good morning from the studio 57 newsroom at cbs headquarters here in new york. anne-marie green is off, i'm brook silva-braga. president trump is lashing out after the release of an explosive whistleblower complaint that is fueling the impeachment inquiry. it accuses mr. trump of abusing his power and officials of covering it up. a new npr/pbs hour marist poll shows the nation is split over the democrats' impeachment investigation. 49% approving, 46% disapproving. marc liverman is in new york with what we're learning about the president's response. good morning. >> reporter: good morning, brook. the president compared the person in the white house who supplied information to the whistleblower to spies and suggested that he committed treason. president trump says he's at war following the release of a whistleblower complaint detailing his phone call with ukraine's president. >> who's the person that gave the whistleblower the information? >> reporter: in a video of a

closed door gathering of u.s. diplomats obtained by bloomberg news, the president suggested it could be treason. >> you know what we used to do in the old days when we were smart, right, with spies and treason. we used to handle it differently than we do now. >> reporter: in a nine-page complaint released yesterday, the whistleblower said senior white house officials worked to lock down all records of a presidential phone call this summer out of fear that they had witnessed the president abuse his office for personal gain. acting director of national intelligence, joseph maguire, told lawmakers he has no reason to doubt the whistleblower. >> you don't have any reason to accuse them of disloyalty to our country or suggest they're beholden to some other country? >> absolutely not. i think the whistleblower did the right thing. i think he followed the law every step of the way. >> reporter: republicans point out that the whistleblower was not a direct witness to most of the events described. >> the whistleblower tells us the officials that i spoke with told me, and white house officials told me that -- in other words, all of this is secondhand information.

>> reporter: but house speaker nancy pelosi says it provides a roadmap for an impeachment investigation. >> there are some in our caucus who think let's just having an impeachment. no. we have to have an inquiry to further establish the facts. >> reporter: president trump maintains he did not pressure ukraine to investigate his political rival, joe biden. and members of congress are leaving d.c. today for a two-week recess. brook? >> okay, marc liverman in new york. thanks. president trump's personal lawyer, rudy giuliani, and attorney general, william barr, are named in the complaint. paula reid looks at the serious accusations against them. >> reporter: the whistleblower singles out rudy giuliani as a central figure in the scandal. the president's personal lawyer is mentioned 30 times in the complaint which cites meetings he had with at least seven ukrainian officials. in early august, just eight days after president trump's call with his ukrainian counterpart,

giuliani flew to madrid to meet with one of the ukranian leader's advisers. according to the complaint, they discussed cases the two had raised. giuliani has admitted to pressuring ukraine to open an investigation into former vice president joe biden and his son, hunter. >> you did ask ukraine to look into joe biden? >> of course i did. >> reporter: the whistleblower alleges starting in mid-may u.s. officials were deeply concerned by giuliani's circumvention of national security decisionmaking and efforts to relay messages between the white house and ukraine. president trump defended his personal attorney wednesday. >> rudy giuliani's a great lawyer. he was a great man. he's highly respected. >> reporter: responding to the whistleblower's allegations, giuliani said "it is impossible that the whistleblower is a hero and i'm not. and i will be the hero." scott frederickson is a former independent counsel. >> we've never in the history of our country that i'm aware of ever seen a personal attorney engage in this kind of foreign diplomacy, especially with

respect to these very specific requests. >> reporter: the complaint also singles out attorney general william barr. president trump told the ukranian president barr would investigating the bidens, but the justice department said the president never asked barr to contact ukraine. paula reid, cbs news. hillary clinton is weighing in on the impeachment inquiry. president trump's former democratic rival spoke at an event in washington last night. >> we've got to do two things at once. we have to talk about what's at stake with impeachment, and we have to advocate for what's at stake in the next election. we can do that. and we must do that. >> clinton also said president trump betrayed his oath of office to uphold the constitution and protect and defend our country. the cdc says the number of deaths linked to vaping has risen to at least 12 nationwide.

health officials say there are now 805 probable and confirmed cases of lung injury across 46 states. the cdc has not pinpointed the cause, but it recommends people stop using e-cigarettes. the vaping industry is also suing to nullify new york state's ban on the sale of flavored e-cigarettes. advocates of the lawsuit say the state's ban unfairly targets former smokers who rely on flavors while failing to address marketing to youth. a california businessman has become the third parent to be sentenced in the sweeping college admissions scandal. he was sentenced to four months in prison and has to pay $400,000 in fines. he paid nearly half a million dollars to get his son into the university as a fake tennis recruit. felicity huffman and lori loughlin were also charged. pleading guilty, huffman will serve 14 days in prison. loughlin pled not guilty and is fighting the charges.

a former dallas police officer is expected to testify in her defense early today. amber guyger is accused of killing her black neighbor inside his apartment. guyger said she thought she entered her own apartment when she shot jean. she said she thought he was a burglar. yesterday a witness for the prosecution surprised the court when he said he did not think guyger committed a crime. >> no, i don't believe that it was reckless or criminally negligent based on the totality of the investigation and the circumstances. >> the trial is expected to continue for about another week. an alaska airlines flight was diveverted following action by an unruly passenger. the flight yesterday from new york to los angeles was diverted to kansas city. the plane landed safely. the passenger allegedly made a verbal threat to do harm to the plane. take a listen. >> you're wrong -- seven people right here to use the bathroom while the whole bathroom up there is empty is wrong.

>> the man was restrained until the plane could land and police could take over. alaska airlines is disputing reports the passenger tried to break into the pilot's cabin, saying the man tried to get into first class to use the bathroom there. an army soldier has been killed in a black hawk helicopter crash in louisiana. the chopper went down yesterday morning in the training area in ft. polk about 150 miles northwest of baton rouge. three other stfs members were hurt. the cause is under investigation. okay, coming up on the morning news, hurricane victims in florida finally getting relief aid nearly one year later. and break out the glitter and glam, the super bowl announces two superstars to perform at the 2020 halftime show. this is the "cbs morning news." ime show. this is the "cbs morning news." ♪ ♪ jenny from the block here i go ♪ we now know pop superstars jennifer lopez and shakira will perform together during the 2020 super bowl halftime show. it was announced yesterday. jay-z's rock nation will co-produce the show. lopez is known for such hits as, we're listening now, "jenny from the block" and "if you had my love," currently starring in "hustlers." shakira is a three-time grammy winner, one of the world's best selling latin artists. the super bowl will be played in miami on february 2nd. help for victims of hurricane michael one year later, and the rate of suicide among military troops hits a high. those are some of the headlines on the "morning newsstand." the "washington post" reports a northern gulf coast city heavily damaged by last year's hurricane michael is getting a more than $1 million state grant to help it recover. yesterday governor ron disantis announced that mexico beach will receive the money to help rebuild its infrastructure and

public services. >> we knew that some of the local services were in jeopardy, and so we saw an opportunity to support the mexico beach fire department as well as the police, some law enforcement operations. >> the money going to mexico beach is the first of $25 million expected to go florida communities still reeling from the hurricane. "usa today" reports last year's military suicide rate spiked to its highest level in five years. the army, navy, and marine corps all saw the rate of suicides go up among active duty troops. the marines had the highest rate with 31.4 suicides per 100,000 marines. only the air force saw a decrease. the number of suicides across the military increased from 511 in 2017 to 541 in 2018. troops who died by suicide were mostly enlisted men under the age of 30. and "time" reports the anti-defamation league is expanding its online data base of hate symbols.

in mass production and shipping to select customers. on the cbs "money watch," uber rolls out a new system to keep riders safe, and doordash confirms a data breach affecting millions. diane king hall is at the new york stock exchange with that and more. good morning, diane. >> reporter: good morning, brook. investors will be closely watching a couple of companies today. peloton and micron. peloton made its debut on wall street yesterday, pricing its shares at $29. pretty lackluster in the end. meanwhile, chip maker micron fell in after hours trading following the release of its quarterly report card. health care and energy shares accounted for much of the market sell-off. and wall street reacted to the whistleblower complaint. so the dow fell 79 points, the s&p 500 lost 7, and the nasdaq dropped 46. uber has launched a series of new features focusing on rider safety. the optional verification system will require drivers to get a pin from their rider before a trip can start.

and starting next month, riders can text 911 from inside the app, automatically sending the urntocatio and destinatio riders will also be able to report safety issues during a trip. doordash has confirmed a data breach that impacted nearly five million people. the food delivery company says the information of customers, workers, and merchants was stolen by hackers in may of this year. among the affected information was names, addresses, phone numbers, order history, and emails. the company says however customers who join after april of 2019 are not affected by the breach. users of amazon's alexa digital assistant can now request that recordings of their voice commands delete automatically. previously users had to go into alexa's settings and delete recordings manually. users can ask amazon to automatically delete recordings after three months or 18 months. users need to specify that in the setings because recordings are kept indefinitely by default.

our top stories this morning -- president trump is calling the impeachment investigation an effort by democrats to destroy the republican party. an explosive whistleblower complaint accuses mr. trump of abusing his power. it alleges white house officials tried to cover it up. the new npr/pbs marist poll finds 49% of americans support the inquiry with 46% against it. and the cdc says the number of deaths linked to vaping has risen to at least 12 nationwide. health officials say confirmed and probable cases of lung injury have surpassed 800 across 46 states. the cdc has not pinpointed the cause. school safety advocates including a school shooting survivor told a house panel

yesterday that reactive measures are not enough to stop shootings. they're calling on congress to act to prevent the next massacre. katherine johnson has details. we have failed you. >> reporter: the gun debate shifted to school safety on capitol hill as advocates testified before a house panel. lawmakers heard from 16-year-old lauren hock who survived the 2018 parkland shooting. >> do you think we would act? >> i hope one day you will. unfortunately, if that takes until people my age are in your position, we're going to be the legislators sitting in your seats. we're going to be the ones who have lived through this. we'll have to make these changes. >> reporter: max schacter's son alex was one of 17 killed at marjorie stoneman douglas high school. >> we know that the next school mass murderer is already out there. it is not a question of if, it is a question of when. >> reporter: after the parkland shooting, congress passed measures to fund grant programs for school violence prevention training and infrastructure improvements. a white house commission suggested arming school
