right now on kpix 5 and streaming on cbsn bay area, we're learning more about a triple stabbing that ended with a suspect dead. more testing options are coming to the bay area. where the latest site is opening up. and 49er fans hitting the roads andiarities. we catch up with the faithful making the trip to l.a., hoping to see the 9ers punch their ticket to the super bowl. good morning, it's saturday, january 29th. i'm devin fehely. thank you for joining us. let's start with the weather with darren peck. >> the first alert forecast starts out with cold temperatures in the north bay valleys and the inland valleys of the east bay again. it's 35 in santa rosa. 37 in concord; 36 in livermore. we're really seeing the classic setup across the bay area where our inland valleys are in the mid-30s and everywhere else in the low to mid-40s, classic and typical. we're in the looking at widespread fog this morning.

we'll look at that in detail in a complete forecast. we're doing okay and will track it as we do and mid-60s for daytime highs. more sunshine and haze. i will see you with the rest of the forecast in just a bit. back over to you. >> thank you. and this morning, we know the identity of a suspect in a triple stabbing who was later hit and killed on the freeway in san jose. he was identified as 25 year held humberto samora. he know stabbed the though roommates early in the morning and was found dead's few hours later when officers responded to a crash on highway 85 north of deanza boulevard. a truck driver told police a man jumped in front of the vehicle before the crash. no word so far on a possible motive for the staffing. san francisco police have arrested three teenagers in a deadly shooting new year's eve. it happened on corny on wall street. the police found 25-year-old takota smith from oregon

suffering from a gunshot wound. investigators were able to determine that smith had his car stolen and his puppy as well. and the authorities took a 15- year-old and 17-year-old. the officers with the search warrant found the dog and car. >> a group of richmond firefighters were caught in the cross fire of a drive-by the hog is earlier this week. the team was heading to a medical call on monday when the police and two vehicle began shooting each other. the crew was able to take cover inside the fire truck. no one was hurt. however, the truck was left with several bullet holes. >>. and the south bay, two people were hurt when a two-alarm fire tore through the emk's lodge in santa clara, it broke out around 5:00 p.m. yesterday near scott boulevard. firefighters encountered heavy smoke and flames. the eaindications point to a steve fire as the source. they say, the two people were cooking in advance of an event.

one was hospitalized suffering from smoke inhalation and slight burns. the other was treated at the scene. >> a new effort is underway to tackle a wave of smash-and-grab robbers in california. a group is collecting signatures for an aspect theft initiative to deter the violent crimes and would restore accountability for repeat offenders. >> it gives californians an opportunity to stand their ground against the criminal community that has become more brazen and dangerous by underlining million safety. >> organizers are getting more signatures to qualify for the initiative on the november ballot. starting tuesday in oakland, anyone 12 and up will need to show proof of vaccination to get into restaurants, bars, entertainment and event venues, gyms and adult care facilities. on saturday, san mateo count will open up a new walking site. they can do up to 2,000 tests a day. they'll be open from 8:00 to

4:00 every day, except on mondays when they're closed. >> and we we're waiting for word on whether nearly 00 teachers ist contra costa will call a strike feet over their covid concerns. the union is demanding high quality masks, weekly testing for all and the option of remote learning if there is a classroom outbreak. the union can call for a walk- out next week if they don't reach a deal. the district tells us it has k- 95 masks to students and staff and weekly testing and is proceduring paying raises for substitutes to keep classknowros covered. meanwhile, the okayland downfewed school board will hold a special meeting on monday to hear proposals on potential school closures. we reached out to the district for more details. new information on the new omicron subvariant. it's known as ba.2 and is 1 1/2 times more transmiss believe

than the original strain. there is no evidence it's more severe and doesn't appear to reduce the effectiveness of vaccines. two cases of the new variant have been detected in santa clara county so far. and this is a look at california's latest covid numbers. the test positivity unchanged at 18.8%. there are 76,000 new cases. that is up 1%. the biden administration's free n-95 mask started arriving in parts of the country this week. the bay area may need to wait longer. there were signs posted on the doors of a cvs and walgreens stores in alameda saying the free government masks were not available. they had masks you could buy. the companies couldn't say when they would arrive, but they're telling customers to keep checking. and meanwhile, the white house said 60,000 households ordered three at-home covid tests through the website. the 49ers are in california and making the final preps for

>> reporter: the urgency of using $1.2 trillion of infra structure money came into the area this morning in pittsburgh. at 6:30 this morning, a sickening screech of metal alerted neighbors that something had gone terribly wrong with the fern hollow bridge in pittsburgh. >> the debris off of the bridge. stating it fully gave out on the injuries. >> reporter: the 50-year-old bridge last inspected in september of 2021, gave way injuring ten people and leaving a bus dangling precariously. >> had this been maybe 20 minutes or 25 minutes later, you would have had school buses on there. you would have had full buses on there. a lot of cars and fatalities. >> reporter: this happened just as president joe biden was heading on a preplanned trip to pittsburgh to talk about the benefits of the recently passed infrastructure deal. >> we're going to fix them all. not a joke. this is going to be a gigantic change. >> reporter: in the bay area, less drama and danger as leaders showed off projects

funding from the infrastructure bill will pay for. >> this big hole you see behind us is $250 million that will resurrect the final phase of the harvey mill terminal one. >> reporter: including, lie detectorrifyication of cal train, bringing it to the terminal. a possible second transbay for b.a.r.t. >> there is completion of b.a.r.t. into san jose and santa clara and there is a complete transformation of highway 37, a absolutely vital east-west corridor in the north bay. >> reporter: the bill includes a 50% raise in general transportation assistance. a lot of that meany will go to bridges deemed structurally deficient. meanwhile, the ntsb is on the ground in pittsburgh. >> our engineering team will look for signs of stress in the materials that compress the bridge. signs of fracture and deer toiation. >> reporter: the bay area us this far is looking at about

$5.4 billion in federal funding from that infrastructure deal with more money possible through federal grants. in san francisco, andrea borba, kpix 5. the bay area's expected to receive the portion of that trillion dollar packaging over a five-year period. another cvs store is shutting down in san francisco. the company said that the closure in the city's financial district is not related to retail theft but several other factors. they include the dynamics and the local markets population shifts and how much revenue is generated by a store. tesla's cybertruck is running into another delay. the ceo elon musk told investors the pickup won't be ready until 2023, two years after the first promise. the main issue is now technology and finding a price that people would be willing to pay for it. the initial plan was to list it at just under $40,000. apple music is troweling spotify a day after the rival agreed to remove neil young's music from the service. in a tweet pinned at the top of

we'll look leave outside from our camera that is sitting on treasure island. clear skies out here. not only over the city, but for the most part, bay areawide, i have one area with fog that i want to highlight. around fairfield. it's 33 degrees. the current temperature shows you 33 in fairfield. 36, livermore much you can bring out the differences here on the map like this. you want to find the 30s? go to all of the locations that are inland and away from the bay. you want to fine the low to mid- 40s? come into the heart of the bay. pretty classic. and temperature spread from this time of the day. fairfield has an issue now. down to about 0.4 of a mile and that is how far you can see down the road in front of you. everyone else is doing phone. you can see for ten miles. heyward, you're seven. concord and liver more, you're 6. great numbers and we're not looking at issues with fog on the road and if you're heading

on 80 through solano valley, plan to hitting patchy fog and that is gone by late morning. this is a clear die on future cast. play that to 2:00 in the afternoon. there is nothing here. sunny skies overhead and into the afternoon, getting into the evening tonight and into tomorrow morning, we will see the low clouds fill back in and that is our sunday morning at 7:00 a.m. we likely wake up with more clouds tomorrow and meaning two things. it will be warmer tomorrow morning than yet is right now and we might clear the fog for the colder valleys. that sends to warm things up and checking in on that tomorrow morning. the fog can be real tricky to forecast and we'll keep's few clouds and here and upper 60s. 67 in san jose. 64, fremont and san mateo, 63. the numbers coming into the mid-

60s as well. concord will go to 64. and numbers in the heart of the bay in the mid- to upper 60s and that same story. and that covers the forecast here and, of course, all eyes down in southern california on sunday. the weather is a big factor for two reasons and that is near 70 for the daytime high and indoors. big picture shows you the storm track to the north and no rain the next few days. we don't even so a lot of change in the temperature spread. and there is a subtle offshore wind event that could happen on tuesday. doesn't look like a significant one at this point. we'll look at that coming up in the next half hour and what the winds, look like in the mountains. doesn't look like a major event and the rest of the seven-day forecast shows us we don't have a major event coming our way. i feel like it's been dry a

before they happen. this morning is an easy one. this their is not a lot happening today and looking into the east. concord, 37; 35, santa rosa and livermore. the inland valleys this morning. we're watching fairfield for patchy fog. right now, the visibility center has fairfield at two miles and just about 15 minutes ago, when we did our last first alert forecast, that time. more blue sky than anything else into the mid-60s. see the rest of the forecast in a bit. a bizarre story emerged from the north bay. a couple from southern california stayed at a sonoma airbnb and allegedly went home with a neighbor's pet. kpix 5s da lin spoke with the owner who said getting the

animal back is as easy as hurting cats. >> i want my kid back. i want my friend back. she's my friend. >> reporter: he is in tears thinking about his cat. he misses her every day. >> reporter: go outside, stress out and burnt out and she just comes running. so, she is like my support cat. and they stole her. >> reporter: the sonoma man said a long beach couple rented an airbnb two doors down in october. when they left, he said, they took the outdoor cat with them. troy was out of town at the time. when he returned, a vet called him after scanning his microchip. >> i am like nevins is in long beach? she doesn't walk to long beach. nor did she hitch a ride, you know what i mean? how on earth is she in long beach? >> reporter: the long beach couple apparently took the cat in for a health check. the vet returned the cat to the couple and asked them to

contact troy. they refused. >> those are evil people. those are people without a conscience. they're people -- >> reporter: troy filed a cat napping report with the sonoma county ship. the clinic said, they fully cooperated with the sheriff's department. and investigators tell troy they forwarded the case to the district attorney's office. three months later, troy is still waiting for nevin's return. >> i don't have kids. she's my kid. and she has seen me through so many things. they took her. and i want her back. sorry. i think of all of the millions of -- the second i opened the door or drive up the driveway or go out back, it's just -- there is nevins in my lap. >> reporter: troy won't give up. if law enforcement doesn't act, he may hour an attorney and a

private investigator to get nevins back. i'm da lin. kpix 5. we reached out to the sonoma county sheriff's department about the case but have not heard back yet. california now ranks number one in the nation for ransomware attacks, according to a new report by a cybersecurity company at normal security. of the nearly 4200 ransomware victims identified from 2020- 2021, 260 are in california. that makes our state the biggest target in e naonfoe cks experts say criminals are not just going after big companies, but they're hitting police departments and even hospitals. last summer, a hospital was hit and was knocked off line, including patient charts, becoming a challenge for nurses and doctors. >> it was a hardship for our staff. to have to work under those

changed conditions. it was very disruptive and difficult. we're glad we got through it. >> i they use a phishing email to infiltrate and lock a victim's computer system often including records and databases. we would like to think that a crisis like a global pandemic would bring out the best in people. it did, but it's also brought out the worst. including fake testing sites that are popping up across the state. reporter laura has the latest on this unfortunate trend. >> reporter: major hazards, including dangerous electrical systems just one reason why this shipy container turned to covid-19 site shut down. everything looked legit. >> i saw some guy who had a blue apron on and a full mask on going out to cars back and forth with a clip board. it liked official. >> reporter: this week, he scheduled an appointment in arvada county's colfax avenue testing site in grass valley. when he arrived, he was not

sure where to turn to test. >> was here to get my first covid test. over here is another covid test site, the rapid test site. >> reporter: steps away from the site, a shipping container advertising covid testing. >> a sign up on the side and people went over there. they were confused which is the place they were supposed to go. >> reporter: the site is no longer running, shut down, marked as dangerous and unsafe to occupy by nevada county public health for not having the necessary authorization to operate. the site agreed to close its doors and not reopen without approval. who was running the site and what exactly did they do wrong? we're getting answers. grass valley pd confirms to cbs 13 that a local community group was trying to get permitted by the city's community development director to block the site. the city was yet to give the green light and the group went ahead anyway testing residents

without the proper perms. shipping containers like this are illegal within grass valley city limits. >> maybe the heart was in the right place, they were trying to fill a need, but, still, you have to go about it the right way. >> reporter: grass valley pd said the group was not stealing money or identities of the people tested. the residents say the illegal operation still poses problems for the community. >> this is eroding trust in the legitimate places that are doing it the right way. >> reporter: if you took a test here, officials say to retake the test as a precaution. we asked nevada county and grass valley pd about the group that runs it. they didn't have that information for us. each county has their own website with a detailed list of test sites. the department of public health as -- has an online search tool that maps out and confirms the authenticity of testing sites. san mateo county is trying to make it easier to get a

covid test and announced a new partnership to operate a free walk-up test masking site at the event center. they can accommodate up to 2,000pcr tests a day. the site will be open tuesdays through sundays from 8:00 to 4:00 at the county, haven't center on delaware street. a new debate over street closures in menlo park. the city is keeping some closures and downtown park areas for now. what is hap helping some businesses is hurting others. >> reporter: the city of menlo park decided this weeky that would keep this section of santa cruz avenue closed to traffic to accommodate outdoor dining and other outdoor activities, restaurant owners are thrilled about it. other merchants are not. >> reporter: they have been great. >> 99% is outdoor. even with the cold weather. >> most lunches, we have only seating outside. >> reporter: restaurants have relied on the pandemic-related

street closure to stay afloat with expansive outdoor dining areas. theycelebring thec tokeep re osplace for the time being. >> it's important to have the outdoor street closed and the m road closure is harvest furniture. >> we're completely bareyicaded by not just departments, which we tolerate, but the occupancy of the street is tense. >> reporter: he is reconsidering his future on santa cruz avenue where his storefront stood for 25 years. >> it's devastating. i don't say this likely. >> reporter: the locations in redwood city and los gatos did well in 2021. and the menro park store had the worse year suns 2009. >> it was a major train on any profitability. we at least were under the obligation. i am looking to get out of the lease and i am negotiating. >> reporter: while other downtown areas throughout the

bay area have made temporary street closures permanent, menlo park has not made that move yet. viewers hope the city does not go down that road. the restaurant owners hope the city will consider the possibility. >> i think it should be closed for good. >> reporter: for now, the restaurant owners will make the most of this lifeline. >> i expect it will come to an end, although my hope is that they're will continue it just because we have gotten such great feedback from our community. >> reporter: in menlo park, max darrow kpix 5. it's one of the most popular malls in the bay area. now, there is a heated fight over parking. kpix 5s kiet do has more on the new plan getting backlash. >> reporter: valley fair mall will begin charging for parking in 11 days. beginning on february 8th, everybody is paying a fee. customers and, yes, employees. here in vietnam's restaurant, the owner started his business last year in the middle of the

pandemic. after the delta variant, omicron variant, hiring struggles, supply chain issues and inflation, the mall management dropped one more bomb during an all-hands video call. >> this is what we're going to do. paid parking starts on this day. employees will have to pay for it. >> just like that? >> yeah. >> reporter: valley fair said a substantial number of vehicles are left overnight on the property by people who work elsewhere. they also say that the owners ditch their cars at the mall and head off to the airport. to ensure the scoff laws are not taking up the 8400 spaces, valley fair will be the first mall in the south bay to charge for parking. for customers, the first two hours are free. it's a dollar for each additional hour. for employees, it's $3 a day. a monthly pass is $40. mall management said that this new controlled parking plan is part a broader focus on security at valley fair. by creating a more controlled parking environment, the hope is that the already popular center brings even more customers to support retailers allowing them to flourish.

>> yeah! >> reporter: in june of last year, valley fair had a grand reopening to showcase a billion dollar renovation. three months later in september, they held a job fair with more than 150 open positions. the parking fee won't help, he said,. >> and now, you're telling them, like, o, you have to pay $40 a month to work here. like that doesn't make any sense to me or anyone else running the other stores who are finding it hard to have enough employees to stay fully stocked up. >> reporter: the backlash has begin. this worker petitioned demanding free parking passes and has more than 400 signatures. organizers claim the mall could make up to $51,000 a month off of the employees. if their demands are not met, workers will downvote the mall and on yelp and google reviews and brainstorming other actions. >> they treating us like commodities or ways to bring extra revenue in to their property. -- what is unfair, we're the workers who are keeping the

a short-term rental crackdown is coming to tahoe. the placer county board of supervisors voted to clamp down on the number of vacation rentals operating around lake tahoe. the new rule caps the number of licensed vacation rentals at 1300 and that means about 25% of housing on the north shore and west shore are allowed to operate in the short-term rentals. they still need final approval next month. and a powerful winter storm is dumping snow on the parts of the northwest. here's more from long island this morning. >> i it started showing at 8:00 last night and hasn't stopped since this morning. and the wind gusts are picking up. the snow is falling hard. about five inches has fallen so far and you can see the mound of snow that is pushed assured. log island is expected to get the brunt of the storm in new york state and parts of new

we will take a view now from the trivalley. out over towards livermore and dublin. you can see the high clouds hanging out there. that is not it and there is no fog showing up over the trivalley this morning. we don't see anything another from our camera and looking into the east. a few high clouds out there. the temperatures, definitely it will a typical story for the bay area at 6:48 in the morning. and it's cold in the inland valleys and noticeably warmer in the bay. look at all of the 30s, whether we start in the north bay and go all of the way around the intire are areas. into the bay, the numbers are in the low to mid-40s. relatively comfortable start and there is some fog out there for farfold and we're tracking that. doesn't look like it's gotten worse the last 15 to 20 minutes but it's moderated up and down and has gotten worse and better at types and you can see two miles on the road and the rest

of today is nothing but sunshine and that is 2:00 today. no clouds and we'll so low to mid-level clouds fill the bay in tomorrow morning and gets us to 7:00 a.m. on sunday. and clouds whyer in the classic situation where they fill in the interior bays and woke get into tomorrow night, meaning monday morning. and there might be a few clouds. day time highs, and upper 60s in the south bay. the mid-60s of the east bay and into the heart of the bay, it's the same story here. low 60s long the water for the north bay and into the interior valleys up north, it's mid-60s as well. and one item into tuesday, the offshore wind event. it's not going to be strong but considering whaty woke have soen happen in big sur and near the guysers the last time we had a strongia of shore win, vent, watch what happens here

and that is on tuesday. and winds increase. showing you the offshore wins and a close in addition shows you how distinctive this will be on tuesday afternoon as we watch the mountains light up and this is tuesday, 40-miles- an-hour gusts. you see where they're showing you the offshore winds and not that bad. mount diablo, a 30 miles per hour-gust and this will be copfind at this point on tuesday, the middle of the day and north bay mountains. doesn't look termestrong, but -- terribly strong, but it's manage to keep an eye on. and we're going to have to watch offshore wind events again through the rest of the winter and we're not getting anymore rain. we look across the seven-day forecast here and we don't see anything. not only here, for san francisco, oakland and san jose, but the microclimates for the inlandivals of the east bay
