live from thcbs y , e famil the man killed in this crash in santa clara county is calling out tesla, the new lawsuit filed today. good afternoon. i'm ken kenny choi. >> i'm michelle griego. the family of a man who died driving a tesla on autopilot last year is filing a wrongful death lawsuit. kpix5's anne makovec has more on the accusations. >> reporter: this lawsuit is being filed not only against

tesla, but also possibly its subcontractors who helped with the design and manufacturing of the autopilot system. this is what was left of walter wong's tesla after ieof last year. wong was killed. the 2017 model x was on autopilot at the time. his wife says it was his dream car. the family believes the autopilot feature is defective and likely causof his lane of safety, pointed him at a fixed concrete barrier and then accelerated almost 10 miles an hour in three seconds. >> reporter: they say he complained about his tesla veering into the same barrier at the exact location of the crash and that he brought his car into the dealership several times to report a problem with the autopilot function. the grounds for the suit, defective product design and intentional misrepresentation. in a statement soon after the crash the company said, quote,

no action had been taken by the driver who had a 5-second view of the concrete divider. the driver received several visual and audible hands-on warnings earlier in the drive and the driver's hands were not detected on the wheel for six seconds prior to the collision. >> trying to put the onus on mr. wong to suggest he should figure out what tesla's job is is unfair. >> reporter: the family is suing california saying the highway median was missing its crash guard which could vewong' severe. his family is suing for unspecified monetary damages. >> just don't want this to thnt to release the results of its investigation. in san francisco, anne makovec, kpix5. there are several other complaints and lawsuits by other tesla drivers of navigational errors by the autopilot. a tesla spokesperson declined to comment. and i'm emily turner here

at the live news desk where we have two serious car accidents to tell you about this morning. get right to that video of chopper 5. this first accident happened in san francisco. it was a car versus a pedestrian. it happened in lower pac heights. the scene is taped off at sfpd is investigating at sutter and dida't ty bad dent to rert. there is also one across the bay in alameda, this is chopper 5 video just into our newsroom as well. this is a bike versus a truck. we are told that that bicyclist has serious injuries this morning but is expected to recover. he collided with that pickup truck in berkeley at ninth and cedar street. the good news is both of the drivers remained on the scene and are working with police for the investigation. at the live news desk, i'm emily turner. back to you. >> thank you. workers across the bay area are using this may day to takea in

line since early this morning saying that they are being pushed out of their home towns. kpix5's jackie ward is in oakland. >> reporter: construction workers tell me that they have been trying to get what's called a project labor agreement with the city of oakland for a couple of years now. they say they need one in order to stop being displaced from their homes. these workers are demanding a project labor agreement or pla. that's an agreement that guarantees local workers' jobs on city projects. alameda county cities like alameda, berkeley, hayward and san leandro have these agreements. >> make sure we have a pathway for open residents, especially disadvantaged residents to get into the trades through have careers in construction, sustainable middle class careers. >> reporter: along with the local hiring process and apprenticeship program workers are demanding an area standard wage. that's not what they taxes here the city is run by money. we don't want outsiders to come

in, make their money and take their money elsewhere. >> reporter: oakland city council president wants to help and says a public lands policy recently passed. that includes worker standards. now it's a matter of the city implementing it and holding developers accountable. >> it should be more advanced by now and that's part of why you heard people say they want to fight for it because when we passed it last fall we were all intending it would be more fully along by now. >> reporter: mayor libby schaaf wouldn't comment directly on this but had this to say about may day in general. union strength is woven into oakland's dna and i am grateful for labor leaders that have led the fight to pass recent laws to -- strengthen the rights of all workers. the alameda county building trades council sent this letter to mayor libby schaaf yesterday saying she needs to sign a pla soon in order to save union jobs. they have yet to hear a response. in oakland, jackie ward, kpix5. >> just about an hour ago in

santa clara county google workers staged at sit-in inside their mountain view campus protesting alleged retaliation from management. the mo afr st ar's historic walkout when some 20,000 google workers left their offices to protest the company's handling of sexual assault allegations. a bay area couple charged in the college admissions scheme pleaded guilty today. cameras lined the street as real estate developer bruce isackson and his wife davina isackson left federal court in boston. the hillsborough couple pleaded guilty to one count of conspiracy to commit mail fraud in the scam. they reportedly paid $600,000 to get their daughters into usc and ucla. they also paid to boost one of their daughter's entrance exam scores. both are cooperating with investigators for the chance at a lighter sentence. recognize this guy? walnut creek police say two weeks ago he smashed a glass against someone's face at a bar. here's another look at that

suspect. it is not clear what led to the confrontation. call police if you can identify him. right now several san francisco streets are without water as crews work to repair a broken water main. chopper 5 7:isas cars were being rerouted. this is next to the portal. repairs are expected to be wrapped up in the late afternoon. a live look in washington, d.c. now where attorney general william barr is testifying before the senate judiciary committee. he is being questioned about his role in the release of special counsel robert mueller's report. nikole killion is on capitol hill. >> reporter: attorney general william barr told a senate judiciary committee this morning that he was surprised kenaial counsel robert mueller out whether ot to charge president trump with obstruction of justice. >> we did not understand exactly why the special counsel was not reaching a decision. >> reporter: barr testified

that ultimately he made the decision based on the evidence mueller laid out. >> the evidence developed during the special counsel's investigation, was not sufficient to establish that the president committed an obstruction of justice offense. >> reporter: the testimony comes hours after news broke that mueller told barr he was frustrated with barr's original ary of report. in a stmonth mu told barr his message to congress, quote, did not fully capture the context, nature and substance of mueller's views on obstruction of juevious denied where mueller stood on the attorney general's characterization of the investigation's findings. >> i don't know whether bob mural -- >> you didn't know the concerns being expressed muelr's team? would you have heard those concerns directly from mueller two weeks before. >> reporter: barr insisted mueller's issue was not with the accuracy of the summary

smashing property. around 200 people were arrested. before the chaos thousands of yellow vest protesters turned out to voice their opposition to president emmanuel macron's policy. julian assange is heading to a u.k. prison for violating his bail. a british judge sentenced him to 50 weeks in prison. it has been about three weeks since authorities removed him from the ecuadorean embassy in london and earlier this morning assange pulled up to the courthouse in this van with the cameras waiting. he faces an extradition hearing tomorrow on a u.s. criminal conspiracy charge. now a powerful weather system is threatening more than 14 million americans from texas to arkansas. at least two dozen possible tornadoes were reported across five states yesterday. in sulfur, oklahoma, drone footage captured this tornado as it touched down. it was on the ground for about 10 minutes. nearulsa. moinches trailer
