reporting from the nation's capital, i'm catherine her raj. ♪ it's tuesday, october 6th, 2020. this is the "cbs morning news." back at the white house. president trump takes off his mask despite his could he videe covid-19 infection. his message as the outbreak grows in the west wing. breaking overnight, a texas police officer is charged with murder after shooting a black man who witnesses say was trying to break up a fight. fda overruled. why the white house is blocking new safety guidelines for a coronavirus vaccine.

good morning. good to be with you. i'm anne-marie green. this morning president trump is back at the white house after being hospitalized for the coronavirus. after arriving back at the white house yesterday, the president stood on the balcony and removed his mask in a dramatic gesture. he then released a video on social media youb playing his covid diagnosis. still, his own doctors warned he is not out of the woods yet so naomi ruchim is in washington. naomi, what is the president's latest message to the american people when it comes to the coronavirus? >> reporter: anne-marie, clearly the president is trying to portray an image of health and strength telling the american people he beat the virus in a couple of days. he is telling americans not to be afraid of covid-19 and not to let it dominate their lives. still, doctors say he has a lot of room left in his recovery and this comes as many close to the president are still sick with

covid-19. president trump walked out of walter reed medical center monday evening, three days after being hospitalized with the coronavirus. >> do you think you might be a super spreader, mr. president? >> reporter: the commander in chief took a helicopter back to the white house where he is receiving treatment. >> one thing is for certain, don't let it dominate you. don't be afraid of it. >> reporter: the president's message comes as 210,000 americans have died from covid-19 and more than a dozen people close to him have recently tested positive. the latest, white house press secretary kayleigh mcee na any. i stood out front. i led. >> reporter: his doctors say the condition has improved since the weekend but they acknowledge he's not out of the woods yet. >> if we can get through to monday with him improving, better yet.

then we will take a final sigh of relief. >> reporter: joe biden is not surprised he got the virus. >> anybody who contracts the virus by essentially saying masks don't matter, social distancing don't matter i think is responsible for what happens to them. >> reporter: tomorrow vice president mike pence and senator kamala harris face off in their only debate but plexiglass will divide the two candidates. >> reporter: meantime, the next presidential debate is set for october 15th, just about a week nava way. the president has said he does intend to debate but that will be left up to the doctors if he's allowed to do so. joe biden says he will debate the president as long as scientists say he is safe and as long as there is a safe distance between them. anne-marie? >> it should be a very busy month. we are exactly four weeks away from election day this morning. the clock is ticking on

republican senators' plan to get the supreme court nominee confirmed. so what's the latest on this outbreak possibly delaying that, the supreme court push? >> reporter: well, anne-marie, republicans say they are full steam ahead. they are planning to move on with hearings for judge amy coney barrett. those hearings would start next monday. if that happens, it doesn't necessarily mean things will be delayed because right now there are two members of the senate judiciary committee who are republicans who are out with covid-19. 24's concern there may be more, but they can miss the hearings as long as they're here for the vote. that's what matters in terms of getting her confirmed. democrats are still trying to push this back but if they can have enough republicans to approve the nomination, she will be approved. anne-marie? >> naomi ruchim in washington.

thank you so much, naomi. so you saw the presidential candidate joe biden in the story. he hits the campaign trail today. biden is leading trump 51% to 44%. last night biden took part in an nbc news town hall event in miami. when asked about the president taking off his mask after he was discharged from the hospital, biden had this to say. >> i would hope the president having gone through what he went through, and i'm glad he seems to be coming along pretty well, would communicate the right lesson to the american people. masks matter. these masks, they matter. it matters. it saves lives, it presents the spread of the disease. social distancing. >> biden said wearing the mask is a patriotic responsibility. kayleigh mcaenany is the latest to test positive. she will begin

self-quaranti self-quarantine. she said she previously tested negative and she spoke with reporters without a mask as treatmently as sunday night. new coronavirus precautions will be in place at tomorrow night's vice presidential debate. senator kamala harris and vice president mike pence will be separated by a plexiglass barrier when they take the stage at the university of utah. the request was made by the biden/harris campaign. the pence campaign had opposed the barrier. they will be seated and will be 12 feet 3 inches apart. breaking overnight in texas. an officer was charged with the murder of a man. the texas rangers arrested shawn lukas who's a police officer in wolfe city. he posted a $1 million bond

within hours of his arrest. authorities say lukas shot and killed 31-year-old jonathan price on saturday. witnesses told authorities price tried to protect a woman in an alleged domestic violence incident. in a statement the texas rangers says price was involved in a disturbance and resisted when the officer tried to detain him. he started to walk away and that's when lukas used a taser and shot him. lukas's actions were deemed not objectionable. price is considered a hero and his family is getting help from a former baseball player. >> i loved my son and i tried to bring him up to do the right thing. >> reporter: the family of jonathan price was overcome with emotion as they gathered feet away from where they say he was gunned down by police. >> i came up here and seen my son laying there fighting for his life. >> reporter: price's family

claims he was breaking up a domestic dispute between a man and woman outside this convenience store in wolfe city near dallas when authorities according to witnesses, the responding officer tased then shot twice killing him. >> i said, who shot jonathan? he said, i did. i said, what did you shoot him for? he said, get back. >> reporter: price is being described as a pillar of the community. >> jonathan was a mentor, broth brother, son, a beloved hero of this community. >> reporter: former red sox player and cbs hq analyst will middlebrooks has organized a go fund me page to cover funeral expenses. chris martinez, cbs morning news. back to the coronavirus. the white house has blocked

"the new york times" reports just days after reopening, some new york city schools are being closed after coronavirus outbreaks. governor andrew cuomo approved a request from mayor bill de blasio to reinstate restrictions on public and private schools in nine city zip codes where cases are spiking. about 300 schools, including religious schools, are being closed starting today. the restricted areas have large orthodox jewish communities that appear not to be following guidelines. the san francisco chronical said california governor gavin

on capitol hill were making progress on a new stimulus package. the dow jumped 465 points. the nasdaq rallied 267 and the s&p 500 added 60. the heads of three major tech companies will appear before capitol hill this month. facebook's mark zuckerberg and jack dorsey will testify before congress. the trio will be grilled over hate speech and misinformation on their platforms. venmo is out with a new credit card. the mobile payment network says there's no annual payment fee and customers can earn rewards with up to 3% back. they can manage the card with yap. for instance, consumers can use their venmo balance to pay off any charges. the card will be offered to eligible app users over the next

lukas's decision to use deadly force is under investigation. the second largest movie chain in the u.s. is closing its doors again. the parent company to regal cinemas says it can no longer weather the financial strain of the pandemic. elise preston reports. >> reporter: james bond won't be on the big screen this fall. producers pushed the release of "no time to die" from november 2020 to april 2021. the move is forcing the second largest theater chain in the u.s. to go dark. cineworld announced it will temporarily close its 536 u.s. regal cinemas on thursday. >> we are bleeding much bigger amounts when we are open than when we are closed. we'll be like a grocery shop with no food. >> reporter: most movie theaters around the country re-opened in august promising a safe experience for customers.
