to uphold mississippi's ban on abortion after 15 weeks. chief justice john roberts suggested the court wouldn't have to overturn roe. >> if you think the issue is one of choice, that women should have a choice to terminate their pregnancy, why is 15 weeks an inappropriate line? >> reporter: that would be a major retreat from the last abortion case when the court drew the line at viability around 24 weeks. mississippi's only abortion clinic at the center of the fight performs abortions up to 16 weeks. >> that is the question, where does the line get drawn. it is them chipping away. >> reporter: a lawyer from mississippi said the issue should be up to the states. that struck a cord with justice kavanaugh. >> why should this court be the

house for one night. for more news download the cbs news app on your cell phone. i am tom hanson. cbs news, new york. this is the cbs overnight news. good evening and thank you for joining us. i am margaret brennan in for norah. we begin with the first confirmed infection from the new covid variant omicron here in the united states. cbs news learned the u.s. is reviewing more potential cases in several states. the first case was detected in san francisco. that patient was fully vaccinated but not boosted and recently had travelled to south africa. hundreds of cases of the new variant have been confirmed in

more than 20 countries prompting the biden administration to require stricting tests requirements for all entering the united states, including americans. president biden implored americans to get that additional dose. 135 million americans are eligible for boosters. only about 42 million have gotten them so far. we lead off our coverage tonight from san francisco. good evening, anna. >> reporter: cbs news learned the first known u.s. omicron patient came through here, san francisco international airport. public health officials are crediting the state's large scale testing program for finding that case and now that testing will be stepped up at airports. the patient was someone 18-49 who developed mild symptoms on thanksgiving day and tested positive four days later. the sample was sequenced

overnight at a university of california san francisco lab and confirmed to contain the omicron variant. >> they had received a full dose of the moderna vaccine but no booster. >> reporter: five days after the world health organization declared omicron a variant of concern, little is known. officials say it may be more contagious than any other variant discovered so far. today at the house dr. anthony fauci said that it will be weeks before researchers determine how severe omicron really is. but current vaccines he says probably offer at least some protection. >> we know what we need to do to protect people. get vaccinated. get boosted. >> reporter: hospitalizations and deaths were predicted to increase after a recent surge in cases before omicron was detected. the delta variant still accounts for more than 99% of cases worldwide. now labs across the country are

sequencing approximately 80,000 pcr tests per week to see where omicron might show up. >> reporter: how long did it take for delta to become the majority of cases in new york city? >> probably six to eight weeks. >> reporter: once you detect omicron after one and a half to two months it could be the majority of everything? >> it could be. >> reporter: international travellers now must test negative within 72 hours. but the white house is expected to tighten the rules so that everyone coming to the u.s. must test negative within a day of boarding, regardless of whether they are vaccinated. the cdc announced yesterday it was expanding surveillance at four of the nation's busiest airports including here at san

>> reporter: she apologized on twitter but after a contentious call with omar has gone back on the offensive. now it is a twitter feud that appears more like a food fight. we turn now to the deadly school shooting in oxford, michigan. a fourth student died today from his injuries. he was just 17. the accused gunman, a 15-year-old sophomore is being tried as an adult. we learned hours before the attack his parents had a school meeting regarding troubling behavior. >> anything you say can and will be used against you in a court of law. do you understand that right sir? >> yes, i do. >> reporter: the 15-year-old ethan crumbley sat motionless as he was arraigned on terrorism and first degree murder. >> there are facts leading up to

the shooting suggesting it was not just an isi act. investigats saymore me out of a restroom at oxford high school and fired at least 30 rounds from a semi automatic handgun. hours earlier crumbley and his parents met with school officials over behavior concerns. the teen made a video the night before the shooting talking about killing students at the school. cell phone video shows terrified students barricaded behind a locked door before running to safety. four students, aged 14 to 17 were killed including justin shilling who died in the hospital this morning. >> reporter: the county prosecutor said more charges could be filed, including

tourism revenue has achieved. a few years back this community chose to get milking calves. now they are being given to new needy families. the colorful striped sweaters are a product of tourism revenue sharing too. one year they used funds to buy knitting machines. some of the porters and guides are porchers? >> yeah. >> reporter: has all poaching of gorillas stopped? >> in rwanda, yes. >> reporter: they can still get caught in snares set for smaller antelopes. they dispatch a small army of trackers every morning.
