hospital this morning from an infection. the 75-year-old was admitted to uc irvine medical center tuesday. a spokesman says he's on the mend. he has badminiered iv anbioticd . the infection is non-covid related. sources tell cbs news that he's up and about and joking with hospital staff. in a statement, physicians for the former president said after two days of treatment, his white blood cell count is trending down, and he is responding to antibiotics well. we hope to have him go home soon. since leaving the white house in 2001, mr. clinton has faced some health scares. in 2010 he had a pair of stents implanted in a coronary artery. in 2005 he underwent surgery for a partially collapsed lung. and one year before that he had a quadruple bypass surgery after suffering chest pains and sortness of breath. also breaking overnight, a federal appeals court says that a strict abortion law in texas

can stay in place for now. earlier this month a u.s. district court blocked the ban. but after the justice department challenged it, last night's ruling is expected to be appealed to the supreme court. the law which went into effect last month does not allow abortions after detection of cardiac activity which is usually around six weeks. and this morning there are major developments when it comes to covid vaccine booster shots. an fda advisory panel voted unanimously to endorse moderna's third dose. and today the same committee will look at a possible second shot for people who got the johnson & johnson vaccine. laura podesta has more on that from new york. laura, good morning. >> reporter: hey, good morning, anne-marie. these boosters are not being recommended for everyone, just the elderly and adults who are high risk or work certain jobs. the panel has been discussing at what point should the boosters to decide.o all adults ove n

an advisory panel to the food and drug administration will today consider whether a booster shot of johnson & johnson is needed for those who received the single-dose vaccine. yesterday that same panel backed the moderna booster for high risk and older adults. >> we do have a unanimous 19 out of 19 yes votes. >> reporter: the next step for moderna, an fda authorization which would be followed by a cdc vote. if all goes smoothly, the shots could start being given out as early as a week from today. the new guidance also includes younger adults with health issues and workers who face a higher covid-19 risk. >> one thing that i think would be importatant is really if we e going to be making boosters available is to increase efforts to get specific communities at risk. >> reporter: the pfizer and moderna boosters are given at least six months after the second shot. unlike pfizer, moderna's booster would be a lower dose, half the original. but challenges remain cocing pe to even t

thr first shot. >> let's be clear, vaccination requirements should not be looking at mixing and matching boosters from different vaccine manufacturers. and later this month, it will consider whether to authorize shots for children younger than 12. anne-marie? >> laura podesta in new york. laura, thank you very much. well, a new york judge has ordered former president donald trump to give a videotaped deposition on monday. this stems from a lawsuit filed by protesters who claim that they were roughed up by security outside trump tower back in 2015. mr. trump is expected to record the deposition at trump tower. his testimony will be played for a jury if the case proceeds to trial. meantime, one of mr. trump's closest allies could face criminal contempt charges. steve bannon defied a subpoena

in the january 6th capitol riot the house committee looking into the attack will vote next week on whether to recommend the charges. nikole killion reports. >> reporter: former white house chief strategist steve bannon was a no show to on capitol hill, skipping his scheduled deposition before the house select committee investigating the january 6th attack. >> as much as they hate trump, as much as they hate me, as much as they hate all these other folks, they fear you. >> reporter: just a day earlier, bannon addressed this virginia rally. >> i pledge allegiance to the flag -- >> reporter: where supporters pledged allegiance to a flag that was allegedly carried during the riot. bannon was urged not to cooperate by forormer president trump and in a letter obtained by cbs news, bannon's attorney said "until the committee reaches an agreement with the former president over the scope of executive privilege, mr. bannon will not be producing documents or testifying." >> it's more of the same that we saw during the last four years. so when the former president played rope-a-dope in the

courts. >> reporter: congressman adam schiff sits on the panel which plans to refer bannon for criminal contempt. he said anyone else who defies subpoenas could face similar consequences. what types of penalties do you want these individuals to face? >> whatever penalties are necessary to ensure compliance. >> reporter: does that mja >> depends on the person, but it could mean jail time, yes. >> reporter: bannon was in close contact with the former president in the days leading up to january 6th, warning all hell would break loose. mr. trump said in a statement "the january 6th unselect committee should hold themselves in criminal contempt." the select committee will vote next week to move forward with holding mr. bannon in criminal contempt. but the full proceedings could drag on for a while. cbs news has learned the depositions for three other top trump aides has been postponed. nikole killion, cbs news, capitol hill. well, it's official -- u.s. won't face an economic disaster,

shooting and killing susan pros berman to prevent her from incriminating him in the disappearance of his wife in new york in 1982. art by banksy breaks a record at auction, and there's a new estimate in the california oil spill. those are some of the headlines on the "morning newsstand." california's "orange county register" reports the oil spill two weeks ago off huntington beach was likely around 25,000 gallons. that's according to the coast guard. that is much less than what officials initially feared. the leak occurred in a pipeline owned by houston-based amplify energy. officials say the cause of the leak is under investigation, but the pipeline was likely damaged by a ship's anchor months before it ruptured. "the detroit news" says michigan officials vow to replace lead pipes in the city of benton harbor within 18 months. high levels of lead have been found in the predominantly black

and low-income community's tap water. it comes seven years after the crisis in flint. yesterday governor whitmer ordered a whole of government response to the situation in benton harbor. the lieutenant governor said that the state will find the millions of dollars needed to fix things. >> every community deserves lead-free pipes. so we are committed to doing everything that we can to ensure that every parent in benton harbor can give their child a glass of water with confidence. >> residents are being urged to use only bottled water for cooking and drinking. and the "associated press" says a work by british street artist banksy that self-shredded three years ago sold at auction for more than $25 million. that's a record price for banksy. the piece called "love is in the bin" was sold yesterday at sotheby's in london. it was purchased by an undisclosed buyer.

week on the campus of unc-chapel hill. the chancellor says the university, like so many others, is in the midst of a mental health crisis. several unc students have recently taken their lives or tried to. manuel bojorquez reports from the campus. >> reporter: parents gathered on the campus of unc-chapel hill to offer hugs, treats, and messages of support. >> i want to be with those students and tell them, hey, it really, really, really will get better. i promise. >> reporter: it's the latest effort to increase mental health awareness after two students died by suicide and two others attempted suicide in recent weeks. the university's chancellor canceled classes tuesday so students could observe a wellness day, saying in part, "we are in the middle of a mental health crisis, both on our campus and across our nation." seniors sonah shah and clare landis are part of a campus counseling group called peer to peer. >> i think the past 18 months we've had covid on top of everything else, college is a

super-hard time, socially, academically, financially for a lot of people. >> reporter: suicide is the second leading cause of death among the college-age population. and from 2019 to 2020 one report found nearly 37% of college and university students who had received mental health services had seriously considered suicide. >> this is a major societal issue. it's a mental health tsunami, and this is our kids. >> reporter: dr. samantha meltzer brody chairs the university's psychiatry department. >> mental health's been stigmatized for so long. people suffered in silence. students are talking about this here, there, and everywhere loudly and supporting each other. that we need to do right by them and respond to what they're saying. >> reporter: the student counselors say they have noticed an uptick in the number of people reaching out to talk in the last few days. the university plans to host a summit to discuss ways to keep the conversation going beyond just this week. manuel bojorquez, cbs news, chapel hill, north carolina.
