fo this is kpix5 news. now at noon. and streaming. they go back to court. thanks for joining is. i'm kenny choi. >> i'm michelle griego. right now at the house on magnolia street, a large crow has gathered in a show of force to stop the eviction. you can see demonstrate tors forming a human chain around the home. kpix 5's jackie ward is in hayward where they also showed up at course. >> reporter: attorneys at the group moms for housing said it was significant as they wait for the judge to make a decision. >> we barely get to spend time with our kids because we want them to have a stable home.

it is hard for us with so many blocks in our path but we're hardworking moms. >> reporter: misty cross is one of six defendants that lives inside. she works three jobs. her co-defendant domonique walker also works multiple jobs and shared what she would tell the judge if she had a chance. >> i would talk about the programs that are put in place to help that don't help. i would tell the court about all of the application that i filled out, the application fees, the credit check fees that land nowhere. >> after the hearing, the judge decided to take this case into consideration. >> for us that creates a lot of hopefulness in terms of his future decision. >> reporter: wedgewood properties say trespassers do whose have the right to property but they have they have the right for adequate housing. while it is sympathetic to the blight of homelessness, it does

just south of brokaw road. all lanes were blocked for a time, but since reopened. it was the second pedestrian death of the weekend in san jose. a 63-year-old woman was hit and killed while crossing oakland road near brokaw. she was not in a crosswalk. the total now 30 in 2019. an emotional night for friends and family of three dublin teens killed in a christmas night crash. a candlelight vigil was head at the high school last night to remember the 16-year-old boys. their car careened off the road hitting a power pole and a tree. the three died at the scene. two others were thrown from the car and suffered major injuries. >> he always wanted the best for everybody and he was such a good person. >> they were so joyful and always smiling and always happy.

there was never a time when they were separated so it is sad to see them all go at the same time. >> the cause is still under investigation. taking a live look at the airport. the scene of an emergency landing for the kansas jayhawks men's basketball teach. video taken from inside the chartered plane shows flames coming out from under the wing. the blaine turned and headed back for the airport. the jayhawks tweeting out saying one of the engines failed and the pilot contacted the airport and we made a safe landing. we're grateful to the pilots and the entire flight crew. an armed parishioner is being called a hero after killing a gunman who opened fire on a texas congregation. here is the harrowing stories from survivors. >> it was like matter of seconds. >> reporter: that is how long it took to have a peaceful sunday service to have a room

in chaos and fear. cameras inside this sanctuary captured the moment the gunman pulled a shotgun from his pants and shooting two in the corner of church. some people ran to escape the danger and others hid under pews. isabel and her family noticed the man toward the billerica of the church. >> i didn't feel comfortable. he was giving me a bad vibe. she was within feet of the gunman when he started shooting. i said to my husband let's go and give me my baby. the gunman was killed by a gunman part of the security team. others drew their guns as well. there were more than 240 people inside at the time. >> this team responded quickly and within six seconds, the shooting was over. >> reporter: church members said they were richard white

taking a live look at the white house this afternoon where the president will return from vacation to face the continued threat of an impeachment trial. skyler henry on the assurances he is getting from republican leaders. >> reporter: president donald trump continues to slam house speaker nancy pelosi's decision to withhold the articles of impeachment from the senate for now. the president tweeted this weekend crazy nancy pelosi should spend more time in her decaying city and less time on the impeachment hoax. his republican colleagues say the trial will happen and that the president will likely result. >> the son will have a fair trial and an acquittal. >> those without documents to

and upper 60s inland through the rest of the afternoon. want you to be aware, we have a beach hazard statement in effect from 1:00 p.m. tomorrow until 9:00 p.m. wednesday because of sneaker waves. we're looking at the swells, 6 to 11 feet and breakers up to 25 feet, so there is increased risk of rip currents as we head through tomorrow and wednesday. that low pressure system that did bring the wet weather on sunday continues to move out of here and this ridge of high pressure building in. it will be the dominant weather feature over the next several days. you can see all of that sunshine as we head through tomorrow. we are looking at plenty of sun, as well and then watch as we ring in the new year. mainly clear skies at midnight and lacking at partly sunny skies tor your wednesday for the first day of 2020. our sunset at 4:59. our sunrise tomorrow at 7:234.

daytime highs for today, seasonal and around where we should be, 56 in san francisco. looking at 58 in oakland and fremont. 60 in san jose. 60 for a high in santa rosa and looking at 58 for concord. your fireworks, new year's forecast first. looking at 8 p.m. temperatures in the low 50s if you're heading out the embarcadero center and mid 5s a round midnight. chilly temperatures but we're looking at those clear skies to watch all of our fireworks. there we go with the extended forecast the we're looking at starting off the new year weather dry conditions and partly sunny skies for wednesday and thursday. plenty of sunshine on friday. we'll start the first weekend of the new year with that sunshine. a little cooler, but still saturday and sunday looking great for outdoor events. >> that sounds pretty good. new new year's eve. no fog. >> fingers crossed. >> entertainers making
