the 83-year-old is the senior member of the supreme court's liberal wing. his departure gives president biden a chance to make his first nomination to the high court and an opportunity to make good on a campaign promise to appoint the first black female justice. debra alfarone is on capitol hill with more on this. good morning. >> reporter: good morning, anne-marie. it is a chance to make history. and if history is any guide at all, the fight to confirm president biden's pick will likely be an intense process here on capitol hill. today, supreme court justice stephen breyer is expected to announce his retirement at the whwhite house. >> let him make whatever statement he's going to make -- >> reporter: president biden declined to comment further as the news broke yesterday, but the president made this declaration on the campaign trail in 2020 -- >> i'm looking forward to making sure there's a black woman on the supreme court. >> reporter: the top candidates are all sitting judges. the front-runner, 51-year-old

federal appeals court judge ketanji brown jackson. a harvard law school graduate and former law clerk for justice breyer. >> thank you very much, mr. president -- >> reporter: the 83-year-old breyer, a liberal, was nominated by president clinton in 1994. he's faced some pressure to retire while democrats control congress over concerns a republican senate would block any future nomination. >> when exactly i should retire or will retire has many complex parts to it. i think i'm aware of most of them. >> reporter: breyer will likely stay on the bench until the end of the court's term this summer, then all eyes will be right here on capitol hill for an intense confirmation process. >> we want to get this done as soon as possible. >> reporter: three republicans voted to confirm jackson to her current position including maine's susan collins. >> we can take our time, have hearings, go through the process. >> reporter: breyer's replacement will not change the

court's ideological balance, a 6-3 conservative majority. so it wouldn't change the idealogy, but it would change the face of the court. in its history, there have been more than 100 white male justices and only two african american justices, both men. anne-marie? >> debra alfarone on capitol hill. thank you very much. well the u.s. is condemning yet another north korean missile launch. south korea says the north fired two suspected ballistic missiles into the sea overnight. it's the sixth round of missile tests this month. the state department says north korea's tests are in violation of multiple u.n. security council resolutions. >> there's no diplomatic breakthrough yet in the standoff between the u.s. and ukraine. the u.s. made an offer to deescalation the situation, but russia is showing off more military muscle ahead of a possible invasion. margaret brennan reports. >> reporter: with more russian fighter jets positioned in

neighboring belarus within striking distance of ukraine, six u.s. fighter jets arrived to the region ahead of an attack that the u.s. estimates could come in the next three weeks. >> that's what's really causing all the tensions now is this very, very big build-up of forces, very combat credible forces that he has along that border with ukraine and belarus. >> reporter: the u.s. and nato offered vladimir putin a way out. the u.s. ambassador to moscow issued a written response to the demand that nato halt for expansion and never allow former soviet states including ukraine to join the alliance. >> there's no change, there will be no change. >> reporter: secretary blinken said no such concessions will be made, but the u.s. did put an offer on the table. was this just to show you tried? >> as we've said, the placement of offensive missile systems in ukraine, military exercises and maneuvers in europe, all of these things would address i think mutual concerns including concerns stated by russia and

advanced collective security. >> reporter: 8,500 u.s. troops were put on high alert for near-term deployment in case diplomacy fails. nato's secretary general said 5,000 allied forces to set to go. >> we have plans in place that we can activate, execute on very short notice. >> reporter: no one is quite sure what vladimir putin will do. next week he is set to travel to china for the start of the olympic games. and the state department says that may impact timing of an attack. >> i think that probably president xi jinping would not be ecstatic if putin those that moment to invade ukraine. that may affect his timing and his thinking. >> that was margaret brennan reporting. moscow still denies that it will invade ukraine, and the president of ukraine is downplaying the threat, telling citizens there is no reason to panic. well, the federal mandate for millions of health care workers to get vaccinated against covid begins today. the rule will first start in states that did not challenge the mandate.

it will take effect next month for 25 other states that filed lawsuits. the u.s. supreme court lifted injunctions earlier this month that put the vaccine requirement on hold. meanwhile, moderna says that it is studying a booster shot designed specifically to fight the omicron variant. a study shows moderna's booster shot protection against omicron fades over the course of six months. pfizer is also studying its own omicron-specific shot. a major winter storm is threatening to slam the northeast this weekend. areas near boston could see more than two feet of snow. forecasters say that the storm will intensify as it moves up the carolina coast. snow is expected to arrive in western massachusetts late tomorrow afternoon. people in its path are getting ready by stocking up on supplies and groceries. >> definitely basics, milk and eggs and water. >> we're overdue, but we're always ready. >> how much snow do you think we'll get? >> i don't know. they're saying one to two feet

place yesterday at an empty chemical storage tank. five of the victims were taken to the hospital. now the same company also reported an explosion at a sister facility that injured six people last september. an artist paid tribute to kobe bryant and his daughter, and a coast guard search continues off florida. those are some of the headlines on the "morning newsstand." "reuters" says rescue crews recovered one body, but 38 people are still missing from a capsized migrant boat off the coast of florida. the coast guard says that they were believed of to been on board a suspected human smuggling boat when it capsized during a storm on saturday. the wreckage of the boat was discovered tuesday, and a man was rescued after he was found clinging to the boat. he said that it set sail from the bahamas with 40 people on board saturday night. >> the longer they remain in the water without food, without water, exposed to the marine environment, the sun, the sea conditions, it is -- every moment that passes, it becomes

much more dire and unlikely that anyone could survive in those conditions. >> the coast guard reported intercepting another boat off the bahamas coast tuesday loaded with 191 haitian migrants believed to be headed for florida. the "los angeles times" says a bronze statue of kobe bryant and his daughter gigi were placed at the site where the helicopter crash that killed them and seven others two years ago. the sculpture of the 150-pound bronze statue dragged it up a steep, narrow hillside trail yesterday in calabasas, california, on the second anniversary of the tragic accident. it depicts bryant in a lakers uniform with his arm around his daughter who is also wearing her basketball uniform. the names of all of the victims are on the base of the statue. and "the new york times" says central michigan university told 58 high school seniors that it will pay their full tuition for four years after mistakenly telling them they'd won full rides.

the students were notified over the weekend that they had been awarded a prestigious scholarship. it came with full tuition, room and board, $5,000 to study abroad, and admission to the school's honors program, but then the school told them the messages were sent out by mistake. they will still get the tuition, just not the perks. building a better burger. mcdonald's is letting you stack a big mac on top of your favorites. your favorites.
