president biden signed a last-minute deal to avoid a government shutdown, and this morning he is waiting to congress to act on his top domestic priorities. democrats delayed a vote last night on a $1 trillion infrastructure measure. that's because some progressives threatened to vote against it. they want a much larger package, the build-back-better plan passed, as well. so laura podesta has more from new york. laura, good morning. >> reporter: good morning. this boils down to cost. moderate democrats don't want to spend the amount of money that progressives say is desperately needed to fund the programs they promised constituents. this fight which is months' long now could come to a partial conclusion with a vote today. >> the motion is adopted -- >> the bill is passed. >> reporter: congress passed a continuing resolution yesterday to keep the federal government funded through december 3rd. >> the last thing the american people need is for the government to grind to a halt. >> reporter: meanwhile

negotiations are ongoing regarding president biden's legislative priorities. a $1 trillion infrastructure ill and $3.5 billion message that encompasses everything from climate to childcare. >> compromise is inevitable. right now we're in the thick of it. >> reporter: a planned vote on the infrastructure bill was postponed last night after progressive democrats refused to vote for it. >> there's no point in us negotiating against ourselves. >> reporter: those progressives want a concrete deal on the social spending package first. house speaker nancy pelosi told reporters after midnight she expects to try again today. moderate democrats like senator joe manchin have held up the social spending package in part because of the cost. he's been pushing to bring it down to $1.5 trillion. >> let's look at each bill that's on there. a lot of good in both of them. >> reporter: also facing washington, congress needs to raise the debt ceiling by october 18th. >> it's necessary to avert a catastrophic event for our

economy. >> reporter: democrats are working to raise it on their own after republicans blocked multiple attempts this week. and just for some perspective here, the debt ceiling has been raised dozens of times over the last 60 years including multiple times by republican congresses during the trump administration. >> yeah, a good reminder. laura podesta in new york. thank you, laura. so today a federal judge will hear arguments over whether texas can leave in place its new abortion ban. the texas law is the strictest in the nation, and it bans abortions after six weeks once cardiac activity is detected. the biden administration called the law unconstitutional and sued texas last month. it's unclear when the judge will make a decision. and today is the four-year anniversary of the las vegas music festival shooting. the deadliest mass shooting in modern u.s. history. 58 people were killed. public events will be held in las ves toemr the

responders. in 2017 stephen paddock opened fire from the 32nd floor of the mandalay bay resort on thousands of people attending the route 91 harvest festival. he killed himself before police reached him, and his motive remains unknown. officials say thousands of tourists are flocking to a hawaii volcano to watch it erupt. kilauea, one of the most active volcanos on earth, began erupting on hawaii's big island wednesday. it does not pose a threat since homes are not in the area. it says contained entirely within a national park which remains open. >> it's all confined for the present. seismic activity, tilt, et cetera, that's all showing that it's in the summit region. it hasn't gone elsewhere. >> the volcano has erupted 34 times since 1952. tourists are encouraged to stay on marked trails and overlooks only. for the first time ever a drone was sent into the eye of a

category-four hurricane. this is newly released footage inside hurricane sam. scientists say it captured winds reaching 142 miles per hour and waves of up to 50 feet. they're hoping to better understand hurricanes. meteorologists say sam could remain a major hurrica i the weekend as it passes a couple of hundred miles east of bermuda. there was also a storm on capitol hill related to facebook. a top executive faced tough questions over a report that found that instagram could be toxic for teenagers. carter evans has more. instagram is that first childhood cigarette. >> facebook is in the process of hiding. >> reporter: in a show of bipartisanship, lawmakers hammered facebook using the company's own data against it. leaked research indicated about a third of teen girls who already feel bad about their bodies say facebook's instagram makes them feel even worse.

>> this research is a bombshell. i ask you to commit that you will make full disclosure all of the thousands of pages of documents -- >> we are looking for ways to release more research. >> reporter: facebook's global head of security, antigony davis, said roughly 40% lead to ideas of a perfect image, feeling attractive and having enough money started on instagram. she says lawmakers are focusing on the wrong information. >> we found that more teen girls find instagram helpful than not. >> reporter: senator richard blumenthal said his office set up an instagram account for a fake 13-year-old girl. >> within a day its recommendations were exclusively filled with accounts that promote self-injury and eating disorders. >> it can make me feel insecure and not confident in my own body. >> reporter: 17-year-old

destinee ramos joined instagram when she was in eighth grade. could you stop it if you wanted to? >> i think i could, but i think i would not like it at all. >> reporter: next week a facebook whistleblower is expected to testify, and it could expose more about what they knew when they knew it and what they did about it. earlier this week, the company announced that it's pausing development on a new instagram app designed specifically for kids 10 to 12 years old. carter evans, cbs news, los angeles. prime beachfront property in southern california has been returned to the heirs of a black couple. governor gavin newsom signed a bill giving the land back to the descendants of willa and charles bruce. the beach in manhattan beach was taken from them nearly a century ago. >> as governor of california, let me do what apparently manhattan beach is unwilling to do. and i want to apologize to the bruce family for the injustice.

"the des moines register" reports remains were discovered that match the description of an iowa boy who disappeared in may. investigators say a farmer working in a cornfield found the remains yesterday a few miles from montezuma where 10-year-old xavior harrelson vanished. he was reported missing from the trailer park where he lived days before his 11th birthday. >> we are not saying that it is xavior harrelson at this time. there's a lot of work yet to be done at the scene here. then as you can imagine, the state medical examiner's office and state anthropologist has a lot of work left ahead of them in the days and weeks even to come. >> authorities say the boy was last seen riding his bike. "the washington post" says california senator dianne feinstein introduced a bill that

would require passengers to be vaccinated or test negative for covid in order to take a domestic flight. feinstein said that the country cannot allow upcoming holiday travel to continue to another surge in cases. the bill would also allow people who have recovered from the coronavirus to travel on domestic flights. airline leaders have said that the vaccine mandate would be logistically impractical. and "the cincinnati enquirer" says the bangles rallied past the jaguars on thursday night football. rookie evan mcpherson kicked the 35-yard field goal to lift them to the victory. the bengals moved to 3-1 in the season. they overcame the 14-1 halftime deficit last night. the jaguars have not won a game yet this year. still ahead, get your napkins ready, an iconic mcdonald's sandwich is returning to the menu for a limited time. we'll tell you when.

for more developments on monetary and fiscal policy set to emerge in october. yesterday the dow skidded some 546 points. the nasdaq dropped 63, and the s&p 500 fell 51, ending a seven-month winning streak in september. snail mail is set to get even slower under a new u.s. postal service plan aimed at cutting costs which takes effect today. the service's three-day delivery standard for first-class mail for things like letters, bills, and tax documents, will likely move up to five days. the change will impact about 40% of first-class mail. and on october 3rd, the postal service will again temporarily hike prices for some package shipments for this year's peak holiday season. mcrib fans, your wish is mcdonalds' command. the fast food giant says the beloved sandwich is returning next month. nearly a month earlier than last year. the mcrib which features seasoned boneless pork, barbecue sauce, onions and pickles on a

actress scarlett johansson and the walt disney company have settled a lawsuit. she sued disney claiming the release of "black widow" in theaters and on the disney-plus streaming service breached her contract and deprived her of potential box office earnings. the lawsuit said that her contract guaranteed an exclusive release in theaters. terms of the settlement were not disclosed. another streaming service, netflix, is releasing a musical about princess diana today before it hits the broadway stage. ♪ ♪ yet feeling rather small ♪ >> "diana the musical" was filmed without an audience over four days during the pandemic. it tells the story of her
