reporting from the nation's capital, i'm jeff pegues. it's tuesday, november 10th, 2020. this is the "cbs morning news." transition trouble. president-elect joe biden is hitting roadblocks days after he declared victory in the election. why the formal process can't even begin yet. 10 million cases. the coronavirus virus is surging across the u.s., but there could be some hope with an experimental vaccine. the lost children. a new twist after the government says it cannot find the parents of hundreds of migrant kids. good morning. good to be with you. i'm anne-marie green.

well, we begin with a holdup in the traditionally smooth transition of power after joe biden declared victory in the presidential election. biden's team is threatening legal action against the federal agency overseeing the transition process. it accuses a top administrator of not freeingng up money and access to agencies. meantime, president trump has yet to concede over unproven allegations of voter fraud. deborah alfarone is in washington. why aren't administration officials cooperating? >> reporter: well, anne-marie, the person who oversees that federal agency you were talking about, her name is emily murphy, and she was appointed by president trump. the president hasn't conceded. he's continuing to vow that he's going to have his legal fight, right? so this really is unprecedented that murphy wouldn't sign the paperwork that would essentially start the transition process, but as you know, 2020,

unprecedented here. president-elect joe biden urged americans to come together to fight the coronavirus. >> we can save tens of thousands of lives if everyone would just wear a mask in the next few months. not democrat or republican lives, american lives. >> reporter: some health experts estimate 100,000 people could die by the time mr. biden takes office. >> maybe it saves the lives of one of your children's teachers. maybe it saves your life. >> reporter: around the country the number of cases and hospitalizations are hitting new highs. >> these rates are growth are truly chilling. >> it is no longer a drift. our cases are surging up. >> reporter: dr. ashish zha says even with promising news on the vaccine front, that doesn't mean the pandemic is over. >> the vaccine won't be available to a majority of american people until late in the spring. >> reporter: here in washington president trump is refusing to concede and is instead continuing to fight the election results with unfounded claims of

voter fraud. >> this election is not over. far from it. >> reporter: attorney general william barr is urging federal prosecutors to pursue substantial allegations of voter fraud even though there's been no evidence of it. in georgia, election officials pushed back against republican allegations they haven't been transparent. >> what i don't like is people out there trying to undermine the system. >> judges in michigan, georgia, nevada have already rejected lautsds backed by the campaign saying they presented no serious evidence. going back to the transition though, this delay also means that president-elect joe biden is not going to be able to get up to speed on operation warp speed which is that complex plan by the pentagon to get coronavirus vaccines out to the people. that's another issue we're looking at this morning, anne-marie. >> deborah alfarone, thank you so much, deborah. so vice president mike pence

is weighing in on the election for the very first time since joe biden declared victory. pence tweeted yesterday, it ain't over till it's over and this ain't over. president trump has never stopped fighting for us and we're going to keep fighting until every legal vote is counted. for the sixth day in a row now the number of coronavirus cases in the u.s. has topped 100,000. more than 111,000 cases were reported just yesterday. that's according to johns hopkins university. the nation has seen 1 million cases in just the past ten days, but as nancy chen reports, the drug company foopfizer is offer some hope saying its experimental vaccine works. >> reporter: pfizer says its experimental vaccine is more than 90% effective and it will submit an emergency use authorization with the fda once the trial is complete in two weeks. >> we have been working

basically around the clock for eight months. this is one of the biggest if not the biggest medical advance in the last 100 years. >> reporter: pfizer says it has 50 million doses ready to go. about half will go to americans. and the drug company says it will be able to manufacture at least $1.3 billion doses next year. coronavirus cases are now rising in 26 states. 41 states seeing a rise in hospitalizations. in texas, the city of el paso has brought in ten mobile morgues. they called up the national guard to help expand testing. inside many nebraska businesses masks are required. in awe tau there's a new statewide mandate. >> you may not host casual gatherings with unless they're in your immediate household. >> arkansas, alaska, new mexico and colorado hit daily records.

that prompted denver's mayor to have a 10 p.m. curfew. >> reporter: this weekend tens of thousands participated in mass gatherings, including here in times square, to both protest and celebrate the presidential election results. health experts fear they were possible super spreader events. >> any time you put that many people in close proximity, you do run the risk of that transmission. >> reporter: the notre dame students who rushed the football field saturday are now required to get a covid test before they leave for winter break. university officials say students who don't get a test won't be allowed to register for classes next semester. nancy chen, cbs news, new york. the number of migrant children separated from their parents is reportedly higher than previous figures. nbc news obtained an email to the justice department stating 666 kids have not been found. last month lawyers who represent

the children said the parents of 545 kids were lost. the higher number reportedly includes children for whom the government did not initially provide contact information for. homeland security and defense department officials did not immediately respond to a request for comment. and the supreme court is set to hear arguments on obamacare today. the case was brought by republican officials backed by the trump administration. they're urging the justices to declare the law's mandate to buy insurance unconstitutional because congress has repeatedly repealed because of noncompliance. coming up on the "cbs morning news," two republican senators from georgia are calling for a republican election official to resign and high speed ride. a hyper loop system completes a successful test with humans. this is the "cbs morning news." this is the "cbs morning news."

the walt disney company says it is furloughing more workers at its california theme parks, including disneyland. the company says it does not know when the state will allow disneyland to reopen. because of the pandemic, disney did not say how many workers will be furloughed, but it will include executive, salaried and hourly workers. it comes on top of the 20,000 employees who were laid off in september at disneyland and florida's walt disney world. a black woman has made history at the u.s. naval academy, and there are accusations of election failures in georgia. those are some of the headlines on the morning newstand. the atlanta journal constitution reports georgia's two republican senators are calling for the resignation of the state's top election official. senators kelly loeffler and david perdue accused republican

secretary of state brad raffensperger of unspecified failures in last week's elections. they provided no evidence to back up their claims. joe biden holds a small lead of 12,000 votes in the state. loeffler and purdue face runoff elections in january that will determine which party controls the u.s. senate. raffensperger says he's not stepping down. the miami herald said tropical storm eta caused heavy flooding in the city and throughout south florida. the storm made landfall sunday night in the florida keys. entire neighborhoods were hit with fast-rising water that did not drain for hours. it left cars stranded and damaged homes and businesses. >> the street does this a lot. it's crazy people try to drive through it. i've seen two people stuck already and i just got here. >> no, no damage at all. >> just a lot of flood water? >> a lot of flood water. you can see all these cars trying to cross intersections and just getting wrecked.

♪ ♪ things will be a little different for people celebrating the new year in australia. the traditional midnight fireworks show over city harbor will go on as planned, but the 12 minute display will be shortened to just a few minutes. prime harbor site spots where thousands of revelers typically gather will be set aside for front line workers. boeing 737 max could be back in the air and mcdonald's is offering a meatless option. diane king hall has those stories and more. >> reporter: wall street rallied on optimism over progress with a covid-19 vaccine. shares of pfizer climbed more than 7%. ultimately the dow soared from 834 points surging to the highest level after hitting an interday record. they did lose ground dropping

181 points. the s&p 500 added 41. shares of zoom tumbled 17% after that promising news of major progress with the coronavirus vaccine. the video conference company has exploded in popularity since many people across the country started working from home when the pandemic hit in march. a vaccine could mean more people would head back into the office in the coming months. meanwhile, the faa is reportedly set to lift grounding orders on boeing 737 max fleet in eight days. according to reuters, the agency is in the final stages of reviewing proposed changes to the aircraft and will complete the process in the coming days. the 737 was grounded globally in march of 2019 after two deadly crashes that killed 346 people. the action could be part of boeing's path to recovery after the aerospace company skidded into its worst financial crisis ever. and mcdonald's is shaking up its menu adding plant-based

inspiration for his constant desire to learn, his kindness and for his love of his family. on behalf of everyone here at "jeopardy," thank you for everything, alex. this is "jeopardy." >> and that was followed by a moment of silence with the lights on the set dimmed. trebek died at the age of 80 after battling pancreatic cancer. hosted "jeopardy" for 37 years. he taped the last episodes less than two weeks ago. they will air through christmas. a delayed and very different masters tournament gets underway this week in augusta, georgia. some of golf's biggest stars including defending champion tiger woods played a practice round yesterday. the masters has been held in march or april since its inception in 1994 but it's been postponed due to the pandemic.
