it comes as roughly 1,600 migrants are being released every day to shelters and on the streets of el paso, texas, putting a huge strain on the city. jarred hill is in new york with the latest. good morning. >> reporter: good morning. those questions over the future of what's called title 42 come as a federal judge just delivered a setback for the biden administration's immigration plans. former president trump's remain in mexico policy can stay in place while legal challenges play out. all that as communities say they are struggling to deal with the people who are already coming into the southern border. >> my biggest concern for them is is not to die out here in the street. >> reporter: sandra grace martinez came from san antonio to el paso, texas, on a mission to help the thousands of migrants that have crossed the border the past few days, many sleeping outside in the cold at night. >> they have no food, no shelter, no water.

>> translator: thank you for all the help. >> reporter: the anticipated flow comes as the pandemic era policy, title 42, is set to expire next week. a court ruled it's unlawful. it led to thousands of migrants being expelled for public health reasons, sent to mexico or their country of origin before giving them a chance to claim asylum. >> we have a crisis on the southern border, they can't deny it. >> reporter: republicans have criticized winding down of the policy. the white house says it will release more guidance on its post-title 42 plans next week. >> we have an intensive all of government effort under way to prepare. >> reporter: in denver, democratic mayor has declared an emergency as the city struggles to meet the need of several hundred migrants bussed there in the last month. >> this is a clarion call to our elected officials at the federal level to put aside politics and recognize the humanitarian crises that have come to our borders. >> reporter: congressional officials tell cbs news that negotiations on a bipartisan compromise on u.s. immigration

and border policy failed to gain enough support to pass by the end of this year. now that potential deal would have included the legalization of millions of undocumented immigrants known as daca recipients as well as created certain measures aimed at reducing illegal crossings at the u.s.-mexico border. back to you. >> all right, jarred hill in new york. thank you. this morning the northeast is being slammed with snow and ice as a massive storm is still on its devastating path from coast to coast. it packed a punch in minnesota where blizzard conditions produced more than two feet of snow in some places. blizzard warnings continue in parts of the northern plains. >> i've been here all my life, i'm 75 years old. i've never seen it this wet and sloppy. >> the same system produced at least 40 tornadoes across the south, mostly in louisiana where the governor declared a state of emergency.

this man rode out the storm in his home and described the terrifying ordeal. >> what i saw was from here looking that way, the roof kind of lifted three times. >> tornadoes in louisiana killed at least three people including a mother and her 8-year-old son. a former fort worth, texas, police officer is convicted of manslaughter in the shooting death of a woman inside her home. aaron dean fired through a rear bedroom window killing 28-year-old atatiana jerferson in 2019. police were responding to a report of an open front door. dean said he acted in self-defense when he saw jefferson point a gun at him, but prosecutors said there was no evidence he saw jefferson holding a gun before he fired. dean faces up to 20 years in prison. families of the victims of the uvalde, texas, school shooting are urging congress to take action on gun reform. they were joined by relatives of those killed at sandy hook elementary school during a hearing on capitol hill yesterday.

it came seven months after 19 students and 2 teachers died at robb elementary school, and this woman who spoke at the hearing. >> she will never graduate high school, never fall in love herself, never be present at my wedding, and we will never know how scared she was in her last moments in that classroom. are we not tired of hearing another tragedy because of gun violence? when is enough enough? >> congress passed stricter gun-control laws in june following the uvalde shooting, but democrat lawmakers at the hearing said without an assault weapons ban, more people will die. the biden administration says it's putting emergency health personnel on standby in case hospitals become overwhelmed by a covid winter surge. it's all part of the white house's pandemic contingency plan. nancy cordes has more. congratulations -- >> reporter: with 90% of the country now seeing a covid surge, the administration is

reinstating its free testing program. starting today americans can order four covid tests per household at covidtest.gov. according to the latest cdc numbers covid cases are up nearly 50% in the u.s. in just one week. covid deaths are up nearly 62%. why are covid deaths spiking more dramatically than covid cases are? >> death numbers are just beginning to rise. we obviously want to make sure that does not go any further. we know we can prevent nearly every death from covid if people get the updated vaccines and get treated. >> reporter: so far fewer than 16% of u.s. adults have gotten the new bivalent booster released this fall. among them, denise san miguel in dallas who is acting now because her sister got covid. >> i was just scared that -- i don't want to get it. >> reporter: even before this uptick, hospitals were already overcrowded with flu and the respiratory illness rsv.

though on that front the white house covid coordinator says there is a bit of good news. >> there's still places that have a very high levels of rsv. but nationally there's no question in my mind rsv is heading down. >> reporter: the white house has warned that its covid operation is running out of funds and asked congress for another $9 billion. republicans are pushing back. they argue that government has already spent enough on covid. they say the white house should try to repurpose other funds if it needs them. nancy cordes, cbs news, the white house. the biden administration issued new sanctions in connection with russia's war in ukraine. they target russian proxies including more than 20 people placed in positions of power in ukrainian territory. sanctions were also announced against a wealthy russian oligarch believed to have close ties to president vladimir putin. the sanctions come after russia's recent attacks on ukraine's critical infrastructure. coming up here, miracle at sea.

-- one would give it independence but create a treaty outlining such things as defense, u.s. citizenship, and use of the u.s. dollar. the bill stands little chance of passing the senate where it would need 60 votes. the "new york post" says the father of a new york state college student missing in france is pushing back on a french official's claims. 22-year-old ken deland, a senior at st. john university, was studying at a school in the french alps. he last contacted his family on november 27th. a french prosecutor says he was having difficulty making friends and left the area voluntarily. his father tells cnn the prosecutor does not know his son. early this week a friend of deland talked about the missing student. >> he wanted to study abroad, to know different people, different languages, all of their cultures and religions. we had foreign exchange students that were in our school that he -- he was good friends with all of them. >> deland's father says his family feels left in the dark

about the investigation because of french privacy laws. and "usa today" says two men were rescued after spending ten days lost at sea. the men along with a dog left new jersey in a sailboat thanksgiving weekend headed down for florida. they say a storm packing 40-foot waves hit the boat off north carolina and broke the mast. it lost power and fuel as it drifted out to sea. the men also ran out of water. tuesday the crew of a tanker spotted and rescued them more than 200 miles off the coast of delaware. happy dog. still to come, get ready to hop into a mario cart. we'll tell you when a new super nintendo theme park opens at universal studios. i know how it is for families who are unfortunate to get the gifts that they want for their kids. this is a way of the juju foundation giving back to those in need. >> nfl star juju smith-schuster gave back to his kansas city community this holiday season. he surprised shoppers by paying off their layaway businesses. the kansas city chiefs wide receiver says he dropped close to $10,000 at a local burlington store through his foundation. the 26-year-old who grew up poor said it's cool to give back. inflation is putting pressure on retail sales, and taco bell has a new twist on an old classic. serena marshall that's and more in today's cbs "money watch" report. >> reporter: it was a dismal day on wall street. the three major indices ending in negative territory as fears of a recession grow. the dow closing out its first day in three months, skidding 764 points.

the nasdaq falling 360 points, and the s&p 500 sliding 99 points. part of that selloff worries over a weakening consumer market as a much worse than expected november retail sales report came into focus thursday. it northbound consumer spending declined .6% last month after a rise in october. the data making it clear americans, particularly those with lower incomes, are cutting back on their shopping amid rising interest rates and elevated inflation. credit card delinquencies expected to spike to the highest level in a decade. that's according to a new forecast by consumer credit agency transunion. it also finds personal loans may face challenges in 2023 with those delinquencies also increasing. some factors driving this trend, inflation, continued layoffs across the country and the end of the pandemic era stimulus funding contribute. taco bell is putting a new twist on its mexican pizza. it's testing new types of the popular item.
