>> he tried to kill mr. pelosi. now at 11:00, capitol police security cameras did capture the break this at nancy pelosi's san francisco home, but it turns out no one was watching. the next round of rain across the bay area to start the month of november. still a few showers making their way towards us. i'm tracking those and the snow in the high sierra in the first alert forecast. good evening. tonight paul pelosi is still recovering from that vicious attack with a hammer. police say the suspect, david depape, was on a mission to kill, and is now facing state and federal charges. tonight we're learning the moments leading up to the assault were caught on camera after all, cameras supposed to be monitored by federal police.

>> reporter: the man accused of attacking paul pelosi barely spoke in the courtroom. no cameras were allowed, but depape's right arm was in a sling. his public defender said he hurt his shoulder when he was tackled by police. he wouldn't go into details about depape's mental state, but did hint at a potential defense strategy. >> what i will say is there's also been a lot of speculation regarding mr. depape's, um, vulnerability to, to, um, misinformation. that's certainly something that we're going to look into, we're going to delve into. >> reporter: that very subject

is on the prosecution's mind too. the district attorney insists her office is trying to set the record straight amid swirling conspiracy theories about the attack. >> i think what's clear is that this case is vulnerable to misinformation. we're seeing it spread across all platforms at this point. we need to make sure that the record is clear what happened in this situation for all parties. >> reporter: a key piece of evidence about what happened that night, the 911 call paul pelosi made. cnn is reporting pelosi's family will have a chance to review that along with body camera footage of officers who responded to his house the night of the attack. jenkins says she's made a decision not to release the 911 call from the pelosi home. >> we are going to make a choice of whether or not it's something that should be played during the course of his preliminary hearing, and of course a later trial, but that's when that would be made available. >> reporter: cbs news confirms there were cameras outside the

pelosi house that captured the break in, and that capitol police didn't realize anything was wrong until they saw a police car in the driveway. capitol police can monitor 1800 different cameras according to the washington post. the san francisco police chief explained depape was on a mission to kill. >> what was going on in his mind, i can't speak to that. but what is very clear to me, from viewing that body worn camera, is he tried to kill mr. pelosi. >> depape will be back in court on friday for bail discussions and the scheduling of a preliminary hearing. we do have some breaking news tonight. a magnitude 6.0 earthquake just struck in the pacific ocean about an hour ago. it was centered less than 700 miles from the bay area. luckily there are no tsunami warnings tonight. a suspected hit man, allegedly driven by a

multimillion dollar motive is now charged with murder and conspiracy in the death of an oakland dentist: he's accused of conspiring to the victim's boyfriend. he admitted he stood to receive about 1 million from her life insurance policies, but he killed himself last week while in police custody. cell phone records show the two started talking in july, a month before the deadly shooting. an early morning attack at a san francisco 7-eleven store turned deadly. it happened on bay shore boulevard around 6:30 this morning. a 73-year-old died at the store. police say 911 callers helped them catch the suspect as he was trying to escape. now, this comes as a san francisco entrepreneur is speaking out after being the victim of a violent assault.

he's reminding people to stay alert, even in familiar surroundings. betty yu is here in the studio with that story. betty, i know you talked to the victim after he got out of the hospital. >> that's right. richard says right now he has five staples in the back of his head, and he's looking at at least several weeks of recovery. he said he hopes that more people speak up about these kinds of crimes so demand for a better quality of live in san francisco will be heard by public officials. >> reporter: richard showed us his head injury friday night. he said he had just parked his car and took a short walk to a friend's home around 9:30. he believes the suspects were after his rare rolex daytona. >> i heard footsteps behind me, and suddenly i was hit with something metal. when i turned

around there were two people. >> reporter: then the suspects ran away. he was left with what turned out to be a severe concussion and fragmented memories around the event. >> i didn't actually realize how bad the injury was. my head was hurting, i was bleeding, and just wanted to get home and bandage my head. >> reporter: it was the next day, on halloween, that he went to the hospital to get checked out. there staff members called police to take a report. but no one showed up during his ten-hour stay. he was later told to go to the station and complete it >> i was happy with the response today. i was disappointed they didn't come for the police report. >> reporter: he believes an officer finally came to take the report tuesday after he received social media attention. >> the police response seems

slower. >> reporter: he's sharing his story to ensure people are more careful in their surroundings. >> i'd like to see action from law enforcement and the city. i think there needs to be a tighter relationship between the mayor's office and enforce. and i'd like criminals to be held to account. >> he described the suspects as being around five feet tall, wearing hoods, and one had a baseball cap. >> pretty disturbing. that injury looked pretty gruesome. what was he out doing when this happened? >> he was at a late brunch with friends, and then went to pick up his tesla, and then parked the tesla near where he was staying. the attack happened shortly after that. he also wanted to mention he was sober during the entire incident, in fact he's been sober the last 30 years. >> thank you so much, betty. get ready to bundle up. a cold front brought showers across the bay area and snow up

moved off the bay bridge, rolling right through oakland with brief heavier downpours. not going to last long, and will scoot over the oakland hills and inland through the east bay and the san ramone valley. we'll see this off and on pattern throughout tonight and the first half of the day tomorrow. it's a 20 to 30% chance of rain with a little additional rain on top of what we've already picked up. mostly in the quarter inch to half inch range is what we've already picked up, which is a nice wetting rain to knock down the fire danger for a little while. more details in the seven-day forecast coming up. straight ahead in sports, world series shift to philadelphia, and somebody is in a position to win. and the warriors, well, to put it nicely, they're working on it. plus, five attempted murder suspects all under the age of

tonight five teens are facing attempted murder charges in a stabbing at a nevado school that left a student badly hurt. last monday, after school hours, a 16-year-old boy was stabbed in the school parking lot. this morning, six suspects were arrested, including five teens between the ages of 13 of 15. they're facing attempted murder charges tonight. the only adult suspect is facing conspiracy charges. tonight the victim is still in

the hospital in critical condition. a member of atlanta hip hop group migos is dead. take off was shot and killed after a party in houston this morning. the 20-year-old died outside of a bowling alley there. police say an argument broke out among 40 people leaving the private party. then, someone started shooting, killing the hip hop artist and injuring two other people. police are still looking for the gunman. take off was the youngest member of the group migos. check out the first snowfall of the season. fresh powder blanketing the sierra. that's quite a bit of it, right, paul? >> yeah, that's nice! this is video from the central sierra snow lab. they always get the best video and slow it down to make it dramatic. >> don't you just want to play it going to sleep? >> yes, if only it had a sound. it's like the visual version of white noise. i know all the ski fanatics are very excited to see this. >> we have the sound part of it down here in the form of rain.

>> which we also needed. they'll get a little more snow, and we'll get a little more rain over the next 24 hours. let's look first at the sierra and advisories in effect. the potential for 16 inches of snow total. they've picked up a lot of it already. for the winter weather advisory including south lake tahoe, up to 19 inches of snow total. the cold front that brought us the most widespread rain rolled through this afternoon. this cooler, breezy condition in the wake of that, but still enough energy pin wheeling around the heart of the system to squeeze out a couple more showers, including one that just crossed from san francisco to oakland. a few more showers trying to make it into san mateo county. it will be a hit or miss pattern throughout the rest of the night. futurecast has a pretty good handle on it, indicating a few showers for the morning

commute. but they'll be more miss than hit. just be prepared for the outside possibility just in case. make sure you have your umbrella just in case. the rain is really winding down by tomorrow afternoon. still a few lingering showers just after sunset through the central valley. then the wetter than normal pattern is likely next week. in terms of how much rain, the forecast model is still all over the place. one of them indicating maybe an inch of total rainfall across the bay area. this just takes us through thursday evening. the long range model says wait a minute. maybe a quarter inch to half an inch of rain. but even on the lower end of the estimates, there will be another nice, wetting rainfall. right now looking in the distance, you can see the rain

clouds across the bay in oakland. temperatures in the upper 40s and low to mid-50s. 40s across the board in the morning, a bit on the cool side, even for november. temperaturestomorrow definitely on the cool side. a good 10 to 12 degrees below average. the warmest spots inland and the east bay reaching the low 60s. a couple degrees warmer thursday, a couple degrees warmer friday, but friday is the warmest day in the seven-day outlook, and it'sstill well below average. the next rain is as early as saturday night. it's not going to rain everywhere all the time sunday, monday, and tuesday, but there's a decent chance of rain each day. we'll keep you updated as we get closer to the weekend. up next, how a dog named bear is helping the most vulnerable of victims feel

hard to imagine just how scary it is probably is for kids to testify in court, especially those who have experienced violent crime. but the contra costa county district attorney's office has a new tool to make the court process a little easier for them. katie nielsen introduces us to a dog with a very important job helping put kids at ease. >> let's go to work. good boy! >> reporter: this is bear. he's a five-year-old black lab golden retriever cross. >> he picks up on things i never would. he knows how nervous or anxious people are. >> reporter: janet is an investigator with the district attorney's office and is part of the team that interviews children after crimes have occurred. often victims of

sexual assault or molestation, or witnessed domestic violence crimes involving their parents. >> bear's most important job is to get victims through probably the most uncomfortable time in their lives. >> reporter: she was skeptical at first how bringing a dog to the interviews could help. >> the types of cases we were dealing with, nothing you could bring or say or do would make a victim feel any better. >> reporter: bear was donated to the da's office in 2019 by canine companions for independence, a nonprofit that provides service dogs to adults, children, and veterans with disabilities at no cost. >> i've had children who refuse to speak to law enforcement and don't want to testify, but i bring bear in, and their entire attitude changes. >> reporter: he also goes to court with them to testify. the deputy district attorney says the first case he won with bear

in the courtroom was a home invasion robbery case. >> it was an eight or nine-year-old victim who was hog tied with zip ties with a gun to his head. and that child was terrified of coming to court or being in the same room as the person who did it to him. >> reporter: but that changed when bear was able to join him on the witness stand. >> he was able to not only testify, but look at the person who did it and identify them. >> reporter: chris says the testimony from the children witnesses is often critical to making their case. >> i think that really speaks wonders to his ability to work with children. >> reporter: but that doesn't mean bear has to be serious all the time. he often helps employees at the da's office blow off a little steam. >> people are stressed about a bunch of different jobs and he wanders the halls and helps them.
