporter: according to court documents, david xu's coworker

noticed a strange taste, or smell from her water and food, left unattended in her office. starting back in october 2017, she even allegedly suffered immediate and significant health problems after consuming this water and food, at times, requiring emergency care at the hospital. after months of getting sick, documents say an officer the camera shows david xu adding something to her water bottle . a sample of that water tested positive for cadmium, a substance that causes cancer or death. it was also found in her bloodstream. this arraignment has been moved to thursday. so far no bail has been set. >> are two other alleged victims. family members who drive from her water bottle who tested positive for cambium. today, a jury selection is set to begin in the trial of a deadly go ship warehouse fire. the fire

decemb 2016. september, and alameda county superior court schedule the long-awaited trial to begin today. cameras will not be allowed in the courtroom. two teenagers died after being electrocuted while trying to rescue a dog. authorities say the dog got stuck in an irrigation canal in dixon yesterday. the boys walked into the canal, and the one of them touched a gate. then, an electrical current traveled through the water at the sheriff's office says the dog survived. crews are working to contain a fire at a chemical plant northeast of houston texas. we have just learned at least one person has died. here is a live look at the scene. the fire broke out at a chemical process in ts morning. residents say they felt their homes shaking and saw a thick column of smoke rising in the air. this is the life picture where you can still see that smoke billowing out of that area. officials say two people may be hurt, roads are closed and schoolchildren are sheltering in place.

air conditioning is being switched off to reduce exposure to any toxins in the air. a manhunt is underway for the suspect in the fatal shooter of weather and activist nipsey hussle. police are investigating what triggered a stampede at a vigil that left 19 injured. the police chief gave an update this morning. chris martin is has the details. >> reporter: los angeles police say 29-year-old eric holder is the man who murdered grammy nominated rapper in nipsey hussle, and wounded two other men sunday afternoon in front of nipsey hussle's south la clothing store. >> mr. holder, who i am confident is watching this, i asked him to surrender. >> reporter: according to investigators, holder and housel had a verbal confrontation. police say holder left, but returned later with a gun, and fired multiple shots. before running to a waiting vehicle. >> we believe this to be a dispute between mr. hustle and mr. holder. >> reporter: chief moore says holder is a number of a gang,

but police believe the dispute was not gang-related. hassles death has officials worried about a recent uptick in gun related to crime. he was one of 11 people people killed here in los angeles, after more than a 17% drop in homicide at the beginning of the year. i am deeply concerned, it will commit everything the city has a turnaround. >> reporter: a vigil for hustle erupted into chaos overnight. police say a fight broke out when a man should a gun. that led to a stampede, that left at least 19 people injured. lisa urging people paying respects to come in peace. >> police are searching for this female's getaway driver. to washington, where the hyatt house oversight committee is voting on whether to issue subpoenas to investigate how white house officials, including president donald trump's son-in-law receive top level security clearances.

the veteran security advisor told lawmakers that clearances were denied for 25 officials, but later overturned. >> he came forward because the system at the white house is so dysfunctional that she believes congress needs to intervene. >> every day that we go on without getting to the bottom of this matter is a day that we are putting hundreds, if not potentially thousands of americans at risk. i mean really, what is next, putting nuclear codes in instagram dm's? this is ridiculous. republicans say the allegations were overblown, and cherry picked. white house press secretary sarah sanders says democrats are putting 3 million people with security clearances at risk. >> with the democrats are doing is playing a dangerous and shameful game.

>> president donald trump has denied any involvement, and granting kushner's security clearance. democrats want to hear testimony from the former director, the personal security office, about reported irregularities in the white house a security clearance process. a second woman is accusing former vice president joe biden of touching her inappropriately. >> he walked up to me, and wrapped his hands around my face like that him and pulled me in, and started rubbing noses with me. it did not feel sexual, it just felt like a total invasion of myspace. >> amy lee post says it happened in 2009 while she was congressional aide. this comes on the heels of another allegation. house speaker nancy pelosi is weighing in. >> he asked to understand in the world we are in now, that people's spaces important to them. what is important is how they receive it, not necessarily how you intended it. >> two days ago lucy florez says biden approached her from behind at a campaign event,
