day battle lines are being drawn on capitol hill over president trump's new supreme court nominee. republicans are pushing for a swift confirmation for judge amy coney barrett. joe biden calls the it an abuse of power. today the president again praised his conservative pick as democrats made clear they want the president and republicans who back him to pay the price for it at the polls. nikole killion is at the white house. ( chanting ) >> reporter: outside the supreme court demonstrators rallied for and against nominee amy coney barrett as president trump expressed confidence in her eventual confirmation. >> she is one of our nation's most brilliant legal minds, i think she will do well, we are moving quickly. tremendous unity in the republican party >> reporter: with the high court set to take up the affordable

care act soon after the election, the president tweeted obamacare will be replaced with a much better and far cheaper alternative if it is terminated in the supreme court. former vice president joe biden accused mr. trump of using barrett's nomination to throw out the landmark legislation. >> i'm focused on making sure the american people understand that they're being cut out of this process they're entitled to be part of. tod the cutout is designed in be part of. a order to take away the a.c.a. and your health care in the midst of a pandemic. >> reporter: republican leaders say they intend to move forward with confirmation hearings now scheduled for mid october. >> we'll start on october 12th and more than half of the supreme court justices who have had hearings were done within 16 days or less. >> reporter: some democrats are threatening to boycott the process or not meet with barrett at all. >> we will use every tool in the tool kit to slow things down. >> reporter: cbs news learned white house counsel pat cipollone will work in close coordination with chief of staff mark meadows to oversee barrett's nomination.

meadows says they will deliver information to senators monday and could be on capitol hill as early as tuesday. jamie? >> yuccas: i know a lot of attention will be on the supreme court this week but all eyes will also be on the first general election debate this tuesday. nikole, in your mind how did the candidate strategies differ? >> reporter: well, president trump says he is preparing every day and this weekend he told reporters he is not sure if he will go on the attack. we know former vice president joe biden began his formal debate presentations late last week. this debate, however, will look a lot different because of the pandemic. the candidates won't shake hands and the audience will be limited to a small number of guests, jamie? >> yuccas: nikole, thank you. you can see the first presidential debate right here, cbs news coverage begins tuesday at 9 eastern, 8 central. the debate and fight over the supreme court are adding to the

already high stakes of the presidential election. new cbs news battleground tracker polling out today shows a close race in north carolina, which republicans have won the last two elections. in neighboring south carolina, the president maintains a double digit lead. georgia has gone republican in the last seven elections but this is 2020. cbs's mark strassmann is in atlanta. >> reporter: make georgia vote trump again. that's the president's struggle in a state reliably republican no more. this trump stump on friday pitched black voters. >> racial justice begins with joe biden's retirement from public life. what the hell do you have to lose? >> reporter: nothing, steven tucker says. >> democrats have never, ever done anything for us as a black people. >> reporter: some republican strategists admit to win on election night the president needs georgia to wear a maga hat. not this georgia tech student. >> biden at least appears to be making some effort to unite people. >> reporter: according to our cbs news battleground tracker, georgia is a tossup. president trump just one point

ahead. the big issues in a state with a roughly even split among voters in both parties: covid, the covid economy, the supreme court and a summer of unrest. >> we're not democrats that are burning down cities. >> reporter: for decades here, the late john lewis thundered about the importance of voting. turnout is critical for joe biden. on the front lines of atlanta suburbs and among the 30% of georgia's registered voters who are black. >> joe and kamala uniquely understand. >> reporter: this biden campaign ad targets black turnout but in this atlanta neighborhood, the motivation to get out the vote may be more about president trump. >> i have to vote for biden. just because we have to. >> reporter: why? >> to get trump out. >> reporter: they are only some what confident their votes will be counted properly, some republicans more than dems. a new lawsuit this weekend alleged security issues with

voting machine, the third party vendor is trying to fix it. in tossup georgia, this election is the most unsettled debate since sweet tea versus unsweet, in a state where a democrat for president last won in 1992. mark strassmann, cbs news, atlanta. >> yuccas: a new wildfire has erupted here in california in what is already the state's worst fire season ever. the glass fire has engulfed more than a thousand acres in the napa valley forcing thousands to evacuation. the brush fire that started early sunday fueled by hot dry air and high winds is 0% contained. protestors demanding justice and shouting breonna taylor's name remain on streets across america after a grand jury in louisville, kentucky decided not to charge officers in connection with her death. cbs' adriana diaz was there. >> reporter: never before seen body camera footage obtained by "vice news" appears to show the

officer involved in the shooting walking into taylor's apartment after the incident. according to vice, that is him asking about shell casings. >> there. > i back out until they get ci in here. >> reporter: that would be a violation of local police policy, which states that officers involved in police shootings are to be isolated from all nonessential individuals for the remainder of the initial investigation. the fact that body camera video exists at all is a surprise to angelo pinto, who is with the activist group until freedom which works with taylor's family. >> when you look at the actual bodycam footage it looks like, and i think it's clear in some instances that a lot of departmental policies are being violated. >> reporter: local officials have long said that no body camera footage existed of the raid itself but on wednesday kentucky attorney general daniel cameron said there is footage from patrol officers who responded after the raid. >> video footage begins at the point that area patrol officers arrive at the location. >> stay back or i will set this dog on you!

>> reporter: this video showing taylor's boyfriend's apprehension appears to be from an officer in the k9 unit. there was one k9 officer anthony james who was part of the raid and appeared to be wearing a body camera on his shoulder. police would not commented on whether this video is from james or if more video exists because an internal review is ongoing. one of the attorneys for the officer who was shot says thee new videos don't substantially change anything. he says the officers still acted in legal self-defense. as for former officer brett hankison, he is expected to be arraigned tomorrow. jamie? >> yuccas: we'll be watching that. adriana, thank you. there is troubling news about the pandemic. over the past week the united states averaged about 43,000 cases per day. that is up 24% from the average two weeks ago. so far more than 7 million americans are known to have been infected. the death toll now tops 204,000. cbs's lilia luciano has more.

>> reporter: tailgating in full swing in south carolina this weekend with little social distancing. the fun going on in new york city where police are cracking down on karaoke clubs, bars and crowded parties. >> it's america, we should be able to do what we want. >> reporter: authorities even breaking up a wedding reception in queens where nearly 300 people packed into a hall. >> every day they're partying up here, every day. >> reporter: tonight new york and new jersey face growing clusters of the virus. new restrictions could follow. new trouble in the heartland too. the number of daily cases is spiking in almost every mid western state. the c.d.c. warns that 90% of americans are still susceptible to the virus. former f.d.a. commissioner scott gottlieb says the u.s. has already seeing an upsurge. >> we were always facing heightened risk of increased coronavirus as we headed into the fall and winter. now we're there. >> reporter: but in southern california, one bit of good news. the spread of the virus slowing down in los angeles and orange county.

>> they wish corona would be over and they would go back to school. >> reporter: are you feeling safe? >> yes, i'm feeling very safe. >> it is normalizing, you know what i mean, it feels good, it good to feel that because i feel like we are isolated from everything before. >> reporter: orange county is moving closer to more reopenings. and could be in california's less restrictive orange tier as early as tuesday but that doesn't apply to theme parks or to stadiums. jamie. >> yuccas: lilia, thank you. nearly one million lives have been lost to the coronavirus around the world as hot spots keep emerging. cbs news senior foreign correspondent elizabeth palmer has the latest. >> reporter: in rio de janeiro the body of 78 year old selma pedrito is laid to rest. in a specially built concrete crypt for covid victims. brazil has the highest coronavirus death rate in the world after the u.s. it is at the center of a wave of infections galloping across south and central america and

mexico which has killed well over 100,000 people. while here in europe, we appear to be at the very beginning of a devastating second wave. at an online only u.n. general assembly prime minister boris johnson said countries had to be honest about how the virus started and how it spread. >> i simply believe as a former covid patient that we all have a right to know. so that we can collectively do our best to prevent a recurrence. >> reporter: but first he's got a serious recurrence in the u.k. to deal with including outbreaks among students back at university and now under lockdown. >> we barely got any milk and bread to last us until monday. >> reporter: in london the infection rate is climbing too and protests against covid control measures have become regular events. you have to look to wuhan, china, where the pandemic started, to see life nearly back to normal.
