hundred together and walked it over not mourning the death of supreme court justice ruth bader ginsburg. >> an impromptu vigil in san francisco with the reaction overnight to her death. the san jose police are cracking down in response to a dramatic spike in sideshows and street racing. good morning. it is saturday, september 9. i am emily turner. >> i am devin fehely. hundreds gathering outside of supreme court bringing signs, flowers mourning the passing of supreme court justice ruth bader ginsburg. cbs reporter deborah farone takes a look at her life and legacy. >> reporter: mourners gathering in paying tribute for ruth bader ginsburg. >> i feel that so much of what i have today in this country is her ideals and what she fought for.

>> reporter: the second woman ever pick to serve on the nation's highest court. she arrived with an impressive resume. in the 1970s the native new yorker was an architect or the women's right movement, arguing six cases before the supreme court, and she won five. asked supreme court justice ginsburg was a strong voice champion of women's rights and equality. >> reporter: president trump had kind words for ginsburg. >> she was an amazing woman that led an amazing life. i am saddened to hear that. >> reporter: the president will nominate the ginsburg replacement likely from a list of candidates he already put together. democratic presidential joe biden says the choice to be made after the election. >> voters to he priden consldk fo

nonee. ate jority lder mitcidt r deborah farone, cbs news the supreme court. >> deborah will join us live to talk about the political implications of the vacant supreme court seat. overnight the flags lowered to half-staff in honor of justice ginsburg with at home hundreds crowding the district saying we will not let you down, "rbg", as she was known to many. california attorney general argued cases in front of ginsburg at the supreme court and argued and reacted to her death saying she was the little engine that could for all of us and leaves us her story to make us proud, and how do you fill the shoes of a giant? governor newsom said that

throughout her extensive career, her fight tirelessly for the rights of women at work, school and in the life of our nation. it's time to check on the weather this morning with emily turner. >> the two big takeaways are we will are warming up at least in some parts of the bay area. it is nice and clear giving us a clear picture of the bay bridge with current temperatures mild for this time of the morning. 61 and concord, 59 and livermore. at santa rosa a chilly 53 with fog as well. visibility is not great in certain parts but mostly in the low-lying areas and along the coast. we have quarter-mile visibility in santa rosa with one mile in petaluma and the golden gate as well.

as well as louth bstd half mn bay we are wakup with c temperatures with that cold front moving through but that will change and things will start to warm up. in fact, our high temperatures this afternoon close to 90 inland. mid-70s around the bay. we have a few clouds here and there but along the coast we wake up with cloudy conditions and potentially drizzle which will start to clear out, at least the drizzle portion. but the clouds and the fog will remain. new this morning, 4.5 earthquake shook southern california last night 5 miles east of los angeles near rosemead. the earthquake could be felt as far san diego but no immediate reports of damage or injuries. the san jose where the police say they've seen a rise in the sideshows and street racing. they will be out looking for violators before they even get to the finish line. kpix 5 maria medina has the

latest on the steep consequences of getting caught. >> i'm upset. the racing we are saying is endangering people's lives. >> reporter: the videos posted recently on youtube capturing cars hitting spectators at the site show in i get a complaint least one or several every single day. >> reporter: this begins as we start our interview with councilmember. >> this is been a nightmare. >> reporter: the council members say that the rise in street racing and sideshows is not only limited to one part of the city's back we have seen bad crashes increasing and i area. these are in neighborhoods next where the families live and kids are playing. >> reporter: morning constituents not to confront those involved.

>> i have had to talk my residence out of confronting people because they have had guns pulled on them. >> if the vehicles are caught they are impounded for up to 30 days and that is $3000 worth of fines. >> reporter: san jose police have arrested brenda people since the ordinance when in effect allowing police to fine even spectators up to $1000 or put them in jail for up to six months. >> we have had lasers wanted it officers and objects put in the front of the cars. >> reporter: maia has a message for those coming to san jose to commit crimes. >> do not come to san jose and we don't want to arrest you. >> reporter: the city council members say's these are not only happening in the streets and neighborhoods bet at schools and in parking lots. the man killed by walnut creek police family reached a $4 million settlement. the encounter turned deadly in june of last year. the family and parents of miles hall say was suffering a mental episode. they called 911 telling

dispatchers he was behaving erratically and carrying a prybar. but the family said rather than the escalating the situation that officers opened fire. family attorney john burris said they reached out to the police before to explain the issue of their son with mental illness. >> typically in prior occasions encountering something like that it would run home. he was taught to run home. the tragedy is that the very thing they were trying to prevent is an african-american male killed by the police in effect happen. what they were trying to get done in terms of procedures was not followed. >> in addition to the financial settlement the city committed to increasing training for the police on mental health response and crisis intervention. "while the city recognizes the continuing loss of the hall family it is the city sincere hope that the settlement of the civil lawsuit will provide a step toward hearing still ahead on kpix 5 and

new this morning, gunfire erupted at a backyard party in rochester, new york killing two and wounding 14. the man and woman that died were in their late teens or early 20s. the police say it's unclear whether there were multiple shooters and so far no suspect is in custody. the shooting does not appear to be linked to the scandal in rochester over the death of amanda please gusting back in march. a drive-by shooting killed a man and richmond sending two others to the hospital. the investigation is underway. this was outside of the store at four street and mcdonnell. chopper 5 blue over the scene and there was heavy police activity. the police have not identified the suspect or suspect vehicle but say they're working on it. another victim was airlifted to the hospital with serious injuries and the third victim is expected to survive. and fremont a man was stabbed on board bart at the warm springs station and a suspect

was arrested in that incident would shut down the station for an hour yesterday. and san francisco restaurant could open for indoor dining as soon as october 1st if the number of covid-19 cases remain stable and if we move into the orange tier. restaurant can open with limited capacity and help modifications. experts say's a big step toward the start of the restaurant industry rebound. >> the character of san francisco will be different when we come out of this. many of the neighborhood restaurants that were favored places for us to go may not open again with many closing permanently. san francisco has come back from these types of situations before. >> the ci is gie een light to allow museums to welcome back visitors as early as next week. admission is open to the general public next friday and the asian art museum will be open october 1st.

has the weather. >> we wake up to fog and see smoke coming in from the north and potentially making it into the city and peninsula that it kind of depends on how much wind we get later in the afternoon. let's start with current conditions as far as the fog is concerned. at petaluma 1 my visibility with low visibility as well at this will clear up in the afternoon with the exception at the coast where the marine layer will retreat back and eventually remaining along the coast. we see a little bit of fog at the bottom of the screen looking out live to the bay bridge. 60s with 61 in concord, if you nine in livermore with santa rosa the most chilly at 53 degrees where the fog is impacting visibility. the 24 hour temperature change tells an interesting story. we have had a cold front moved through over the last couple of days with lower than average temperatures with chilly

temperatures by a few degrees. the story will ship today and we will wake up to warmer temperatures tomorrow with the warming trend moving in for the remainder of the weekend. that has thanks to this low pressure system which is ushering in cooler temperatures. it dropped a lot of rain east of us but unfortunately not in our direction. but they are at least getting much needed rain for the fire season. behind this is that high pressure system bringing up temperatures and behind that is a low pressure system ushering in another cooling trend. that's in the long-range forecast. will get there we have dry and warm temperatures. clouds and fog along the coast with some drizzle we will wake up with this morning. we have temperatures throughout the weekend with conditions continuing into the afternoon sunday. monday cooler temperatures return next week with air quality forecasts not great. today we are in the green with a spare the air alert and that will get worse into the week as

we see the fires, predominately the northern part of the state. that will affect us as we look at the smoke drifting into the north bay. that will slowly start creeping lower and lower. it will of the air quality continue to affect us into the beginning of next week. the marine layer goes back to the coast before building back in. overnight we will have warmer temperatures because this will not come in as far as it normally does over the remainder of the weekend. it will retreat back to the coast before we move into the beginning of next week in which tellus off. build back in today a mix of 70s and lfn y. east bay temperatures close to are in the around the bay itself we have a mix of 60s, 70s and 80s as far as the 7-day forecast is concerned. temperatures will begin to decrease and then rising back up

toward the end of the weekend. ginning of next week we will cool all. we have a roller coaster pretty much of the next several days. unfortunately the air quality is declining again. >> i was working out of the city yesterday, and it was absolutely gorgeous. but keeping with the themes of 2020, the good times won't last. a quick check on bay area fires with three major fire sparked by lightning a month ago nearing containment. the czu complex fire burned over 86,000 acres in santa cruz and san mateo counties and expect that will be fully contained by tomorrow night. social distancing during the pandemic can be challenging and especially difficult for the blind and visually impaired. seeing eye dogs like this lab gold cross are trained to do a

lot but not taught to socially distance. it makes it difficult to keep the owner six feet apart from other people. a woman that relies on her dog every day says that when you recognize the guy dog and its owner, it's up to you to keep a healthy distance. >> if i am not social distancing from you, i am not trying to be disrespectful or discourteous but i simply do not have the visual that you have. we praise that you ahead of time taking your steps on your own to walk a few streets down or steps down and on the other side of the street. >> it's also important not to pet or interact with guide dogs, and just let them do their jobs. good morning, everybody. straight ahead in sports, the lakers likes their game last night and a letter grade in oakland last night and how about all a's, and what that awesome internet. it's more than just fast.

day after her husband, marty, passed away in 2010. she came here and nowhere she would rather be than in her people have been coming here since the news broke last night and still here this morning. since they learned she died they have been coming here to say she is a trailblazer, inspiration, champion of civil rights and equality, and even a beloved pop-culture picture. so many know her and the younger generation knows or simply as "rbg". she was the main architect for the legal fight for women in the 1970s, literally changing the world the way we know it, paving the world ways for women including me. >> she led an amazing life. what else can you say. she was an amazing woman whether you agree or not, she was an amazing woman that led an amazing life. >> she practiced the highest american ideals as a justice.

equality and justice under the law, and ruth bader ginsburg is fit for all of us. she was a beloved figure. >> this is a hugely consequential election, and what kind of impact expect her death will have on the presidential race? >> reporter: we have been talking about this since we learned of her passing last night. it is already a tumultuous election season and this is the thing everyone is now talking about. you may be wondering what she had to say. interesting that she actually spoke with her granddaughter and said i want to get this exactly crest. my most fervent wish is i will not be replaced until a new president is installed. that was a direct quote from her granddaughter and joe biden seems to agree. >> let me be clear. that the

in san jose was santa rosa the most chilly at 53. we have quite a bit of fog and santa rosa down to quarter-mile visibility with half-mile and petaluma, napa at a quarter mile all of it coming through the petaluma gap and the coast. visibility at half moon bay at 5 miles and in other low-lying areas we have low visibility. that will burn back with the exception of the coast. in the meantime we have cooler temperatures waking up today, 8 degrees cooler than napa was yesterday. that will flip the script, and it will be much warmer to the rest of the weekend than we have seen over the last two days let's get back to fire watch in southern california. the bobcat fire forcing evaluations while destroying and threatening homes, and we report from the antelope valley northeast of los angeles. >> reporter: burning joshua trees and bushes, lighting up the desert for with much of the

juniper hills is a haunting landscape with roaring wind forcing flames from the bobcat fire across the antelope valley community very quickly. the crews dropped fire retardant over the fast-moving flames, helicopters dropping water when it got too close to the homes. firefighters using bulldozers to make fire breaks around the properties. many homes were saved but unfortunately some did not make it. this home on the hill collapsed fire fe roadblocg e . >> rep cl with others thare worse to evacuate in order to get families to safety. >> everybody is safe but a little bit nervous. >> reporter: sheriff's deputy step to rescue two horses with fires burning out of control.

the shifting winds made it difficult for crews to keep up, but homeowners are grateful for all of their efforts. >> they are doing everything they can. i saw a couple of fireman coming down with smoke and all of that, and i guess you want everything to be safe but we them too. >> reporter: after the sunset it was hard to get a clear picture of how much out here has escaped them. back in the bay area a woman and her dogs have been displaced after her concord home call fire. the home was completely engulfed in flames. neighbors heard an explosion and saw the power lines parking. that is when the house caught fire and the good samaritan thankfully stepped in. >> i have no clue. it started the real estate man was driving by and saw it. he was pounding on the door. he was trying to warn me. i was in the bedroom on the phone talking with my friend

and had no clue anything was going on. when i came out of my bedroom the whole wall was on fire. parts of washington state get that bad air for days after wildfires and farmworkers. golf, still work in these conditions. >> reporter: it is a fifth straight day of hazardous air quality in the ballet why they tell people to stay in their homes with the ac on as much is possible but many farmworkers are unable to do so right now in the middle of the apple harvest. being outside in poor air quality is likely to reduce your immune system and defenses. >> reporter: this woman works at the orchard in the lower valley and all she has to protect yourself is the cloth face mask. her employer does not have an n- 95 mask to give her. >> i have problems with my throat hurting and i told them

before and they said if you don't want to come to work we understand. instead of it getting worse i did not go to work. >> reporter: but now she misses her paycheck. >> what i want to say to employers is that they need to worry about is, protect us and we will help them with their harvest but they need to protect us first. >> reporter: and people have to be working right now they should try to take breaks and go inside a place with ac. workers to talk with the employer and have a plan if they have a plan and they have to leave. rosie, her husband is a farmworker and the only one supporting her family. she said his employer told him to stay home until the hazardous air clears but that means no pay for them either. atrosh hashana. the nts traditional male is still a centerpiece at this untraditional year. >> reporter: this holiday at

of a coma. the people in the communities near sacramento are glad to be back outside breathing fresh air with friday the best of the week with no smoke. the city of folsom welcomes the new take on cars filing out to fill the concert arena with over a dozen artist during the two day drive-in event. >> it is such a blessing and it has turned out to be such a great night. i think if it had been like it has been we would all be sitting in our cars watching and eny the great music. in citrus heights more than 100 people were filling up the grand oaks parking lot. when it comes to the smokier unfortunately we see it coming back into the forecast today with the spare the air alert in effect. it will not be as terrible as it will be later and certainly not as bad as it was last week with the apocalyptic situation. that will not be what we see in

the future days that we will see smoke as it begins to move back into our area. that begins from the north moving to the south. let me show you the futurecast. mostly fires burning in the northern part of the state that will affect us. as i play through this you can see the thick smoke creeping in from the north to the south. that's napa, sonoma county and potentially part of marin by the afternoon or evening . we will see it sinking down even further and pretty much blanketing the majority of the north bay with the exception of maybe the south bay, parts of the peninsula okay through the remainder of the weekend. it kind of depends on how these low-pressure systems that will move through later in the week, that will determine what happens with the smoke moving into next week. we have visibility issues with a quarter mile at santa rosa and napa with visibility 3 miles at petaluma with 3 miles

in half moon bay. we have a few loki else in the east bay and south bay. you can see the bay bridge but we have low clouds in the background as well. that arose of 53, 59 in livermore with 61 in concord. we are waking up cooler than yesterday with the exception of napa. that fog and rain later made the intrusion dipping temperatures down. that script will flip and we will warm up in the remainder of the weekend. this low pressure system ushered in a cooling trend moving out toward the east. we will have that high pressure system. basically all of this will be dry anwarm before that low pressure system starts to movie and at the end of next week. that has the long-range forecast, but before we get there it will be really nice to more. clouds and fog along the coast with some drizzle along the coast areas. we have warmer and dry air temperatures throughout the weekend. have a little bit of a cool off

at the beginning of next week. rings will start to rebound after that. the futurecast shows the marine layer retreating all the way to the coast and eventually building back in. it will not be as strong as we will have seen in other days, especially toward the end of the week. the 7-day forecast shows temperatures really climbing toward the into the weekend. we cool off a little bit before we go back up again. it's a bit of a roller coaster but the big story is that the smoke is coming back but deafly not as bad as we have seen. >> that is bigger and the south bay but the smoke is getting pushed the south so that will not affect us so much. >> the campfire is where we get the majority of the smoke from. hopefully they will get that contain and it will start burning itself out so we don't have that much of an issue looking for. a big road project could cause a roadblock traveling to the sears with highway 50 closed and the next two weeks

with a bridge project southwest of lake tahoe by levin biles. but the detour is bring a surge in sales for businesses along the way. >> reporter: with highway 50 shutdown for two weeks for the bridgework, the new detours are bringing traffic to places that generally don't see as many people. the marketing company is promoting local tourism to help with the economic challenges that many businesses have been dealing with. >> with the influx of traffic comes more money. more money leads to more upgrades and bettering of the local community. >> reporter: casey said it best with more traffic, more people, more money. the detour to get to south lake tahoe is already bringing in new faces. >> it is taking over from 50 and this is just as beautiful. not only the business is benefiting

school in concord is an art magnet school with no arts budget and the principal said that $10,000 donation of the art supplies is a big deal. >> children's faces will light up when they see everything we have just received. >> from the paints to the crayons the first grade teacher said the nearly 400 students at the school have what they need to unleash creativity. >> we could not function without it. >> reporter: the art supplies are donated by sunny sing of wheartbreaking poverty. >> what bothered me the most was the little children sleeping on sidewalks with near freezing temperatures and begging on the streets. >> reporter: sunny realized he could've been one of them had his adoptive parents not giving him a better life and he started yours humanly to give access to kids for the same
