with you. i'm anne-marie green. we begin with new shocking the man accused of killing them appeared in court, as we're learning more about the evidence against him. omar villafranca has details. >> reporter: kohberger smiled at his court-appointed attorney and appeared calm as gruesome new details were revealed about how he may have stalked the victims and how police tracked him down through dna, phone records, and a witness. in a court document police say dna from trash obtained from the kohbergers' home matched do you -- matched dna on a knife sleeth like this one found next to one of the victims' bodies. also in the document, a roommate identified as dylan mortensen said she thought she heard kaylee goncalves say "there's someone here" around 4:00 p.m. mortensen said after hearing someone crying and a man saying something to the effect of, "it's okay, i'm going to help you," she opened her door and

saw a figure in black clothing and a mask covering his mouth and nose walking towards her. she described it as a tall male with bushy eyebrows. we learned police say cell phone records show kohberger's phone near the murder scene at least 12 times before the night of the stabbings beginning in august. casey jordan is a criminologist with no connection to this case. >> i would not be surprised if there is more information that's going to come forth. remember, in the probable cause affidavit, they just need put enough evidence to substantiate the arrest. they don't have to show all the evidence that they have that might come out at trial. so there could be other things. >> that was omar villafranca reporting. the u.s. house will try for a fourth day today to elect a new speaker. kevin mccarthy has failed to get enough votes after 11 ballots including five yesterday. 20 hard-line republican conservatives continue to hold out, although there are reports mccarthy has offered a deal and

progress has been made. it's grounded all house legislative and constituent business to a halt. this is the longest it's taken to pick a speaker since before the civil war. and people in california are bracing for more powerful storms after being pounded by hurricane-force winds, torrential rain, and catastrophic flooding this week. a series of so-called atmospheric rivers have washed away roads, destroyed piers, toppled trees and power lines, and cut off power to tens of thousands. at least two people died in the past couple of days including a toddler. a state of emergency remains in effect. danya bacchus is in san francisco. good morning. >> reporter: good morning. the wind gusts in the area were so strong they knocked off this south san francisco gas station canopy. the people across the state are feeling the impact of the storm as more bad weather is on the horizon. overnight, giant waves slammed

into redondo beach outside of l.a. the massive flooding it caused is now a familiar sight for many californians as an atmospheric river storm system moves through the state. this is the dramatic video of crews in nearby ventura county rescuing a man from a rushing river. areas further north, though, seemed to have been hit even harder. a powerful storm surge tore through a historic pier south of san jos. >> it had to take a huge hit. >> reporter: a locally famous pier snapped in half. >> super sad. i've lived me my entire and it's been here. >> reporter: forceful winds have toppled trees. once smashed into these first-time san francisco homeowners' bedroom while they were inside with their two toddlers. >> we were sitting in the living and and they jumped into my lap when they heard the whoosh and the smash. >> reporter: luckily the family escaped unharmed. in sonoma county, a toddler was killed when a redwood tree fell on a mobile home. the same storm system that has

drenched the state in rainfall also dumped several feet of snow in the sierra-nevada where multiple travel and avalanche warnings have been issued. and to put into perspective how much rain has fallen here, the national weather service says downtown san francisco saw its wettest ten-day period since 1871. >> incredible. danya bacchus in san francisco. thank you. breaking overnight, the nfl has announced that it will not resume the buffalo bills/cincinnati bengals game that was halted because of the medical emergency to damar hamlin. it comes as there is some encouraging news about the safety's condition. charlie demar has more. >> reporter: doctors at the university of cincinnati say over the past 24 hours buffalo bills safety damar hamlin has shown remarkable improvement. he's awake and communicating with them in writing. >> still has a breathing tube in and is able to communicate with yeses and nos by shaking his head.

he expressed surprise that he had been not with the world for two days. >> reporter: doctors say hamlin is still critically ill but appears to be neurological intact. they say hamlin can move his hands and feet, and he even asked if his team won the game. >> the answer is, yes, you know, you won, you've won the game of life. >> reporter: the second-year player has been in critical conditsie nday after he collapsed and went into cardiac arrest. >> thank you everybody -- >> reporter: newly obtained audio from "the new york times" captured the urgency from emergency responders. dr. timothy pritz says hamlin's immediate care by the bills' medical staff on the field is what saved his life. >> this was not a run of the mill injury, and they had a significant event on their hands. and immediately responded. >> reporter: buffalo bills' star quarterback josh allen says his teammates are grateful for the progress hamlin's making. >> we heard that news this morning, and we're extremely

happy for him and his family. >> reporter: still, hamlin's doctors say he has a long way to go in his recovery. >> there are many, many steps still ahead of him. from our standpoint, we would like to see him continue to improve, to be completely breathing on his own. >> that was charlie demar reporting. actor jeremy renner has posted a new video from his hospital bed. >> yeah. >> the "avengers" star wrote he was having an icu spa moment to lift his spirits as he received a scalp massage from his sister. renner was badly hurt sunday when he was accidentally run over by his 14,000-pound snowplow near his nevada home. he was trying to help a family member get out of deep snow. and today marks two years since the deadly riot on the u.s. capitol. capitol police are ramping up security ahead of planned demonstrations today. prosecutors have charged more

than 950 people in connection with the january 6th attack. today president biden will honor state officials, election workers, and a dozen law enforcement officers who protected the capitol in connection to the events surrounding january 6th. one of those being honored today is late capitol police officer brian sicknick. he suffered multiple strokes and died of natural causes the next yesterdasinick'sst with riers filed a $10 million wrongful death lawsuit against former president trump and two protesters. the suit claims trump incited his supporters to commit violence that day. hawaii's kilauea volcano is erupting again. the eruption inside the volcano's summit crater comes less than one month after it and its larger neighbor stopped releasing lava. so kilalaua is one of the most active volcanos.

the kremlin says putin ordered the cease-fire starting this morning in observance of orthodox christmas which both countries celebrate. putin claims the head of the russian orthodox church made the appeal. ukrainian president volodymyr zelenskyy said there could be no truce until russia withdraws its truce -- its troops from occupied land. the pentagon said that it was skeptical about putin's offer. the "associated press" reports on president biden's new plan to control the sharp increase of migrants at the southern border. mr. biden said the u.s. would immediately turn away migrants from cuba, haiti, nicaragua, and venezuela who crossed the border from mexico illegally. he also said the u.s. will accept up to 30,000 people from those four countries per month as long as they have sponsors and come legally. the president is set to visit the border city of el paso, texas, on sunday. and "the state" newspaper says south carolina's supreme court struck down the six-week abortion ban.

it was set to start last month but this was a legal objection to uber. and peloton is being hit with a hefty fine, $19 million, for failing to identify a defect in their treadmill that could cause broken bones, cuts, and friction burns according to the u.s. consumer product safety commission. the company had reportedly received more than 150 reports of the tread-plus causing injuries by pulling people, pets, or objects under and trapping them at the rear of the machine before they notified regulators, and that includes the death of a child. flying delta this year? one add-on you will no longer need to pay for is wi-fi. delta's ceo says starting february 1st, you can get in-flight internet for free on more than 500 domestic flights. that freebie will roll out widely by the end of 2024. there is one catch -- you have to be a member of their loyalty sky miles program to get the perk. that is your cbs "money watch" report for there friday

fentanyl-laced fake prescription pills last year in new york state. that is a 152% increase from the year before. the man charged in the death of migos rapper takeoff was released from jail. patrick xavier clark posted a $1 million bond a judge set for him calling him a flight risk. clark's attorney said her client will appear in court when he's required to. the 28-year-old takeoff was killed in november. police say he was an innocent bystander in a shooting which followed a disagreement over a dice game. and the university of texas has fired head men's basketball coach chris beard. the school called beard unfit for the position as he faces a felony domestic family violence charge. he's accused of choking and hitting his fiancee during an argument in early december. joinus toming up on bs cn that
