our evening news anchor, she doesn't mind. that's it for this tuesday from the broadcast center new york city. i'm meg oliver. it's tuesday, august 27th, 2019. this is the "cbs morning news." bracing for dorian. the storm expected to gain hurricane strength. it's headed for puerto rico and the u.s. mainland as people in its path prepare for destructive winds and rain. landmark opioid case. johnson & jonhson ordered to pay half a million dollars after an oklahoma judge finds the company guilty of fueling the opioid crisis. and tragedy in dayton. at least two children are dead and several others hurt after a stolen police cruiser crashes. ♪

and good morning from the studio 57 newsroom at cbs headquarters here in new york. anne-marie green is off. i'm brook silva-braga. puerto rico is under a tropical storm watch this morning as dorian closes in. millions on the caribbean island have been preparing for the storm. dorian is expected to be a hurricane by the time it moves near puerto rico tomorrow. meteorologist dave warren of our miami station wfor is tracking the storm. >> good morning. here's the latest with dorian continuing to move through the windward islands and into the caribbean here this morning. the latest from the national hurricane center has the wind at 60 miles per hour, moving west/northwest at 14 miles per hour. concerns now for puerto rico which had a tropical storm watch issued late monday. the storm forecast to intensify to a hurricane as it moves through the area. now here's the concern -- here's the big question -- the storm tracks a little farther north it

will stay over the water. a little farther south, it will interact with a little more wind shear and terrain and weaken the intensity. the overall consensus from the national hurricane center track is that it goes back to a tropical storm, but it holds together, and there's no question it continues to move to the northwest. the big question will be the intensity. even if it does lose some of that intensity moving over haiti into the dominican republic, it's going over some very warm water as it approaches the southeast here. so that is what we are watching. likely seeing more watches and warnings going into effect. there is that tropical storm watch for puerto rico. stormy weather here across the southern plains, and that is with a cold front which will continue to march its way east. showers and storms will develop ahead of that. one thing this will do is keep tropical depression six off the coast. that may intensify to a tropical storm, but it moves northeast and into eastern canada. i'm dave warren for cbs news. a first of its kind opioid

ruling against johnson & jonhson will be appealed to the state supreme court. yesterday an oklahoma judge ordered the company to pay the state $572 million for helping fuel the opioid crisis. laura podesta is here in new york. what do we know about johnson & johnson's response? >> reporter: they are saying the decision is unfair, that the company did not cause the opioid crisis. and they're looking forward to continuing the court battle with an appeal. in a landmark decision, oklahoma judge thad bulkman said johnson & johnson was to blame for fueling the state's opioid crisis. >> i am entering an abatement plan that consists of costs totaling $572,102.28. >> reporter: that fine falls short of the $17 billion the state's attorney general was seeking. the verdict marked the first time a corporation has been found responsible for the painkiller abuse epidemic that began some two decades ago. >> defendants caused an opioid

crisis that is evidenced by increased rates of addiction, overdose deaths. >> reporter: the case began in 2017 when oklahoma sued johnson & johnson, purdue pharma, and teva pharmaceuticals. the lawsuit accused them of aggressively marketing opioids while significantly downplaying the risks of addiction. teva and purdue settled for a combined total of about $355 million. lawyers for johnson & johnson called the decision unfair and immediately said they would appeal. >> johnson & johnson did not cause the opioid abuse crisis here in oklahoma or anywhere in this country. >> reporter: the damages awarded to oklahoma are intended to fund an abuse abatement program that would cover the state's addiction-related expenses. and in october, an even bigger case against multiple pharmaceutical companies including johnson & johnson is slated for trial in ohio.

the plaintiffs include nearly 2,000 towns, cities, and other groups. brook? >> interesting and important cases. thanks. >> reporter: thanks. president trump is back in washington this morning and expressing optimism about new trade talks with china. before leaving the g7 summit in france yesterday, the president defended his appach to a trade deal. >> i think they want to make a deal. i'm not sure they have a choice, and i don't say that as a threat. >> the president has been criticized for sending mixed messages on china. mr. trump says prospects for a deal are better now than at any time since negotiations began between the two countries last year. before leaving the summit, g7 leaders pledged $20 million to fight wildfires in the amazon. we're learning this morning brazil rejected the offer. a senior brazilian official said maybe the money would be better spent on reforesting europe. more than 80,000 wildfires have been reported in brazil this year.

many started by farmers clearing land. more than 3,500 square miles of forest have burned an area roughly the size of yellowstone national park. some scientists predict complete deforestation of the amazon, and we're a long way from that, would reduce rainfall in the u.s. and across the world. at least two children have died after a chase involving a stolen police cruiser ended in a violent crash in ohio. take a look. this was the scene near the dayton metro library last night. police say it began after a stabbing at a home. the suspect allegedly ran off and stole the cruiser. police say the suspect then crashed it into at least two other cars. seven children and four adult were removed from those vehicles. one witness described the scene as terrifying. >> i heard someone scream "kids are in the car," and jumped out to do my best to try to get as many kids out of the van as i could. >> the victims were taken to

area hospitals where at least two children died. the suspect was also hurt in the crash. he's in custody facing multiple charges. it's been two months since a deadly shooting inside a california costco. and for the first time, members of the victims' family are speaking out. the shooting killed d kenneth french who was mentally ill and injured his parents. this was back in june. an off-duty lapd officer told investigators he shot in self-defense. but the french family says that's not true. >> i don't know this is -- not to shoot twice. i even said "please." i was pleading with our son for our lives -- he was shot in the back. >> the family is filing a claim against the city of los angeles and the lapd officer who was involved. they also want cell phone video of the shooting to be released. up to 30 women will get a chance to speak at a hearing

in new york city today about jeffrey epstein. prosecutors asked a judge to dismiss sex trafficking charges since epstein is dead. his death this month has been classified as a suicide. epstein had pleaded not guilty to all the charges. a judge says today's hearing will give prosecutors, epstein's lawyers, and any victims a chance to speak. supreme court justice ruth bader ginsburg is talking at least a bit about her recent health scare. last night ginsburg received an honorary law degree from the university at buffalo in new york. the 86-year-old's appearance came ja w da after she successfully completed radiation therapy for pancreatic cancer. ginsburg spoke after accepting an honorary degree. >> i think now that this day has been preceded by three weeks of radiation. i said, i will not cancel. >> she did not cancel. doctors say no further treatment is needed at this time.

kind to be sent by russia. it will support the crew and test its skills during a two-week mission. this comes after saturday's aborted docking due to faulty equipment in the docking port. actress lori loughlin is back in court today in the college admissions scandal, and the synagogue shooting suspect faces the ultimate punishment. those are some of the headlines on the "morning newsstand. the "pittsburgh post-gazette" reports the justice department will seek the death penalty against the man accused of killing 11 people at a pittsburgh synagogue last october. yesterday the u.s. attorney's office in pittsburgh filed a notice of intent to seek the death penalty for 46-year-old robert bowers. he's pleaded not guilty. leaders of two of the congregations that worshipped at the tree of life synagogue requested that bowers' life be spared. "newsweek" reports actress lori loughlin and her husband could face legal complications

if they decide to share lawyers. the couple is due back in court today to answer questions about possible conflicts of interest if they use the same attorneys. they're accused of paying $500,000 to help their two daughters get into the university of southern california. they've pleaded not guilty. "politico" says massachusetts congressman joe kennedy confirmed he's considering running against sitting senator ed markey in next year's state democratic primary. in a facebook post, the 38-year-old grandson of robert f. kennedy said he has not reached a decision and will spend the next couple of weeks discussing a campaign with supporters. yesterday he filed a statement of candidacy with the federal election commission. and our partners at the bbc report on a vast raft of volcanic pumice rock drifting through the pacific ocean. it's a sight to behold here. 58 square miles of the stuff were first reported by an australian couple sailing their catamaran to fiji. they were temporarily stuck

kraft heinz is shaking up its c suite amid accounting problems and weak sales. the company will replace its young cfo with a seasoned veteran who held the role before him. david knopf was 29 and the youngest high ranking official at the company when he assumed the role in 2017. taking his place will be 44-year-old paolo basilio who became cfo at h.j. heinz in 2013 and continued in the role after the 2015 merger with kraft foods. the change is effective september 1st. bristol myers is taking a major step toward completing its $74 billion acquisition of celgene. the two pharmaceutical companies found a buyer for a skin treatment. the sale they hope will address antitrust concerns. amgen has agreed to buy the psoriasis medicine for $13.4 billion. the decision comes after the ftc raised anti-competitive concerns. pet stores are suing to block a maryland law that will

yesterday her legacy was honored with a monument unveiled at the u.s. open. maurice dubois learned about the hardship she had to overcome from one of gibson's closest friends. >> reporter: althea gibson was a great talent on the tennis court but lonely off it. in 1955, she met her match in angela buxton, england's top player. >> nobody even spoke to her, let alone played with her in her own country. >> reporter: buxton is jewish and back then wasn't embraced either. >> not once did the british girls invite me to join them for a meal. not once. >> reporter: experiencing similar indignities created a bond. >> i was very, very friendly with her. >> reporter: they became doubles partners and won the french open and wimbledon in 1956. one local newspaper reported the historic feat with a small two-word headline, "minorities win." >> well, all england club had to say something. they said the very, very smallest thing they could. >> reporter: they remained
