why would they leave? an that's the it is thursday, november 5, 2020. this is cbs this morning news. america waits. the presidency awaits in the balance. the vote counting continues. the race to 270 tightens. breaking down the results and the legal challenges. good morning and good to be with you. i'm anne-marie green. we begin with the still undecided presidential election. vote counting stretches into another day. former vice president joe biden is closing in on 270 but president trump is mounting legal challenges in a handful of battleground states that will help decide the winner frmt

here is where we stand right now. right now, biden has 253 electoral votes. that is 17 shy. president trump has 213. overnight, arizona released a new account that president trump is trailing by 69,000 votes but there are still 430,000 votes that need to be counted in that state. nevada is too close to call. ballot counting will continue in the morning. north carolina remains the toss up. president trump has the lead. also in georgia, it is a toss-up, this one is razor thing with the president ahead by about 23,000 votes. and in pennsylvania, trump is up by less than two percentage points. they are calling biden the

winner in michigan and presumptive winner in wisconsin. this race is far from over. >> that's right. many of these states still have ballots coming in that were postmarked on or before the election day still in the mail stream and still need to be counted. that with president trump's potential lawsuits mean the final decision and final numbers could be days away. >> supporters of president trump outside. we are not trying to break in, we just want to see you count the ballots. >> the president trails but there are still votes to be counted. >> in detroit, trump supporters demanded michigan officials stop

counting. >> it is said biden legally won the state. >> we are here to defend the right to vote. >> activists marched through the streets. >> it is our right to vote. all the votes must be counted for. >> the trump campaign is launching legal challenges. the president holds slim leads in pennsylvania and georgia. but the remaining ballots cast on or before election day come from democratic leaning areas. >> in pennsylvania, every vote is going to count. >> cbs projects joe biden is the presumptive winner in wisconsin but that lead is small enough trump is asking for a recount. >> the former vice president looked past the election. it will be time for us to do what we've always done as americans, to unite, to heal, to come together as a nation.

>> nevada is also leaning towards biden. with electoral votes from those two states, he would be right at the 270 to win. president trump leading in alaska and north carolina. more results expected from all of these places. >> it is a nail biter. as it were mentioned, the trump campaign plans to ask for a recount in wisconsin. a state cbs news says biden is the presumptive winner. biden has 49.4%. trump has 48.8%. 9 # 9% of the votes have been tallied. in wisconsin, they can request a recount if they are within the 1% margin and after the votes have been certified.

ahead, scott walker joins us to talk about president trump's chances of winning that state. supporters of president trump continued protesting at an election center in phoenix. more than 200 people gathered frmt this was the scene last night outside of the recorder's office where people inside the building are working to verify ballots. a group of arizona patriots entered the building wearing a military vest. saying the county used sharpie pens to invalidate ballots. saying it is not true and they do not disqualify ballots. some key congress regional races are in the balance this morning. a look at how many seats as they wait for results. either side needs 51 seats for the majority. on capitol hill with more on that. >> the ballots continue to be

counted across several key states with neither party coming away with the majority of u.s. senate so far. the top republican held on to his senate seat as did south carolina's lindsay graham. >> while this election may be over but we have to work together. in nain, maine democratic su seeded to republican. former auburn university football coach is projected to flip alabama's senate seat. foreigner colorado governor will unseat republican gardener. >> let's get to work, arizona. democrats are also keeping a watchful eye on arizona's race where the gop leads martha mcsally. >> democrats came up short in their push to flip seats in

♪ the coronavirus was a top concern for voters. this morning, we learn more than 102,000 cases were reported. is that is the first time we have topped the 100,000 mark in a single day. the number of deaths almost hit 1,100 as well. numbers as well and cases going up in 44 states. a man who died from covid actually won his election. in oregon, the first state to decriminalize possession of hard drugs.

those are some of the headlines on the morning news stand. reporting north dakota's state attorney general can't fill a dead candidate's seat. he died last month and was elected to the state house on tuesday. the governor announced he was appointing an energy company president to the seat. saying the appointment is inaccurate and untimely. oregon, the first state in the nation to decriminalize the possession of heroin and other street drugs. measure 110 passed overwhelmingly on tuesday. people with small amounts of hard drugs like heroin, cocaine, methamphetamine, lsd and oxy co-don't have the option of paying a $100 fine or attending rehabilitation services. >> it is time for a better

tropical depression eta is soaking central america. with torrential rain and damaging winds. eta is the 28th named storm of the season. expected to intensify over the warm caribbean waters. and possibly move towards southern florida. the storm could bring heavy rains, gusty winds and high surf. on the cbs money watch, coronavirus relief aid could come sooner than expected. that is a relief to hear. and a popular advent calendar is back. diane king hall is in new york with more. >> stock futures are trending higher when investors went on a buying binge. on wednesday, the dow jumped

367, nasdaq rallied 430 and s&p gained 74. a new round of stimulus funds could come by the end of the year. mcconnell is calling for lawmakers to strike a deal as they return to work next week. that's a shift leg a lags is more likely for next year. talks have stalled offer the summer time. pelosi and mnuchin insist they've made progress in recent months. drivers with uber and lyft remain as independent contractors in california. voters decided drivers are exempt. the measure entitled drivers to medical coverage and car insurance. both warned ahead of time that any rise in cost would be passed on to customers. aldi is selling their new

more results were released more results were released overnight in the race in arizona. president trump gained about 7,000 votes. he trails by just over 68,000. there are still 430,000 votes to be counted in that state. nevada remains close. joe biden is up roughly 8,000 votes. election officials there are set to speak on the ballot counting process. with the out come still in the balance, the trump campaign has filed lawsuits in pennsylvania, north carolina and georgia. right now, biden is 17 electoral

votes shy of the 270 needed to win. >> voters in 32 states weighed in on 132 ballot measures from issues on the minimum wage and illegal drugs. >> expect more marijuana dispensaries to turn up. voters voted to approve for adults 21 and over. medical american -- medical marijuana won approval in mississippi. >> might help the economy. >> on tuesday, oregon became the first state the decriminalize small amounts of drugs. and made it legal for people in therapy sessions to use the drug in mushrooms.
