heat advisories are in effect throughout the northeast, and people in new york tried to cool off at the popular rockaway beach yesterday, but a seven-mile stretch of the area was closed after two sharks were spotted in the water. in europe, passengers say they got stuck on a train between paris and brussels for four hours without air continuing. -- air continuing. one man tried to break open a window while others tried to force a door open. local media said the train malfunctioned, and the ac was not working during that time. harvey biggs is in new york with more on the scorching heat. good morning. >> reporter: good morning, anne-marie. the national weather service is warning 60 new record temperature highs could be set across 20 states by the end of the week. this unrelenting heat is bringing renewed pressure on the biden administration to break the political deadlock on climate action. more than 120 million americans live in areas covered by excessive heat advisories

as temperatures approach or exceed triple digits in some areas. >> this is not your parents or grandparents' weather. this is new weather that we're experiencing because of climate change. >> reporter: a similar heat wave is also in much of europe. in england the mercury topped 104 degrees yesterday, nearly three degrees above the uk's previous all-time high. the average high temperature there is normally in the mid 70s in july. >> we weren't expecting this for london. >> reporter: the extreme weather has prompted renewed calls for government action on climate change. president biden will be in massachusetts today to visit a former coal plant that's now making parts for offshore windmills. the white house says the president is weighing the idea of declaring a climate emergency. >> i would not plan a -- an announcement this week on national climate emergency. again, everything is on the table. it's just not going to be this week that decision. >> reporter: an emergency declaration would allow federal funds to be spent to address global warming.

>> the pentagon has noted not just in this administration but even the previous one that climate change is a national security issue. >> reporter: president biden's expected announcements on climate change today come after democratic west virginia senator joe manchin said last week he would not support any legislation that includes spending on clean energy. and wildfires are now burning in more than a dozen states fueled by the intense heat. the united nations is warning these types of heat waves we're seeing around the world will become more and more frequent because of climate change. anne-marie? >> harvey biggs in new york. thank you so much. house lawmakers approved a bill to protect marriage equality. all democrats and 47 republicans voted in favor of the respect for marriage act last night. it would provide federal protections for same sex and interracial marriages. but the measure is likely to face a roadblock in the senate. the vote comes after recent comments by supreme court justice clarence thomas who said

the issue of same-sex marriage should be reconsidered. the chairman of the house committee investigating the capitol riot has tested positive for covid. representative bennie thompson said that he's experiencing mild symptoms, and he plans to isolate for the next several days. despite his illness, the january 6th panel will still hold its primetime hearing tomorrow. it's unclear if thompson will take part virtually. meantime, those missing secret service text messages may be long gone. the agency says that it likely won't be able to recover data deleted from january 5th or 6th of 2021. the national archives is now calling for an investigation, though. here's nikole killion. >> reporter: officials at the secret service are acknowledging that some key text messages from january 5th and 6th that weren't delivered to the january 6th committee are presumed to be permanently deleted. lost during a previously planned factory reset of agents' phones. the agency told cbs news it is

reaching out to phone service providers and manufacturers for assistance. >> i would be shocked and horrified if anyone in a position of leadership oversaw the destruction of evidence related to the january 6th insurrection. >> reporter: the national archives asked the secret service to investigate how the records could have been erased. agents played key roles on january 6th, both at the ellipse when then-president trump demanded to be taken to the capitol, and alongside vice president pence, sheltering in place at the capitol during the attack. the developments come before the committee's primetime hearing thursday. the witnesses are former deputy national security adviser matt pottinger and former deputy white house press secretary sarah matthews. both of whom resigned on january 6th. sources say pottinger is expected to paint a picture of chaos in the west wing punctuated by the president's tweet attacking pence. >> that's where i knew that i was leaving that day, once i read that tweet.

>> reporter: matthews is expected to testify how alarmed she was that trump refused to quickly call off the mob after the violence erupted. >> we thought that the president needed to tweet something and tweet something immediately. >> reporter: congresswoman elaine luria who is leading thursday's hearing tells me she believes that testimony will be compelling and says the panel will also play more video from former white house counsel pat cipollone. she also said they're still working through logistics after chairman bennie thompson tested positive for coronavirus. nikole killion, cbs news, capitol hill. cbs news will carry tomorrow's january 6th hearing live starting at 8:00 p.m. you can also watch it on the cbs news streaming platform. to the war in ukraine now where some of the country may soon be claimed by russia. that's according to u.s. defense officials who say moscow is laying the groundwork to annex ukrainian territory.

square. this happened saturday evening. the man tried to outrun the horse after being accused of stealing sunglasses from a vendor, but he ran into nearby officers who took him into custody. he's facing a list of charges. what caused a fire to break out at the hoover dam, and a real-life tragedy for the show "law and order." those are some of the headlines on the "morning newsstand." "the new york times" reports a "law and order" crew member was shot and killed at a film location in brooklyn. police said 31-year-old johnny pizarro was helping enforce parking restrictions for the show yesterday morning. that's when a suspect approached his vehicle, opened the door, and then shot him in the head and neck. >> we didn't even suspect it was gunshots. just went back to sleep. later on we woke up, there were cops everywhere. >> for real? that's what my daughter said, mom, there's a shooting. i said, no, that's -- it's a film. she said, okay, everything's okay as far as i know. but i guess it's not.

>> police said the gunman who was wearing a black hooded sweatshirt and dark pants ran from the scene. they're still looking for him, and there's no word on a motive. the "las vegas review journal" says there were no injuries after a transformer fire at hoover dam. witnesses recorded the flames yesterday morning near the base of the structure. officials say that the fire did not threaten the power grid, but tours of the dam were canceled. the cause of the fire is under investigation. roughly eight million people in arizona, nevada, and southern california rely on electricity produced at the hoover dam. and espn says the american league won its ninth straight mlb all-star game after defeating the national league yesterday. giancarlo stanton, one of the new york yankees, was named mvp. he homered in the fourth inning to tie the game at two apiece. the next batter also hit a home run, putting the a.l. on top 3-2. no other runs were scored in the game. and check out this really special moment after the game.

technology compared to the current brands available. health leaders said the two-dose vaccine will be ready in several weeks. and according to the cdc, about 67% of the eligible population in the u.s. has received at least two covid vaccine shots. astronaut buzz aldrin's flight jacket is going on the auction block. bids for the jacket that he wore on the historic 1969 "apollo 11" mission could land up to $2 million at sotheby's. it's the only space-flown garment from the mission still in private hands. aldrin is the second man to walk on the moon. the 92-year-old is auctioning artifacts and mementos tied to "gemini 12" and "apollo" missions. the sale will take place july 26th. it's not all bad news for netflix, also airbnb has an offer most people won't refuse. matt pieper explains in the cbs "money watch" report. >> reporter: good wall street news as the stock market

had its best day in nearly a month tuesday. the dow gained 754, nasdaq up 353, the s&p 500 taking in 105. and some good news for netflix, too. that's because its second-quarter earnings were not as bad as analysts thought. the streamer lost 970,000 subscribers. that was a smaller loss than the two million it had projected. as for the third quarter, it will add one million net new subscribers. netflix is in the early stages of its paid sharing plan. they're heading to court. a judge in delaware has set an october trial date for the elon musk versus twitter case with twitter winning its motion for an expedited trial. the social media company is suing the tesla founder to force him to make good on his promise to buy it for $44 billion. the trial will be five days long. musk was hoping for a court trial to take place next year. and how about you make an offer they can't refuse? marking the 50th anniversary of the iconic 1972 movie
