during a democratic fundraiser last night the president said that the risk of nuclear armageddon is at the highest level since the 1962 cuban missile crisis. it comes after russian president vladimir putin's recent comments about the po u ukraine. astrid martinez is here in new york with the latest on that. astrid, good morning. >> reporter: good morning, anne-marie. and for weeks now u.s. officials, world leaders have said that putin's threats to possibly use nuclear weapons to defend russia are legitimate, that they don't believe he's bluffing, and that the u.s. takes these threats very seriously. but what stands out from president biden's comments last night at a fundraiser here in new york are that these are the starkest and boldest warnings the president has made on putin's threats. president biden's off-camera comments in at a democratic fundraiser in new york are prompting discussion around the globe. referring to the 13-day showdown

that put the u.s. and soviet riu war 60 years ago, the president said, quote, we have not faced the prospect of armageddon since kennedy and the cuban missile crisis. mr. biden's comments here last night come amid threats from russian president volodymyr zelenskyy to use, quote, all necessary means to defend russians amid the country's eight-month war against ukraine. president biden said putin was, quote, not joking when he talks about potential use of tactical nuclear weapons or biological or chemical weapons because his military, as you might say, significantly underperforming. >> i think the message is if you use a nuclear weapon, it's a suicide weapon. and the response from nato and the united states doesn't have to be nuclear. >> reporter: last sunday on "face the nation," former trump administration national security advisor h.r. mcmaster said as the russian military struggles in ukraine, it might be on the verge of collapse there. >> we have not seen any reason to adjust our own strategic

nuclear posture, nor do we have indication that russia is preparing to imminently use nuclear weapons. >> reporter: on tuesday, white house press secretary karine jean-pierre said the u.s. has seen no change to russia's nuclear forces that would require a change in the alert status of u.s. nuclear forces. fundraiser, so no cameras were allowed inside. president biden also is concerned about putin's off-ramp strategy out of ukraine saying where does he find a way out, where does he find himself where he does not only lose face but significant power. anne-marie? >> exactly. if he's painted into a corner, what will he do? astrid martinez in new york, thank you. well the fbi is stepping up its investigation into president biden's son, hunter. cbs news has learned that the agency has gathered what it believes is enough evidence to support changing the younger biden -- rather charging the

younger biden with crimes related to his taxes and a gun purchase. the fbi has sent the information to the u.s. attorney's office in delaware. in a statement, an attorney for hunter biden said, "it is a federal felony for a federal agent to leak information about a grand jury investigation such as this one." catherine herridge has more. >> reporter: the year's long investigation into hunter biden's business practices began before joe biden was president. the fbi believes there is enough evidence to prosecute. that evidence was provided ney delaw apte has yet tong tree between viand a u.s. attorney making a prosecutorial decision. i will he will have free rein to make the discussion. >> reporter: the probe explored whether the younger biden, his uncle james, and other associates violated tax, money laundering, and foreign lobbying

laws. since the early months of this year the probe narrowed, focusing on delinquent tax payments including income hunter biden earned as a board member for a company. he paid off more than $1 million in past due taxes. sources familiar with the probe told cbs news investigators were also looking at allegations that hunter biden made false statements on a gun registration form and may have disposed of a gun improperly. >> so it figures to be a fairly straightforward charge to prove, and it carries a significant penalty under federal law. >> reporter: a lawyer for hunter biden called the apparent leak inherently biased, one sided, and inaccurate adding, their team believes prosecutors should not be pressured or criticized for doing their job. president biden maintains he is not beg briefed on the case. >> i have never spoken to my son about the overseas business. >> reporter: the president has consistently denied knowledge of his son's work, but congressional republicans say

they will investigate if they take control of committees after the midterm elections. the justice department and the u.s. attorney's office declined to comment on the status of the investigation. hunter biden's lawyer said the justice department should investigate the leak. catherine herridge, cbs news, washington. breaking overnight, two separate u.s. military operations in northern syria have killed three senior isis leaders. american officials say u.s. special operations forces dropped from helicopters and killed an isis leader who facilitated the smuggling. weapons and fighters. it was a rare operation inside territory held by the syrian government. later, two other isis leaders were killed in a drone strike. the u.s. military says no civilians or american troops were killed or injured. and a suspect is in custody following a deadly stabbing attack on the las vegas strip. police released video of the suspect running from the scene after yesterday's brutal attack.

they say the man was apprehended within minutes with help from a nearby casino security. two people were killed, and six others were wounded, though, in the attack across the street from the wynn casino and hotel. a man with a large kitchen knife started stabbing people unprovoked. witnesses said some of the victims appeared to be showgirls who took pictures with tourists on the strip. >> it could have easily been us. we were just there like ten minutes prior to this whole stabbing. and it's very concerning. >> there's no word on a possible motive for the attack. california will begin issuing inflation relief checks to millions of residents today to partly help deal with by far the highest gas prices in the nation. the average price for a gallon of regular gas in california is $6.39. that's compared to $3.89 nationally. that's up a whopping $1.11 in just the past month.

"the new york times" reports the justice department believes former president trump still has documents he took when he left the white house. according to two people briefed on the matter, a top justice department official told trump's

lawyers the department believes he has not returned all the material. it is not known if the doj has new evidence that trump held onto government document after his residence was searched in august. the justice department declined to comment. "usa today" says an orlando amusement park ride where a 14-year-old boy fell to his death will be taken down. the operator of the 400-foot orlando free fall ride is removing it after the death of tyre sampson in march. he weighed 383 pounds, well above the ride's 287-pound limit. an independent report found sensors on the boy's seat had been manually adjusted and was unsafe. his father had asked for the ride to be taken down. >> i'm so filled with emotion. like finally the respect, you know. i'm finally glad they're coming to their senses and say, you know, let's get rid of this

well the comedy world is in mourning over the loss of standup comic judy tenuta. she died yesterday in los angeles after battling ovarian cancer. she rose to fame in the '80s with her outlandish comedy and became one of the biggest female comics of that time. she played an accordion and called herself the goddess of love. in the '90 she earned two grammy nominations for her comedy albums. judy tenuta was 72 years old. argentinian soccer star lionel messi announced that next month's world cup will be his last. the tournament in qatar will be his fifth world cup. argentina has not won the trophy since 1986. messi, who is 35, did not say if he would be retiring from the national team. we're getting a first sneak peek at the much-anticipated
