an plausible outcome. why prosecutors say they have a case against a man accused of trying to kill his own family. >> from kpix 5, this is the late news with sara donchey on cbs bay area. >> hello, i am sara donchey. her the dsa. he called it a miracle the family of four survived a plunge down this cliff in san mateo county earlier this month. today, the father behind the wheel is accused of driving off of that cliff on purpose. certainly difficult to imagine that. betty yu has more on what happened in court today. the story, when i first heard about it, was so shocking. what happened in court and what do we know about the situation? >> reporter: we continue to learn more details, sarah. patel did not enter a plea in court today. he was released from the hospital on friday and immediately booked into the san mateo county jail. he is being held without bail. patel has

been charged with counts of attempted murder and two counts of violence. this is what the family is car looked like after patel drove off a 250 foot cliff, known as devils slide, just south of pacifica. the district attorney said that based on video from a nearby tunnel along with witness statements, he believes that the evidence supports the charges. >> the people driving behind him described the vehicle's movement. the lack of brake lights. things of that nature. number two, there are cameras on that. the vehicle left the tunnel, turned off the road, then turned to go down the cliff. >> the d.a. said that he is not releasing that video to the media at this time. he said it

was a miracle that everyone survived this crash. patel's seven-year-old was injured and his four-year-old made it out with only bruises. he hopes to be able to interview patel's wife, who is still hospitalized. she is declining to speak to his office at this time until she is physically able to. >> specifically, why now, why this day? we know what the motive was. he didn't want any of them to live any longer, but what led to this? what was the trigger? >> the judge issued a no harassment order, meaning that patel can still contact his wife and children, but he has to follow protocols. now patel lives in pasadena. the family said that it was in the bay area visiting with family members. >> it makes you wonder what the conversation would be like between the family and just how much trauma the wife and kids have survived. this is so

horrific. i know that there was a lot of chatter when we first reported on the story about the car and whether it was in self drive mode. what we know about that? >> he said there is no evidence of the tesla malfunction or skidmarks or breaking around the crash site. he also said that the chp does have a specialized team that will be examining the car and answered that question technically. he expects that report to be available within the next few months. >> i am glad to hear that the family survived, but again, they probably have a lot of trauma to work through because of all this. betty, thank you for updating us. tonight, two more memphis police officers have been suspended as part of the investigation into this. the violent arrest of tyre nichols that ultimately proved deadly. video showed many people failing to help nichols after he was beaten by five officers. three more first responders have also been fired now. there will be a public funeral for

the 29-year-old on wednesday. reverend al sharpton will deliver the eulogy there. but tonight, closer to home, there was a memorial to nichols at regency skate park in sacramento, one of his favorite places. he used to live in sacramento. ashley sharp has more from his friends and family there. >> reporter: where hundreds rally to remember tyre nichols monday, tears were shed as well as laughter shared. family and friends gathered at the sacramento skate park he grew up at. >> it was his favorite place to skate. he fell a lot of times here, but he loved this park. >> reporter: friends who met tyree here became family. >> he was more than skateboarding. candles lined up in the shape of a heart. a symbolism of the light within

tyre. it was what his friends remember most. >> he just had this overwhelming urge to just make everyone around him smile. he is always so goofy. >> reporter: a bright smile, and avid skateboarder and photographer. a father, brother and son, even amid quiet reflection, calls for justice. police reform demanded after five officers are charged with murder in his brutal beating death. >> there is no way that a man should be pulled out of his car and beaten for a traffic stop. period. >> i don't care if it was all black officers! evil comes in all shapes, sizes and colors! >> reporter: the message from family and friends is that

tyre 's death will never be forgotten. the mass shooting and half moon bay that left people dead is raising concerns about living conditions for farmworkers. the san mateo county supervisor took these pictures. they show cramped conditions where people gather and were people cooked and apparently were children were playing. they were called , quote, deplorable conditions. the mushroom farm is at the center of shootings were dozens of farmworkers were actually living full-time. he also took this picture of the suspect's home where he stayed with his wife on the property. california investigators say that the farm had several code and permit violations and that they didn't even have permits to house people on the property. the gardens say they are unaware of the violations and they are promising tonight to build permanent housing for employees by next year. the vice mayor says that half moon

bay desperately needs more affordable housing. >> the plan is to do a four-story building. other services will include housing. >> jimenez says that the project will include 40 million units and is already in the works. okay. we definitely have to talk about the weather tonight. live look out across the bay area right now. things are clear, but that means that it is really cold. tonight it definitely is. parts of the bay area under freeze warnings and frost advisories tonight, but don't take my word for it! oh my gosh. i know you're probably going to say that relatively speaking it is not that cold, but for us it is pretty cold, right? >> yeah, temperatures definitely below average tonight. let's get into what's happening tonight. our temperatures are already dropping off rapidly. we will start with those current temperatures. already down to

34 degrees in petaluma and palo alto. temperatures dropping down into the 30s. at best you are still hanging onto the 40s, but those inland temperatures are going to drop down to or a little below freezing by tomorrow morning. so around 10 degrees below average for late january. you can see 30 degrees in santa rosa and a couple degrees below freezing. but it is not that cold. this is typical of what we would see on a regular basis. during the winter we get two or three of these every winter. it is 30 degrees in santa rosa tomorrow morning. it will rank in the top 50 coldest mornings in santa rosa of the past few years. we are not setting any records either. it will be chilly inland. if you park outside you will have to spend a little time letting the defroster run, but we are safely below record low temperatures across the entire bay area. there is a slightly warmer air in store as we go through the rest of the week including rain chances. we will talk about that in just a few minutes. i knew you were going to say that this is all relative! whenever i say, hey, it is so

cold, you come with the receipts! it is called but not the coldest! >> yeah, none of these records will be in jeopardy tomorrow morning. >> paul, thank you so much. it is hard to imagine a team having more issues at quarterback than the san francisco 49ers. brock purdy could be facing a difficult come back after this, injuring his elbow during the blowout loss to the eagles. so before purdy 's injury, the niners were set given what they had already gone through that position, which was already unimaginable. >> and it seemed like they were set for a long time in the making, and they still potentially could be with brock purdy. but as for next year, it is not looking good right now. purdy will reportedly be out at least six months after tearing a ligament in his throwing elbow on sunday. the news probably doesn't come as a surprise to purdy himself, who knew that something was wrong as soon as the injury occurred. >> i knew something wasn't right, so i asked to see if i could throw. even in those couple throws, i was like man,

something is not right. >> reporter: purdy was right. he will be forced to miss the entire off-season, with a training camp return is the best possible scenario. he will seek a second opinion. the injury will lead to big questions for the niners. >> this whole off-season just became a big dark cloud. this is not a rookie quarterback just losing a conference championship like the four rookies before him. now it is, is he going to be healthy for next year? is trey lance going to be recovered enough to participate in the off-season program? is jimmy garoppolo finally leaving this team after six seasons? >> reporter: going into the 2023 season, all the quarterbacks have questions. purdy out six months. trey lance still rehabbing a broken ankle. could jimmy garoppolo return for another year, or could they bring in a veteran like tom brady or aaron

we are heading into the final week of the lunar new year. san francisco city hall was the center of all celebrations tonight. lion dancers put on a performance inside of the rotunda. this saturday is the big lunar new year parade in san francisco, which starts at 5: 15 p.m. get there early to get a good spot.

all these events have been really fun. >> of course we need to plan. probably jackets. >> i mean, yeah. it is san francisco in february. layers and jackets. the good news is it doesn't look like it is going to be raining and i don't think our temperatures are nearly as chilly as what they will be later tonight. oh, it is cold already! >> it is starting to cool off. we will keep you updated on the weekend forecast, but for now it is monday evening. got a whole were quick to get through before we get to the weekend. it will be cold out there once again tonight. some frost on the windshield this morning and you will likely have to contend with that again tomorrow morning. sunshine and cool temperatures on tuesday and then a gradual increase in cloud cover wednesday into thursday before our first chance of showers moves in thursday and then further into thursday night. let's talk about the cold first. temperatures are dropping off into the 30s in concord, oakland and livermore. still holding onto the 30s in santa rosa and san jose. 48 degrees

right now downtown. low temperatures dropping down to the 30s pretty much across the board. there will be some spots around the coast and the bay. inland temperatures down two or even below freezing. again, this is the type of cold snap that happens. happens two or three times every winter. about 10 degrees below normal, but we are not sitting record low temperatures. despite the cold start, we will warm up to within a few degrees of what is average for this time of year. mainly mid-to-upper 50s. let's assume in for a closer look. mid-50s on the coast, upper 50s at the south end of the bay and same thing in the santa clara valley. not bad for me start off at 32. mid-50s inland in the east bay, not a whole lot of variation. midday 50s around san francisco and oakland. but i think even as you look at the warmest spots, they will get right up to around 60 degrees. the winds are in st. helena and back to near normal temperatures for the rest of

the work week. upper 50s around the bay with a mix of upper 50s and low 60s further inland. we are not going to see really any cloud cover at all overnight. without the blanket overhead, that is where our temperatures will drop off. if you fair-weather clouds arriving late in the day tomorrow, then we see the gradual increase in cloud cover on wednesday. it is not going to be overcast, just more of a mix of clouds and sunshine. waiting on the next round of rain, we will have to wait all day on thursday. i think we will see more clouds than sun. in terms of where the rain moves in, we ran out of data at 4:00 on thursday. at that point the rain was still well off shore, so it is not likely to move in until the late evening and thursday night. it is the first of two rain chances. the first moves in early thursday night into friday. another round of rain saturday night into sunday. we will track that ring as we go through the rest of this week. both of these systems will be light with a quarter inch to half-inch of total rainfall, the kind of shower activity we need to continue eating away at the drought conditions across the bay area. temperatures return to close to average with a mix of upper 50s and low 60s once we get past tomorrow, and

i don't know, but i feel like the dallas zoo needs its own police bureau, because they're having a lot of problems. >> it sounds like a sitcom pitch! >> it could be. this latest incident happened this morning. police are looking into all of it. an animal care team found two emperor tamarin went missing. no sign of them

either! police the somebody broke into the habitat and stole them. the zookeepers said the could just wander off and are probably somewhere close to home if they were to do that. about three weeks ago i clouded leopard disappeared for hours and was later found on the zoo grounds. the officers said that somebody cut a hole in the enclosure, then they found a suspicious tear in a home for native to africa and asia. last week, a 35-year-old vulture of some kind that i am not going to try to pronounce died all of a sudden. the zoo said that his death was unexpected and that they are devastated. people have a lot of questions about security. somebody tweeted out this video of a convenience store checker snoozing on the job writing, security at the dallas zoo! somebody compared this video to video of a guard patting people down and doing a fabulous job. we saw this tweet tonight of a line of people failing to stop a crowd from
