connected tv. cbs news. new york. it's tuesday, may 3rd, 2022. this is the "cbs morning news." breaking overnight, an unprecedented leak from the supreme court. a reported draft opinion first obtained by "politico" suggesting roe v. wade will be overturned. we have details from washington, d.c. power grab, the u.s. learns about russia's plan to annex parts of ukraine. on the run. the man hunt continues for a murder suspect who broke out of jail. why there's an arrest warrant for a corrections officer who was with him. well, good morning and good t be with you. i'm anne-marie green. the fbi is expected to launch an investigation into the shocking leak of a reported

draft opinion from the supreme court. it appears to overturn the 1973 landmark roe v. wade decision that legalized abortion nationwide. the reported draft opinion of the report obtained and published by "politico" appears to have been written in february. while the opinion could change if finalized by the supreme court, it could have high-reaching consequences and send it back to the states to decide. after "politico" published the reports, hundreds of opponents and abortion rights gathered outside of the supreme court building overnight. natalie brand is in washington with the latest on all of this. good morning. >> reporter: anne-marie, good morning. again, this is an unprecedented leak. this has never happened before. this morning there are still barricades around the nation's high court. just a couple of demonstrators remain at this hour, but earlier as you mentioned, hundreds had gathered here overnight shortly after this report came out.

an explosive new report suggests the supreme court's conservative majority appears poised to strike down roe v. wade, the 1973 case that legalized abortion. "politico" says it obtained a 98-page draft opinion that was circulated among the justices earlier this year. the court's opinion is not official until published and it's unclear if this is the final version. the draft is in response to case about mississippi's law which bans most abortions after 15 weeks. the ruling is expected by july. roe was egregiously wrong from the start, said justice alito. >> i think this was entirely expected, and i still think it's stunning. >> reporter: loyola law professor jessica levinson notes

half the states want to ban or severely restrict abortions. >> if the draft person stands, what it means is women will live in two very different americas. >> reporter: while the court says it's not commenting on the report, sources tell cbs news that chief justice john roberts is likely to order an investigation that includes the fbi to detetermine the source o the leak. >> do you view roe as having super precedent? >> reporter: former president trump supreme courts were questioned during their confirmation hearings on how they would rule if the issue came up. >> my opinion as a judge is there's 45 years of precedent. >> reporter: house speaker nancy pelosi and majority leader chuck schumer said in a blistering joint statement if the point is true, the conservative justices have lied to the u.s. senate and have ripped up the constitution. republicans praised the possibility that roe will be overturned. texas senator ted cruz calling it a massive victory for life. hundreds of supporters and opponents of abortion rights

clashed outside the supreme court overnight, a preview of the state-by-state fight that may lie ahead for both sides. now, according to the "politico" reporting, five of the republican appointed justices voted in favor of this draft opinion. it's unclear at this point how chief justice roberts will ultimately vote. also important to note, man re, the justices could change their votes in the days or weeks leading up to decisions. released reaction across both sides has been swift and will continue to pour in today. >> all right. natalie brand in washington. thank you very much. ahead on "cbs mornings," we're going to talk with minnesota senator amy klobuchar to get her reaction about the report and what she thinks congress should do. overseas now, russia could be planning to annex new areas of ukraine. senior u.s. officials warned the kremlin wants to formally claim

donetsk, luhansk, and kherson. as part of russia late oren this month. russia would reportedly hold a referendum which would not be recognized by the u.s. or its allies, of course. meantime, prime minister boris johnson is expected to address parliament today. he's expected to announce $375 million in military aid. debra alfarone has the latest from washington, d.c. >> reporter: american diplomats return to ukraine monday holding a news conference in lviv. >> we expect to continue to do day trips. we very much hope the conditions will permit us to go back into kyiv by the end of the month. >> reporter: buses carried civilians rescued from the bomb barded mariupol plant.

and there are plans to evacuate more. this woman says all the time we spent in the bunker they were bombing. house speaker nancy pelosi and a delegation of fellow democrats met with the polish presiden in warsaw after a secret trip to kyiv over the weekend. >> this is a crucial moment in politics for us. >> reporter: congressional democrats are hoping to pass the president's request for an additional $33 billion in ukraine aid by the end of the month. president biden is traveling to a look lockheed martin facility in alabama that produces javelin missiles which is among the weapons the u.s. has provided to ukraine. >> he'll remark about the assistance we've been providing, highlighting congress to pass funding quickly. >> reporter: russian assault rages on though ukrainian forces continue to fight back. ukraine's naval forces released the video, which they say shows a drone strike on russian patrol boats in the black sea. debra alfarone, cbs news in the white house. president biden met with the parents of american journalist austin tice who was abducted in syria nearly ten years ago.

the white house says during yesterday's meeting mr. biden reiterated his commitment to work to secure tice's release. the journalist disappeared in 2012 west of damascus. a video a week later showed him blindfolded and held by blind men. an arrest warrant has been issued for an alabama corrections officer who authorities believe helped an inmate escape from jail. 38-year-old casey white was being held on a capital murder charge when he left the lauderdale detention facility friday with vicky white. they are not related. the officer claimed she was driving the inmate to a nearby courthouse for a mental evaluation. the sheriff says there was no evaluation scheduled, and transporting a prisoner without another deputy violated the policy. the officer's patrol car was later found at a shopping center at a parking lot.

♪ hello there, fellow students... an oklahoma judge say as lawsuit seeking reparations for survivors and decedents of the deadly 1921 dtulsa race massacr can proceed. it had been the most prosperous black district after a young black man was accused of assaulting a white teenage girl. an estimated 300 black residents were killed. the judge struck down a motion to dismiss the lawsuit seeking reparations from the city and others. a crash of a so-called pedal pub was caught on video and there was a new conviction in the january 6th attack. those are some of the headlines on the morning newsstand. "the new york times" reports a judge convicted an officer of assaulting a washington, d.c., officer on january 6th at the capitol.

56-year-old thomas webster claimed he was acting in self-defense when he swung a metal flag polyattacking an officer and grabbing his gas mask. he'd be the third to be charged on assault charges. webster will be sentenced in september and he faces up 20 years in prison. the "associated press" says as the wall fire closes in, thousands in new mexico prepare to evacuate. the biggest fire in the u.s. has scorched more than 138,000 acres. nearly 300 homes and structures were damaged or destroyed. officials warn the fire could keep spreading due to hot, dry, and windy conditions. so no matter what happens, the people in las vegas will survive, and they're strong people. they're strong people in faith, and they're strong people in community.

a big blow to union organizers as workers at an new york city amazon warehouse overwhelmingly rejected a bid to unionize. the warehouse is across the street from a bigger one that made history as the first amazon facility to vote to form a union. they tweeted it will continue in this city and beyond. the fight has just begun. spirit airlines has rejected a $3.6 billion takeover bid by jetblue. the airline says it does not believe the regulators would allow the sale. instead spirit is considering a much lower offer by frontier airlines. this is a reversal from spirit's stance last month. with more on today's "moneywatch" reporter, here's matt pieper.

>> reporter: the dow added 84 points, the nasdaq jumped 201, the s&p 500 gained 23 points. tech stoxx led the way with nvidia and meta platforms each gaining more than 5%. earnings continue with starbucks handing over their quarterly report card. amazon has made two policy changes for its employees. the company will pay up to $4,000 to cover expenses for workers who need to travel at least 100 miles to receive medical treatments including elective abortions. the tech giant is also ending its covid-19 paid sick leave policy, telling employees they now have five days of paid time off instead. spacex has competition in the rocket recycling business. the california-based rocket lab captured a falling rocket out of the air with a helicopter. the booster set 34 satellites into space before falling to earth, deploying a parachute before a cable dangling from the helicopter grabbed it. it was a partial success. the chopper dropped the rocket into the ocean shortly after capture. and that is your "cbs moneywatch" report.
