practice appears to be in jeopardy. captioning funded by cbs good morning and good to be with you. well, good morning and good to be with you. i'm anne-marie green. breaking overnight, up to 14 people, including three chldren, were wounded in a mass shooting in chicago. the police say the drive-by shooting on the city's west side began and ended in about three seconds. they say at least two shooters were seen firing from a car randomly into a crowd. investigators are trying to determine why the crowd was gathered, which could have been for more than one reason. local elected officials say there had been a vigil for someone who had recently died of natural causes. >> i saw everyone crying and people down on the ground, and i just called it in, and then i just went to try to help people and direct the ambulance people to where the bodies were. >> among those shot, a 3-year-old, an 11-year-old, and a 13-year-old. there's no word on the suspects or the motive for the shooting. and the man who allegedly attacked nancy pelosi's husband will be arraigned today on state charges including attempted

murder. in a statement last night, pelosi said her husband paul is making steady progress on what will be a long recovery process. chilling court documents reveal that david depape intended to hold nancy pelosi hostage and break her kneecaps to show congress that there were consequences for their actions. he was found with zip ties, a roll of tape, gloves, and two hammers, one apparently used to attack paul pelosi. this comes as public safety has emerged as a key issue for voters with one week until the midterm elections. debra alfarone is in washington with more. good morning. >> reporter: good morning, anne-marie. next to economy and inflation, crime is up there as one of the factors voters think about in deciding who to vote for. that's according to a cbs poll. both sides are focusing on this issue, just differently. as candidates around the country

continue their final push toward election day, republicans have put the issue of crime front and center. >> skyrocketing crime because of their soft-on-crime policies. >> reporter: it comes as a new cbs news poll shows more americans say republicans make them feel safer, but democrats have also honed in on the issue on the campaign trail via the gun control debate. >> i ran for mayor of my community in western pennsylvania to confront gun violence. >> parents should be able to send their children to school safely and have them returned home safely without the threat of gun violence. >> reporter: this is all amidst an attack on house speaker nancy pelosi's husband paul last week. in a statement yesterday the speaker said paul is making steady progress in what will ultimately be a long recovery process. at a campaign rally in arizona

on monday, gop gubernatorial candidate kari laked to make a joke on the attack. >> she's got protection, but apparently her house needs more. >> reporter: the attack is described as politically motivated. >> we have to calm things down. we have to decide we're going to be more respectful. >> reporter: the da announced felony charged against the 42-year-old david depape which includes attempted murder app assault with a deadly weapon. new court filings say depape was planning to kidnap nancy pelosi and possibly break her kneecaps. authorities say zip ties were recovered at the scene. back at the campaign trail president biden is heading to florida today to stump for democratic candidates there. later this week both he and former president trump will be heading to battleground pennsylvania. anne-marie? >> debra alfarone in washington. deb debra, thank you.

the continuing issue on affirmative action is in question today. yesterday the supreme court listened to arguments whether harvard and the university of north carolina can take race into consideration as one of the factors for admission. now, the justices considered whether factoring in race in college admissions was a modern-day form of discrimination. >> we're talking about race as a determining factor in admission to harvard. >> no one is automatically getting in becaue race is being used. they're looking at the full person with all of these characteristics. >> the court's six conservative justices all express doubts about the practice while the three liberal justices defended the programs. former president donald trump is asking the supreme court to stop his personal tax returns from being turned over to the democratic controlled house ways and means committee. in an emergency appeal yesterday, trump asked the court to stop the treasury department from turning over the records. lower courts have rejected his claims and ruled the committee

has the authority to obtain the returns. an indiana man is under arrest and charged with murdering two teenaged girls nearly six years ago. authorities announced that 50-year-old richard allyn was taken into custody last week after police made a break in the case 146789-year-old libertiy german and 13-year-old abigail williams disappeared while hiking just outside of their hometown of delphi. their bodies were found the next day in a wooded area. the police say the investigation is not over and they're not ruling out others may be involved. >> this is very complex, and i will give the investigative team any resource that it needs. if they ask for additional investigators, i'm going to give them additional investigators to follow up on tips that will continue to come in. >> allen, a drugstore worker in delphi, pleaded not guilty. south korean police say they've launched a nearly 500-member task force to investigate saturday's deadly crowd surge.

an estimated 100,000 people were at a halloween celebration in seoul when the people crowded into a narrow alley. at least 156 people including two american college students were killed. more than 150 others were hurt. the country's police chief said crowd control at the scene was inadequate, and he also said officers did not respond the right way to urgent calls from citizens warning about the potential danger. well, brazilian president jair bolsonaro is expected to publicly talk about his defeat in sunday's elections for the first time today. there are concerns the far right nationalist will not accept the victory of leftist former president louie lula da silva. truckers supporting balls narrow set up roadblocks throughout the country protesting lula's return to power, the protest could affect their vast cultural

angeles international airport were sickened by an accidental carbon dioxide release. three men and a woman were inside an understood ground utility room yesterday when the gas was released. three of the workers escaped quickly, but one man did not, and he is in critical condition. >> they heard a popping sound. that was a complete deluge of that system. it doesn't come out as short sporadic amounts of carbon die oxide but rather a full deluge. obviously that displaced all of the oxygen inside. >> officials say no travelers were affected, but about a hundred people were moved from a nearby terminal. a commercial egg farm has been infected with bird flu. the outbreak took place about 80 miles south of des moines. more than 1 million chickens will have to be destroyed to contain the highly deadly virus. none of the birds or poultry

a mega book merger is now in jeopardy. yesterday a federal judge blocked penguin random house's proposed purchase of simon & schuster, which is a subsidiary of paramount global. the ruling agreed with the justice department that the merger could substantially harm competition for publishing rights in the u.s. penguin random house condemned the ruling. it's expected to fight the decision. some twitter users could start paying a lot more to keep their blue checkmark. and a new salary transparency law goes into effect in new york city. dan liebermann has those stories and more in today's "moneywatch" report. u.s. stocks were down in the trading day yesterday, but the dow still closed out higher with a busy week marked by fed policy, earnings, and jobs data. the dow was down 128, nasdaq lost 114, s&p 500 dropped 29. president biden is speaking out about major oil companies

worker pay, aiming at narrow longstanding pay gaps especially for women of color. that's your "cbs moneywatch" report for this tuesday morning. i'm dan liebermann, cbs news, new york. the chicago history museum is giving visitors a special experience, a scary scavenger hunt. haunted dolls and history's horrors is a collection of 13 antique dolls that are scattered and hidden within other exhibits. now, most of the dolls have been living in the museum's storage area for years. the curator says they brought them out to highlight some of the study's darker tales. >> all the dolls have links to chicago and chicago history, real tragedies and disasters such as the eastland disaster or the iroquois theater fire. >> well, visitors are given clues about where to find the dolls. the exhibit runs through sunday. up next, avatar fans will need a lot of popcorn. how long the sequel is rumored to be as it gets ready to hit the big screen. g screen.
