we begin with breaking developments about classified material taken from former president trump's home. "the new york times" reports the government has recovered more than 300 classified documents from mar-a-lago since trump left office. that includes documents handed over twice to the government this year and from the fbi search on august 8th. lawyers for trump want an independent party to inspect records seized by fbi agents before the fbi can review them. bradley blackburn is in new york with the details. bradley, good morning. >> reporter: anne-marie, good morning. the "times" reports late last year former president trump went through boxes of documents taken from the white house and stored at mar-a-lago. he turned some over and the volume of material inside is why the doj intensified their search. now that legal maneuver from the trump team could delay the process.

lawyers of former president donald trump are asking for the fbi to not look at the documents until there could be a special master to look over the documents. they would take on the responsibility of setting aside documents covered by executive privilege. >> we're going to come out swinging saying, look, this cannot be something where we get a wink and a nod from doj that we're supposed to trust them. >> reporter: monday's maneuver is part of a federal lawsuit filed by the former president's legal team in response to the hours long search of his palm beach estate two weeks ago. >> it could give him a little more comfort. it could keep his side of things of the rhetoric around it, the politics behind it it might help donald trump. >> reporter: the day of the search agents seized documents including 11 sets of classified documents, some marked top

secret. >> they have to go through it not only sentence by sentence and paragraph by paragraph but word by word because every redaction they make, if they don't redact completely, it's going to lead people to speculate. >> reporter: the justice department opposes the release of the affidavit saying it could compromise the investigation. and that motion that former president trump's legal team filed monday also includes a claim that he is the front-runner for the 2024 presidential nomination. he has not officially declared his presidency. it shows how politics is complicating the ongoing investigation. >> bradley blackburn in new york. thank you so much. >> you bet. voters are heading to the polls today in three states. there are primaries in florida and new york. there's also a runoff election in oklahoma. one of the most closely watched races is the democratic primary for governor. charlie crist is running against

nikki fried. the winner will take on governor ron desantis in november. and in new york the signature race is the 12th congressional district. there are four candidates including two incumbents. jerry nadler and carolyn maloney. both lawmakers entered 30 years ago. another contender attorney suraj patel argues the state needs a generational shift. more rain is expected today in the dallas area just one day after a 1,000 year event. the dallas fort worth area was hammered by 9 inches of rain from sunday to monday. that is the second most in the history. it turned streets into rivers flooding cars and homes and at least one person died after being swept off a bridge. the torrential rain also caused hundreds of delays and cancellations out of the dallas fort worth airport. omar villafranca has more from texas. >> reporter: emergency crews

rescued families with children in heavily flooded seagoville, texas. it trapped drivers in and around dallas. >> the current's so strong going past my house, it'll wash you away. >> reporter: this woman was pulled to safety after the road flooded with little warning. >> i thought i was going to die. i was just panicking because i just wanted to get out of my car and get out of the water. >> reporter: dallas fire rescue responded to close to 200 vehicle rescues in just 24 hours. >> you will a of a sudden we were stopped and i see a car floating towards the wall. i was like, oh, shoot. >> reporter: just a few weeks ago triple digit temperatures were baking north texas drying up the trinity river in dallas, but overnight rain pounded the area filling up the river basin. >> she said, the water's coming in so i thought it was going to calm down but the rain kept coming. >> reporter: homes were also damaged. the rain so powerful this home

in downtown dallas quickly ended up with two feet of water. once the flooding receded, the damage became clearer. out west in utah's zion national park torrential rains turned the park treacherous putting park goers at risk. this person was filmed clinging to a large tree trunk in fast-moving flood waters and the search continues for a 29-year-old woman from tucson, arizona, who was hiking with her friends when the storm hit. dallas county has declared this area a disaster, and even though the flood waters are starting to re recede, folks here are hoping the worst of it is over. omar villafranca, seagoville, texas. breaking overnight, the state department is urging americans to leave ukraine. officials say russia is planning to step up attacks since it marks six months of invasion. meanwhile, ukraine is blaming

the remains are likely that of kiley rodney. the remains were found in a vehicle that belonged to rodney in a creek on sunday. the 16-year-old disappeared earlier this month from a party in that area and now investigators want to know how her vehicle ended up in the water. >> we literally have people swimming in the water looking down so we didn't disturb the ground initially. the vehicle was upside down and if silt and stuff come up above, that makes it more difficult. >> it's unclear if foul play was involved. the fbi is helping with the investigation though. "usa today" reports pfizer is asking the fda is asking to approve a new booster shot targeting the omicron subvariant. if approved, the shot would be available in just a few weeks to anyone over the able of 12. the ba.5 subvariant makes up 95% of cases in the u.s. moderna is expected to file a

a warning before you start thinking about lunch today. wendy's is pulling lettuce from sandwiches in several states because of a possible e. coli contamination. the cdc says 37 illnesses have been reported in michigan, indiana, ohio and pennsylvania. 10 people ended up in the hospital. "consumer reports" is advising people to avoid eating any wendy's sandwich or salad with romain lettuce until the source is determined. wendy's says it uses different lettuce in the salads than sandwiches. a popular boutique is banning people from wearing facemasks. kitson is banning people from wearing masks. thieves have been wearing them and targeting them. the world's second largest movie chain could be filing for bankruptcy. as well, subway is offering a subscription service for its
