york city, i'm omar villafranca. it's monday, january 20th, 2020. this is the "cbs morning news". impeachment trial. with opening arguments set to begin tomorrow questions remain over whether new witnesses will be included in the proceedings against president trump. bracing for violence. hate groups are among those expected to descend on virginia today where a gun rights rally is being held at the state capitol. you got to fight for your life! yeah! and the super bowl is set. the kansas city chiefs will take on the san francisco 49ers in super bowl liv.

captioning funded by cbs good morning from the studio 57 newsroom at cbs headquarters here in new york. i'm anne-marie green. it is the eve of opening arguments in president trump's impeachment trial in the senate and the rules coconcerning possible new witnesses have not yet been established. meanwhile some of mr. trump's supporters are defending him. senator lindsey graham called the impeachment process yesterday a partisan railroad job. the president's high-profile defense attorney alan dershowitz said he plans to prove the charges against mr. trump are not impeachable. senate minority leader chuck schumer says he's prepared to force votes for witnesses and documents, even if majority leader mitch mcconnell does not call for it in his proposal. johnny fernandez is in new york here with more. >> reporter: the president's attorneys are expected to file a more detailed trial brief today laying out their arguments. the white house plans to argue

the impeachment articles allege no violation of the law. now the ground rules for how exactly trial will be conducted have not been revealed yet. senate majority leader mitch mcconnell says that he has the 51 votes to start the trial before making a decision on calling witnesses. at a farmer's convention in texas president trump railed against democrats as the impeachment trial draws closer. >> by these radical left lunatics i get impeached. but that's okay the farmers are sticking with trump. >> reporter: democratic house managers were on capitol hill over the weekend planning their strategy. >> all relevant evidence should be admitted and the president has engaged in a concerted attempt to deny all evidence. >> reporter: they want to hear from new witnesses but will need at least four gop senators to make that happen. >> are you still open-minded on witnesses? >> i am only in the scope of the articles of impeachment. >> if we call one witness we'll call all.

>> reporter: president's defense team includes ken starr and alan dershowitz. >> anything that's alleged by the house managers is proven or taken as true, they would not rise to the level of an impeachable offense. >> that's the argument you have to make if the facts are so dead set against you. >> reporter: on n sunday senate democrats complained mitch mcconnell has kept them in the dark about the trial rules. >> leader mcconnell, president trump, what are you hiding? why are you afraid of the truth? >> reporter: the senate will vote on ground rules tomorrow the same day that opening arguments begin. now when the trial begins on tuesday president trump will be out of the country attending the world economic forum in switzerland. now he's expected to be back at the white house on wednesday evening. all right, thank you. ahead on cbs "this morning" former republican senator jeff flake will join us in studio 57 to offer his thoughts on the historic impeachment trial. federal and state authorities in virginia are

stepping up security today ahead of a gun rights rally in richmond. thousands of pro gun rights activists across the country are expected to attend. they are demanding state democrats drop a push for comprehensive gun control in the state. threats of violence have spread quickly including claims of armed militia storming virginia's capitol. some demonstrators feel their message will be marred. >> reporter: our fears are the skin heads and neo-nazi groups, white supremacists will come in here and wreck it for us. >> a temporary stay of emergency is in place. there's a ban of firearms on the capitol grounds. a virus outbreak in china is spreading as millions travel for the lunar new year. there are more than 200 confirmed cases of the coronavirus. today south korea confirmed its first case of the virus. it's the third country affected by the outbreak following thailand and japan.

three people have died from the illness which produces pneumonia like symptoms. as a precaution the u.s. is screening airline passengers arriving from central japan. >> they go through a screen. we check their temperature to make sure we're okay. >> officials in china say the virus is still preventable and controllable. two police officers are dead and an investigation is under way after an eviction goes wrong in hawaii. police say the suspect gunned down two veteran officers. they had been responding to a call about a stabbing at a home in waikiki yesterday. the suspect reportedly attacked his landlord after she tried to evict him. he torched the home. the flame spread to several other houses. authority believe he died in the fire. his remains have not been located.

two people are dead following a mass shooting in texas. an argument led to the shooting inside a nightclub along the san antonio riverwalk last night. one person died at the scene. another died at a hospital. five others were hurt. a suspect has been identified, however no arrests have been made. well, it will be the san francisco 49ers versus the kansas city chiefs in the super bowl. >> downfield and -- 49er defensive back richard sherman intercepting a pass from green bay packers quarterback aaron rodgers and help seal san francisco's victory in last night's nfc championship game. the 49ers will be making their first appearance in the super bowl in seven years. it's been a much longer wait for their opponents the kansas city chiefs. the chiefs defeated the tennessee titans, 35-24. the chiefs will be heading to the super bowl for the first time in 50 years.

>> you got to fight for your life! yeah! super bowl liv will take place on february 2nd in miami. elon musk spacex also had a lot to celebrate. it took a big step forward before launching astronauts to the international space station. more from meg oliver. >> reporter: it was a ride designed to fail. under hazy blue skies, it lifted off carrying test dummies. about 84 seconds into the flight the falcon 9 rocket shut down its engines as planned simulating an emergency. the escape system blasted the crew capsule away from the rocket at more than twice the sound of speed escaping an explosion, parachutes brought it to a safe splash down in the atlantic.

>> thus far, picture perfect mission. it went as well as we could possibly expect. >> reporter: it was the last major test for spacex, to know astronauts can abort and escape safely before flying them into space. >> getting it done successfully was a very big step forward for spacex and nasa. >> reporter: boeing is part of this new american space race. last month they failed to dock their ship with the space station during a test. nasa needs both companies to succeed. >> both of these companies will be launching regular rotation crews to the station starting later this year. ending nasa's sole reliance on russian so use spacecraft. spacex could launch two astronauts sometime this spring. >> reporter: meg oliver, cbs news, new york. prince harry has broken his silence following the decision that he and his wife meghan give up their royal duties.

the duke of sussex says the decision comes with great sadness, but there was no other option. skylar henry reports. >> i can only imagine what you may have heard or read over the past few weeks. >> reporter: it was an extraordinary moment for the british monarchy. prince harry spoke at a british charity event about his decision with his wife meghan to give up their royal duties. >> once we were married we were excited, hopeful, and here to serve. for those reasons it brings me great sadness it has come to this. >> reporter: it comes after buckingham palace announced an agreement with the couple over the weekend. >> so many months of talks. after so many years of challenges. >> reporter: the understanding will allow harry stay a prince and the couple to retain their titles as duke and duchess of sussex. they will split their time between canada and britain but not participate in ceremonial events or official royal tours. >> our hope is to continue to serve the queen, the commonwealth and my military associations but without public

across australia's capital today. hail the size of golf balls pounded the parliament building. cars were dented and windows smashed. dust storms blanketed towns in new south wales. same area hit by bushfires. wind gusts of 66 mile-per-hour were recorded. no one was hurt. an official in puerto rico is fired over wasted aid and a key figure is arrested in hong kong. those are some of the headlines on the morning newsstand. reuters says police in hong kong arrested the organizer of a protest after the rally turned violent. yesterday thousands gathered at a park to call for electoral reforms and a boycott of the chinese communist party. clashes broke out between the protesters and police who fired

tear gas. police said two officers were attacked with wooden sticks and suffered head injuries. the rally's organizers said more large protests are needed for global attention to return to hong kong. the "washington examiner" reports puerto rico's governor fired the director of emergency management. that's after a warehouse full of supplies dating back to 2017's hurricane maria was discovered. the governor also fired the heads of puerto rico's housing and family departments. the warehouse in ponce was being inspected for damage following recent earthquakes in the area. inside officials found food, water, diapers and medicine that were supposed to help victims of hurricane maria. cbsnews.com reports the next u.s. navy aircraft carrier which are usually named after presidents will be named after an african-american hero from pearl harbor. the official announcement naming the next carrier after dorie miller is taking place today at pearl harbor on martin luther king jr.'s birthday. miller was the first african-american to receive the navy cross for valor.

the recalled strollers were sold between october and november of 2019. they are also sold at target and amazon. baby trend said people should stop using the strollers immediately and contact the company for a full refund or replacement. tesla is under investigation amid allegations its cars can accelerate without warning. there are 127 complaints now blaming unintended acceleration for multiple crashes. the investigation will look at roughly 500,000 tesla vehicles and all models are included here primarily from 2012 through 2019. 110 crashes with 52 injuries have been reported. tesla has not responded to requests for comment. and the reboot of a decades old franchise dominated the box office over the weekend. >> knock, knock. >> what the hell happened to knock and talk? >> hands behind your head.
