we begin with new developments in the legal showdown between former president trump and the justice department. today the legal team for trump could ask a judge to appoint a so-called special master in the case, the independent official would review and possibly return evidence collected during the fbi search of trump's home in florida. agents seized 11 sets of documents from his estate earlier this month, some marked top secret and confidential. bradley blackburn is in new york with the details on this latest move. bradley, morning. >> anne-marie, good morning. the former president hinted at that legal move friday in a social media post. this would be a neutral person who would look at those documents collected and determine whether anything was seized inappropriately. it all comes as a deadline gets closer for the justice department to submit a redacted affidavit that might explain the search. >> reporter: this week a florida federal judge wants the justice department to prepare a redacted version of the afidavit that set off the fbi search at former president trump's home.

>> i think the justice department knows it has to come back to the court with a reasonable proposal, the judge signaled pretty clearly that he wants to release some facets of this affidavit. >> reporter: ohio congressman mike turner is the top republican on the house intelligence committee. >> what's important about this affidavit is it will give us the information to understand how did the fbi justify raiding mar-a-lago and spending nine hours in the president's house when we know the former president's home they had other options besides just raiding the house, they could have gone and asked for the subpoena to be enforced. >> reporter: in a separate investigation former trump attorney rudy giuliani spent hours last week in a georgia courthouse before a special grand jury. the former new york city mayor's appearance was part of an ongoing criminal investigation looking into election interference in 2020. >> there is no doubt in my mind that the most risk to the former president is, in fact, the georgia investigation, and one of the reasons i say that is

because it has intensified in terms of the number of witnesses that the district attorney is calling before this special investigative grand jury. >> reporter: on sunday a federal appeals court agreed to temporarily put on hold a lower court's order requiring south carolina senator lindsey graham to testify before that fulton county grand jury, a subpoena had ordered graham to appear tomorrow. and that appeals court that put a hold on senator graham's testimony said it was allowing more time to determine if any part of the constitution protects a sitting senator from being questioned about legislative work. senator graham maintains that is what he was doing when he placed calls to georgia officials in the wake of the 2020 election. panne-marie. >> bradley blackburn in new york. thank you so much. >> you bet. so russia has opened a murder investigation into what they are calling an attack on president vladimir putin's inner circle. authorities say carria dugina

state over the weekend to join the search efforts. >> the family has been in the park and we're working to support them as they go through this with all of us. there are more than 20 people working on this search and rescue operation and they are working all along the length of zion canyon. >> while the storm system caused havoc across several states. danya bacchus has more on that. >> reporter: flash flooding in moab, utah, turned main street into a river. the deluge left some businesses in 3 feet of water, cut off roads and prompted officials to urge everyone to stay inside. the powerful monsoon storms also caught hikers off guard at utah's zion national park where crews are still searching for a missing person. in new mexico's carlsbad canyon national park heavy rain made roads impassable, leaving more than 100 tourists stranded for hours. after an unprecedented amount of rainfall in one of america's driest regions caused millions

in damage, death valley national park is now open. the downpours aren't enough to ease the drought that nearly half the u.s. is under, including the colorado river. the water shortage is so severe that u.s. officials have ordered mandatory usage cuts in arizona, nevada and new mexico. a colorado river pipeline leak has prompted a new water ban in parts of l.a. county, already home to the toughest water restrictions in the country. danya bacchus, cbs news, los angeles. actor gary busey is in trouble with the law after being charged with numerous sexual offenses. the 78-year-old is facing a list of charges, including two counts of fourth degree criminal sexual contact. the incidents allegedly happened at hoteln new jersey ear police said he complainut busey's conductinlvi. the event's promoter said that

marine back home. the defense will make their case against the death penalty in a florida school shooting case and dozens of rescued beagles made their way to oregon looking for new homes, those are some of the headlines on the morning newsstand. the associated press reports the defense team for nikolas cruz will present their case in his sentencing trial starting today. they will argue that the 23-year-old should be sentenced to life in prison and not death. cruz shot and killed 17 people at marjory stoneman douglas high school in florida back in 2018. he pleaded guilty to 17 counts of first-degree murder. prosecutors spent the last month making their case, painting a horrific picture of the mass shooting with surveillance video of the shooting, photos and a tour of the school. and the statesman journal in oregon says that some of the beagles rescued from a mass breeding facility on the east coast will be available for adoption starting as early as tomorrow.
