good morning from the studio 57 newsroom at cbs news headquarters here in new york. good to be with you. i'm anne-marie green. president trump's personal attorney is now facing a battle of his own with a congressional impeachment inquiry. lawmakers have subpoenaed rudy giuliani to hand over documents related to ukraine and this comes as new information emerges about who else was listening to that phone call between president trump and his ukrainian counterpart this summer. laura podesta is in new york. what are we learning about that call right now? >> as you said, anne-marie, we were learning who was listening in. that would be secretary of state mike pompeo. some are saying he should have blown d whistle on the content of that call before the whistle-blower. attorney has been subpoenaed as part of the impeachment inquiry. ay thid aem advance his personal political

interests by abusing the power of the office of the president in a scheme. they want all documents related to his dealings with ukraine since the president's inauguration. >> i'm weighing the alternatives. i'll kind of like go through it, get all my evidence together, get charts. >> giuliani has admitted to asking ukrainian officials to investigate joe biden and his son hunter over claims of corruption, claims that are unproven. he was mentioned 31 times in president trump's phone call with the ukraine president. >> the call was perfect. when the whistle-blower reported it, he made it sound terrible. >> according to a white house summary of that call, mr. trump repeatedly asked volodymyr zelensky to look into the bidens. cbs news confirms secretary of state mike pompeo was listening in. >> we don't know what he did. >> on "the late show" with

accused of spying for china. the california man was arrested after a sting operation. jeff pegues has the undercover video that led to the lae video shows edward peng, a naturalized u.s. citizen, wrapping $20,000 in cash and taping it under a tv stand in a hotel in columbus, georgia. about three hours later he's back to pick up an sd card containing classified national security information, a double agent working for the fbi had left the card in the drawer before taking the $20,000. the so-called dead drop was one of six that took place between california and georgia. peng was working as a san francisco tour guide for chinese tourists but david andersen said he was actually working for the republic of china. >> pong was a secret agent involved in dead drops that

included payments. >> reporter: authorities say the double agent penetrated the spy spring in the san francisco airy in 2015. he would pick up the memory cards and fly them from the u.s. to china. former cia acting director michael morell says the spy game between u.s. and china is on the rise. >> his arrest is the fourth case we've seen of chinese espionage just in the last several months. i think it's both a reflection of how aggressive the chinese are being and how aggressive we're being in trying to push back on them. >> reporter: the u.s. attorney said northern california is ground zero in the fight to protect technology and intell t intellectual property. u.s. investigators say they had tight controls over the classified information turned over in the dead drops turned over by peng in 2001. jeff pegues, cbs news, washington. well, today marks the 70th anniversary since the founding of the people's republic of china. in hong kong the anniversary was marked with protests.

police officer. yesterday in closing arguments prosecutors said amber guyger was an intruder who shot and killed botham jean inside his apartment last year. akes thad when the verdict is announced, advocacy groups are urged to keep any demonstrations civil and peaceful. >> if she is found guilty, yes, there should be protests, but it should be dignified. it should be about botham jean's life. >> guyger testified last week that she mistook jean's apartment for her own after a long shift at work. four inmates who broke out of an ohio jail are back behind bars this morning. the men overpowered two female corrections officers on sunday using a homemade weapon. they were captured in north carolina yesterday. authorities say that the inmates had assistance from at least one person outside of the jail.

were untrue after a police investigation. the girl's family apologized to the boys and the school. idaho hope falls say as man suffered severe burns after falling into thermal water at the old faithful geyser. park officials say the 48-year-old man told rangers he was walking near the geyser without a flashlight and tripped into a hot spring. he was able to get back to the report and call for help. rangers reportedly claimed he was drinking. he's in critical condition. the man could face charges. a "new york times" reports an nypd officer was killed by friendly fire during a struggle with a suspect. it happened sunday. investigators had previously suggest thad 33-year-old brian s from his own gun during the struggle, but police say mulkeen kept control of his gun and fired five shots after the suspects reached toward his waistband.th thaofficefired tent
