jurors and the use of material outside deliberations. yesterday, two men and a woman replaced three female jurors and there was no immediate explanation for why. the judge's instruction suggested may have been because of improper use of the internet, cell phones or exposure to media coverage of the case. the jury has been ordered to start over and we have juliette goodrich on this story and we will have the latest on the news at 5. a new push in the battle over the planned name for a bay area subway station. >> we have emily turner at the live desk. >> reporter: is unfolding with live pictures that you can see where what is happening is that on the steps of city hall right now, protesters are holding a news conference and rally to basically say they do not want the central subway chinatown station to be named after rose pak. this is a live look at the protest with these signs up and their message is very clear. they wanted to be the chinatown

station, only. >> the chinatown station should be named as chinatown station only. is that right, everyone? >> reporter: last week, members of the merchants association marched to urge them to name the station by its geographic location. opponents say that rose pak had a reputation as a powerbroker with a negative side and they said she coerced merchants into making political donations, as well as pressuring non-english speakers to vote a certain way for elections. the merchants and the residents are part of the rally taking place and they will have the opportunity to make public comments at the board of directors meeting that will happen later today. we will track this story and bring the very latest. i'm emily turner. back to you. the search is on for the suspect involved in a violent assault near uc berkeley.

just before 2:00, the victim was attacked on channing way and telegraph, just a few blocks from campus. they said the person was assaulted with a deadly weapon and taken to the hospital with major injuries. today is move in day for thousands of cal students and we will have more on this story on the kpix news at 5:00 and kpix.com. a brazen break in at the international spy shop in san francisco with burglars busting out the front window around 4:30 this morning. the sub >> seemed to have fled immediately. he took hidden cameras, stun guns and voice changes. firefighters believe it was an electrical problem that sparked a fire in san francisco on gerard street. you can see the firefighters removing debris from the roof and the home. we are told five residents are displaced and fortunately, no one was hurt. taking a live look at san

francisco international. today, sales of single use plastic water bottles are coming to an end, in an effort to protect the environment. they are eliminated from shops, cafis, vending machines and restaurants. water will be sold and recyclable aluminum, glass or compostable bottles but it will not affect plastic bottles of flavored beverages including sodas, teas or juices. >> we sell about 10,000 bottles of water per day and it generates 28 million pounds of waste per year. this is really a big thing we can impact in terms of having waist not going to the landfill. >> for now, the policy applies only to the airport and not the carriers flying in and out of sfo. a memorial is under way for the chp officer killed in the line of duty last week in riverside. a procession began for 34-year- old andre moye jr. a couple of hours ago. he was impounding a car during a traffic stop when the driver pulled out a rifle and shot

him. two other officers were injured by gunfire and the gunman was killed in the shootout. former vice president joe biden is making big gains in a new poll a while kamala harris is seeing a steep drop in support. senator harris dropped 12 points , from 17% in june to just 5% this month, the lowest she has polled in any survey since mid- june. a big week for democrats with hundreds of dnc delegates to hear from the 13 presidential contenders. former vice president joe biden will not be among the candidates. cbs news learned the white house is considering new tax cuts to boost the economy. the administration disputes a report it is considering a payroll tax cut. >> natalie brand has the latest. >> reporter: the dow jones opened slightly lower tuesday with the trump administration considering new tax cuts and the white house is disputing

the washington post report that a payroll tax cut is on the table. payroll taxes are taken out of work or paychecks to fund social security and medicare and if that tax is lowered, people will have more take-home pay and it's seen as a way to increase spending and possibly delay a recession. a majority of economists predict the u.s. is headed to a recession by 2021, at the latest. a slowdown could threaten the president's ability to campaign on the economy going into the 2020 election. the white house downplays concerns. >> the fundamentals of our economy are very strong and you know it. we have more people working in this country right now than ever before in the nation's history. >> reporter: on twitter on tuesday, the president retweeted vice president mike pence's comments kid, saying the economy is thriving in the auto industry is roaring back in michigan. the vice president spoke to leaders monday one day before wo from u.s. steel that it will temporarily lay off hundreds of workers at the

moving away from the junior high model and creating middle schools. jackie ward shows us the warm welcome for sixth-graders. >> reporter: there has been construction going on for three years. walters junior high will be walter's middle school, the first of five that will be created in the fremont unified school district. every possible minute, construction groups will put on the finishing touches, and still students will be walking through the door. kim wallace cannot wait until the first day they are here. >> it is one thing when they do the infrastructure and the wiring and another when you see the big beautiful buildings and happy kids going to school. >> reporter: in 2014, measure e gave the fremont district district $650 million to upgrade the schools and deal with population growth and modernization. this project at walters converts old buildings while adding new ones and will cost about $50 million. >> it's nice to see and to get

in the 21st century. >> reporter: fremont is surrounded by declining districts. >> we have to find classrooms to put students in but we are now in a place where kids are coming to fremont and wanting to be in our schools. >> reporter: they are creating a middle school model and moving away from the junior high model. they will finally match the rest of the state. >> it gives more space and we don't have to overload schools. people can go to their neighborhood schools. >> reporter: after a decade, brian williams said this school year brings new challenges. >> two thirds of the student body will be new. six and seventh grade, brand new and eighth grade will be the old guard and they will be the social and academic leaders for the new students. >> reporter: the next obstacle for the district is monitoring demographic trends to make sure they project the right space for students and that they aren't overbuilding or under

millions of kids are flocking to an app that allows them to create short lip syncing videos. >> it's fun and games but there is a warning for parents. lisa mateo reports. >> reporter: move over, instagram and snapchatted. one of the hottest apps right now is tiktok. formally known as music link, the app relaunched last year and it allows users to record videos with popular music. these sisters love it. >> it is summer to relate to others your age and it's always funny, always finding something to make you laugh or it will make you feel happy. >> reporter: tiktok is the fastest growing app of its kind right now. joan saltzman said the app has about 1 billion users but parents shoulde tuned in. many of the popular songs have explicit lyrics. >> they have offensive content
