live from the cbs bay area studios, this is kpix 5 news. >> we begin with breaking news. a helicopter, crashing into new york's times square. let's get to susie steimle at the live news desk. >> we just learned all of this happened in the past hour and at least one person is confirmed dead. this is live footage from the scene. this is at 51st street and seventh avenue in midtown manhattan. the helicopter made a hard landing on the roof of the building, and then a fire broke out. the fire is said to be under control. we just heard from governor cuomo a couple of minutes ago. >> if you are a new yorker, you have a level of ptsd from 9/11, and i remember that morning all too well, so as soon as you

hear an aircraft hit a building, i think my mind goes were every new yorker's mind goes. >> reporter: but at the station, there is no indication? >> there is no indication that is the case. the only indication was a helicopter had to do an emergency or a hard landing, so it crashed onto the rooftop of the building, causing a, but there is no indication of anything more than that. >> you can see the sense of fear people are experiencing in midtown manhattan. it is unclear what exactly happened as we heard him say, but a reporter at the scene says the weather may have been a factor. it's very foggy, very rainy. i texted my sister-in-law a little while ago, who works not far from here and asked if she could see this helicopter that crashed into this building. she said she couldn't see anything because it is so foggy.

>> still unclear what kind of helicopter it is. we will bring you updates as we get them. susie steimle, kpix 5. also new at noon, a brush fire is burning along the roadside of the former concord naval weapons station. authorities say the advancing heavy smoke has forced new shut down traffic on willow pass. so far, no estimated time on containment. the fire is burning as the bay area deals with record highs today. a look at ocean beach right now tells you just how hot it is getting. 20 of people are out even on this monday. we could reach or even break some records. here is a look in dublin right now. the tri-valley, hitting triple digits today. >> meteorologist mary lee with how hot it's going to get today. >> that's right. we are looking at some of the highest temperatures we have seen this year, while on their way to likely record heat.

a heat advisory is in effect until 9:00 p.m. for most of the bay area including the north bay valley, east bay valley, santa clara valley, and the san francisco bay shoreline, so do what you can to stay hydrated, stay out of the heat and limit exposure. today, the first day of the year, we will see triple digits inland from concorde to livermore, and san jose as we head through the afternoon, so highs will be soaring. mid 80s along the coast for the bay, and low to mid 90s, and triple digit heat inland. effect today. we will talk about when we see temperatures cooling down in just a bit. we are just hours from the nba finals. a do or die series. with more. >> reporter: we are just

pursuit. jackie ward says the driver at fault admitted to being under the influence and now faces a slew of charges. >> reporter: the suspect that chp says killed a faultless man admitted to police that he took methamphetamines before getting behind the wheel of the car and had a felony warrant out for his arrest. chp says they first noticed a man driving your medically this morning and they say alexander zumini was reaching speeds up to 120 miles-per-hour. >> this guy was driving at that speed before we even got there. we were doing our best to prevent this from happening. unfortunately, we were not able to do that in time. >> reporter: alexander zumini exited at gair point road, blew a red light and slammed into a minivan with the right away, leaving the driver dead in the van and almost unrecognizable. the passenger in that band survived, but is in critical condition. >> this is horrific. mister zumini is responsible.

had he stopped like millions of other people do every day, this never would have happened. >> reporter: he tried to escape in a silver bmw and got on the offramp before his car became disabled. he then got out of his car and started to run away. chp officers quickly put him under arrest. passenger melissa vincent faces separate charges including possession of stolen charges and identity theft related charges. >> we will still verify and do a series of tests. we just want to verify the driver was actually under the influence at the time and specifically what the driver was under the influence of. >> reporter: zumini has been charged with vehicular manslaughter, dui, and possession of methamphetamines with intention to sell. jackie ward, kpix 5. >> that section of yerba buena is now open. we will have more on the kpix 5 news at 5:00 and online at

www.cbssf.com. in alameda county, teachers in the new haven school district are back in class today. they ratified a new contract over the weekend. they will get a 4% raise through the next academic year and get a one-time bonus of 2.5%. the strike lasted three weeks. students now have four days left until summer. back now to fire watch. a wildfire that broke out yesterday in south san jose is merely out. right now, it is 85contained. the malik fire erupted near malik and bailey roads. it burned about 210 acres. meanwhile in yolocounty, evacuations are still in effect in certain areas because of the sand fire. cal fire says it is only 30% contained. the sand fire broke out yesterday afternoon north of lake berryessa. it has now burned about 2200 acres and destroyed seven structures. in southern california, six flags magic mountain reopened

today after a brush fire burned right up to the theme park yesterday. the sky fire forced everyone inside to evacuate. it's burned about 100 acres and is currently 50% contained. former red sox star david ortiz is in stable condition after being shot in the back, in the dominican republic. you can see a motorcyclist approaches him from behind last night and shoots him in the back. authorities say a crowd attacked the suspect before they took him into custody. the motive is still unknown. the 10 time all-star led the red sox to three world series titles before he retired after the 2016 season. he has been working for the red sox's front office ever since. he is expected to make a full recovery. fu recovery. the justice department has agreed to turn over some underlying evidence from the mueller report.

>> the wind swept through dallas faster than 80 miles-per- hour. this incident marks the ninth death related to industrial crane accident in north texas since 2012. federal safety officials are pushing to increase the safety of crane operations in texas. american airlines is extending the cancellation of 115 daily flights in september due to the grounding of the boeing 737 m.a.x. american previously canceled flights through mid august. boeing 737 m.a.x. 8 jets were grounded worldwide in march, following two fatal crashes. let's take a live look at the big board and see what the stock market is doing. the dow jones is up about 125 points. stocks are up after president trump suspended plans to impose tariffs on goods imported from mexico. patients suffering from severe allergies have a new option. kenneth craig reports there is no surgery required. >> it just started progressively getting worse. >> reporter: melanie arrived at

area. an excessive heat warning now in effect for the east bay valley, santa clara valley and san francisco bay shoreline. now under an excessive heat warning until 9:00 p.m. dangerous heat so stay hydrated and try to limit outdoor exposure with these hot temperatures. you can see those temperatures climbing, now into the 80s and 90s. we are not done yet. we will continue to watch our temperatures climb, and sore, so the hottest day of the year so far, happening today with record heat expected. you can see our temperatures are warmer in many locations compared to yesterday at this time, and not just the heat, but a spare the air alert. the air-quality is moderate, but unhealthy for the santa clara valley, so unhealthy air quality for sensitive groups. here is satellite and radar with a strong ridge of high pressure, and offshore winds helping to heat us up.

the high pressure system is acting like a lid with sinking air trapping particulates at the surface. we will see plenty of sunshine through the afternoon. for tomorrow, we could see like the onshore flow keeping the coast cooler, but still hot inland for tomorrow. as we look ahead to thursday, friday, into the weekend, a stronger onshore flow, which means temperatures will be cooler by the end of the week for all of us. our son max sets at 8:31. sunrise at 5:47, but triple digit heat for the first day this year. triple digit heat in santa rosa, concord, fairfield, san jose. mid 90s in oakland and 94 san francisco. temperatures slowly cooling down as we head through the week. that puts us back where we should be, but in the meantime over the next couple of days, still that danger has been
