hopeful's stop at a cannabis dispensary. i'm kenny choi. >> i'm michelle griego. kpix 5's an anne makovec is live. >> this has been a matt as an issue of racial injustice. >> we know that americans across race and different backgrounds and ethnicities use marijuana and have used illegal drugs at roughly the same rate but only some americans are more likely than other american to be arrested to it. >> reporter: o'rourke met with pot business leaders at blunts and more. the owner won a cannabis business license under the equity program. >> this is important for people to come and talk to hear from us what is going on. >> reporter: o'rourke's plan would expunge pot possession

records and help businesses use banks and impose a new tax, part going to support reentry into society for those in prison for pot possession. >> the criminal code in this country has forever, as long as we have been a country, been used to keep some people down by law. >> reporter: last night o'rourke visited san quentin prison and spoke about his prior arrests, one for drunk driving and a misdemeanor burglary charge that was dropped. those events didn't define him, in part, because of his ration. this is o'rourke's fourth trip to california as a presidential candidate. next he is heading to denver. in oakland, anne makovec, kpix 5. taking a live look right now at sfo where repaving work on the runway is almost completed. the airport announced the entire project is expected to wrap up by 9:00 p.m. tonight, which is a week ahead of schedule. passengers should still expect some delays today. so far there is have been 14 delays and 32 flight cancellations. more than 2,000 flights were

cancelled or delayed during the construction. the trump administration just fired the latest shot in the fight with california over auto emissions. michelle medina reports they want to set national standards and block the current rules. >> reporter: trump administratin has withdrawn california's ability to set its own fuel economy standards. >> no state has the authority to opt out of fuel economy standards. >> reporter: for almost 50 years, california has imposed tougher emission standards to clear the smoggy skies, but president trump wants one nation-wide standard weaker than california's. he contends fuel efficient vehicles are too expensive and too small. >> i mean, they make them now like paper mache. someone touches them and the car collapses. when sometimes hits me i want to be in as close to an army tank as possible. >> reporter: transportation pollution is among one of the nation's largest sources of planet warming greenhouse gases.

that is why 12 other states and washington d.c. follow california's higher emissions standards, accounting for a third of the nation's auto market. legal efforts to stop the move are already under way. it is a battle that could be tied up in the courts for many years. >> he doesn't have the executive authority to do this. he i going about it the wrong way. >> reporter: the trump administration insists the move isn't about politics. >> this is good for public safety, good for the economy, and good for the environment. >> it is about the oil industry, not about the car manufacturers, not about consumers it is not about the health. it is not about the economy. >> reporter: at least four major auto makers are siding with california saying even they don't want the federal government to weaken standards. michelle medina, cbs news, los angeles. tragedy for a popular musician on tour. one person is dead and seven others injured after josh turner's tour bus veeredas 13 mm

$5 billion for privacy violations. new at noon, president trump is suing a manhattan district attorney who is trying to get his hands on his tax returns. cyrus vance jr. recently subpoenaed his accounting firm to get a hold of the last athd years of the president's records. president's attorney says that the suit is intended to address the significant constitutional issues at stake. tensions are high between the u.s. and iran over what the u.s. believes was an iranian air strike on saudi oil facilities. iran's foreign minister appeared on cnn this morning to issue a threat. >> what would be the consequence of the strike on iran now? >> an all out war. >> you make a serious statement. >> i make a serious statement about defending our country. >> secretary of state mike pompeo made an emergency trip to the middle east following the drone and missile attack on saudi oil facilities. >> while the foreign minister of iran is threatening all out war

and to fight until the last we'a coalition aimed at achieving peace and a peaceful resolution. >> the u.s. will roll out more economic sanctions while keeping a military option on the table. the u.s. is working with allies to prepare a case definitively showing iran was responsible for the attack. saudi's defense minute strer displayed evidence of what it says is iranian evidence. iran is calling the evidence lies. texas governor declared a state of disaster for several counties in the wake of tropical depression imelda. they have conducted countless high water rescues. some areas affected by harvey two years ago are getting hit once again. >> reporter: tropical depression imelda is sitting over the houston, texas, area, dumping as much as five inches of rain an hour. flights are cancelled and officials are warning residents to keep their guard up. >> until it clears out of the

area, i'm going to encourage everyone, wherever you are, to please stay where you are. >> reporter: east of houston, the flood water is nearly 16 feet high in dayton, and cars are sinking in winnie. >> we were definitely prepared for a storm. what we weren't prepared for is for a storm to stall on top of us. >> reporter: the deluge brought back memories of hurricane harvey for some residents. this family evacuated to a shelter before the water seeped into the home. >> if you can't see the road it is time to go. >> reporter: in beaumont, texas, nearly a foot water rescues. some areas could see up to three feet of rain before the week is over. the storm spawned weather servis issued a flash flood warning for the area. residents are told to shelter in place. cbs news, houston. it has been a big day for

e-cigarettes is leading some media outlets to change their advertising policies. cbs will stop all future advertising of e-cigarettes, cnn and the parent company announced it will do the same. we'll have much more on the new vaping numbers coming up on the kpix 5 news at 5:00 and online at kpix.com. house speaker nancy pelosi is calling for the federal government to cap the cost of some prescription drugs. the bill proposes that the federal government will negotiate prices with the makers of the top 250 most expensive drugs on the market that don't have at least two competitors. >> as we know, for your seniors and families across america, the struggle is the sky rocketing cost of prescription drugs. drugs they need to stay healthy, but also the cost of drugs threatening their financial health and well being as well. >> house republicans have already blasted this bill saying they were shut out of the

drafting process and for ignoring bipartisan bills that already have support. >> if she was serious about lowering drug prices, she would have built upon the work that was already done by republicans and democrats unanimously, bringing a bill out of committee that was focused exclusively on lowering drug prices. instead, she is taking a socialist approach that will actually make it harder to bring life saving drugs to market. >> the new york times has reported immediate reaction from the drug industry was not favorable. the pharmaceutical research and manufacturers called it even radical. trading on wall street, looking at the board, the dow is down about 24 points. new at noon, parts of the old bay bridge being brought back to life on treasure loughln used 36 tons of steel from the old eastern span to design this

view. there is the low pressure system. that brought the cold frontfr us building in and that will be the dominant weather feature over the next several days. on the futurecast, taking you hour by hour. you can see all of the sunshine starting off the day tomorrow with clear skies. plenty of sun for friday in the afternoon and for saturday with temperatures even a little warmer. this is the reason why, with high pressure building in and even moving closer to us, a warmer end to the week and actually, over the next several days, six to ten day outlook, we're looking at warmer than average, above average temperatures, as we go through the next six to ten days, especially for the bay area. sun will set at 7:11 and the sun will rise at 6:55 for tomorrow morning. daytime highs for today, looking at 81 in concord. mid-70s in san jose. 73 in oakland and 68 for san francisco. by the way, we have the 49ers home opener sunday, 1:25 p.m.. sunshine, warm temperatures in the low 80s for kickoff.

welcome back. this week's jefferson award winner volunteers where she works. >> as ellen martin shows us rafael's unusual day job inspired her to serve others. >> san quentin state prison, warden's office. >> she has what many might say is an interesting and challenging day job. for 11 years, she worked at san quentin prison. >> my job duties, i get to work in the warden's office which i never thought i would. >> reporter: off the clock, she often stays within the walls, volunteering. sometimes as a back up singer for one of the inmate's band rehearsals. >> it is a creative space and especially for people that are

artists. it is a way that they express themselves. >> oh, yeah, that is beautiful. >> reporter: she also volunteers for prison programs like squires. san quentin utilization of inmates resources and studies. it brings people to meet with inmates who share with them what it is really like to be locked up. and she encourages young, incarcerated men, to express themselves with music through the youth offender's program. >> so meaningful to be able to work with music inside the prison and actually utilize the time to help others. it is the best gift i can have to help others. >> reporter: her long-term commitment to volunteering also inspires those who have been incarcerated longer, like brian acy. >> she is raffi, right? i can't really describe it in words because she does so much. >> reporter: she estimates she has helped hundreds of those involved in the justice system

this. they're so good. they're great for us. i cut them in half, i wrap prosciutto, wrap them. i put them on the grill for 30 seconds to auch heat on the . like, off to the side. the sugar comes out even more. a little bit of the fat renders and then the balsamic give makes it tart. that is a dessert right there. it is so delicious. it is so good. let's talk about the figs. i got carried away. i love that recipe. when you buy black mission figs, make sure they're dark all the way around. cracking is better. it means they're full of sugar. on the counter, not in the fridge. don't store them too long. they're nice and ripe at the market now. i'm tony tantillo, eat fresh and stay healthy. i'm buying this.
