classroom had parents and students saying there was a big problem there before that fight turned deadly. >> from kpix5, this is the late news with sara donchey. on cbs news bay area. >> i'm sara donchey. every parent wants their kid safe at school. jaden pianta died after a freshman stabbed him three times in a fight at montgomery high in santa rosa. another student was stabbed as well and is recovering. a 15-year-old freshman is facing felony murder charges. parentsand students are stunned but problems have been there for a long time. andrea nakano spent a lot of time there the last couple of days. sounds like a lot of people you have talked to have said there was violence and a lot of fighting on campus before the stabbing ever happened. >> reporter: that's right

right sara. it is unclear what happened between the students but i talked with three separate parents that shared a similar story they have taken their sons out of school because they were bullied and victims of an attack and they caught the attacks on camera to humiliate them more. now students are afraid to return to school and they are demanding action. damian esparza sanchez and his mother stopped by jayden's memorial with flowers. the two had grown up playing baseball together. he can't stop thinking if the school had done more, he would have been here today. >> just the way they are handling situations like this, it really angered the students. >> reporter: sanchez says the students are demanding change. the students are taking action to have their voices heard. >> after every school in the county lot threats about school

shootings or just incidents in general, it made the students including me really worry about the future of the school. what would happen. after we heard about the incident here, you know, students on social media started posting about a walkout tomorrow. because us as students on a whole didn't feel safe. >> reporter: many parents are contemplating what they can do to protect their child. >> every day that they go out there door, i'm afraid something is going to happen. >> reporter: parents always worry. but many are increasingly alarmed after hearing what happens at school. >> my daughters come home almost daily and tell me oh my god, mom, there's a fight today. it was really bad. almost on a daily basis. >> reporter: christina said there is a history of bullying in santa rosa city schools that has never been addressed. >> this bullying thing, it needs to be addressed. not just at a high school. across santa rosa.

because my daughters, you know, even from kindergarten were bullied. >> until concrete action is taken, many are worried about stepping into a classroom again. >> i don't even know if i want to go back. just because of how administration is handling this. so you know. it's a tough decision to make for the future of my education. >> reporter: so we wanted to point out, we reached out to the administration to get their response. we are waiting to hear back. in the meantime, the question is what do the students and the parents want to see change here? >> reporter: yeah, they really want early intervention and concrete steps to resolve issues. that's the first thing they want. and then the other things like metal detectors at schools and possibly bringing back school resource officers. but some sort of security on campus to monitor these situations. >> all right, andrea, thank you

so much for sharing awes of their stories. we really appreciate it. sonoma county district attorney carla rodriguez released a statement saying her department will be providing justice. but there are regulations in place that protect the privacy of minors. our team coverage continues with betty yu. she talked to the mother of one of the teens hurt in the fight. that mom told betty that the school had the chance to address the conflict before yesterday's stabbing. >> the one thing i want to make clear is three weeks ago there was an incident with the person who stabbed the boys. and he attempted to jump my son and assault him. >> reporter: maria servantez was distraught standing outside montgomery high school this afternoon. her 16-year-old son cruise was stabbed in the hand and received stitches. the school alerted her to violence and tension between the older students and the freshman suspect.

jayden and her son seen on the left in this photo and on the right in this one were best friends. >> we are not the only ones who had concerns regarding the safety of our children here in the school. there were multiple parents involved. regarding issues with this individual. >> reporter: she said the district assured her things would be taken care of. >> there is going to be policies and procedures and extra security in place to make sure that something like this didn't happen. but it did. it did. and my son came into that office yesterday asking and screaming for help. and there was no staff available when my son was there trying to get his friend help. >> reporter: and as recently as a week ago, she said the same suspect slashed jayden's car tires at school. >> our children were failed. ultimately it took jayden's life being taken for eyes to open up and people to realize

this isn't a joke. >> reporter: we asked the school district to respond to those very specific allegations. were given a statement that read in part we are reviewing safety needs across the district and working to ensure we can adjust and amplify our work to assure safety in schools. many schools including the santa rosa school board voted to remove school resource officers from campus in the wake of the george floyd killing. >> you think there should be one? >> maybe two or three. >> why is that? >> well because of the gang stuff here. and what happened yesterday . >> jayden is being portrayed to be an evil person who went into the classroom with my son and jumped this other kid which is not true. it is not true. it's a false statement. and that will be proven in court. >> reporter: half an hour before the stabbing at montgomery yesterday, police were called to maria high

school about report of a 16- year-old student armed with a gun. at first, the student talked to police and ran. they didn't find a gun on him but searched the campus and today officers found this unloaded handgun in a storm drain near where the student was arrested. he was booked into juvenile hall. schools in the santa rosa school district as you heard have no officers on campus. and now a lot of people are asking should there be? we talked to someone from the national association of school resource officers. he says it all comes down to training. >> i'm not saying by having an sro would have prevented it but when we have properly selected sros that are specifically trained and we can make a safer environment. when they are properly selected, they are the right person. and they have a relationship that students may begin not to fear that officer. >> he added that the key is to look for early signs of conflict and get students the help they need right away. new tonight, kids in

oakland public schools are not reading or doing math at the level that they should be. that's according to a new report by a local non-profit. they say remote learning during the pandemic was devastating in an already strained oakland school district. just ask a graduate. >> i had to survive oakland's education system. i had to make it out. i had to go to the military. find alternative ways because there weren't scholarships waiting. because most of us were not prepared when we did graduate. >> families in action for quality education says one in three public school kids in oakland read at grade level. one in four are doing math at grade level. the group says black and brown students have fallen further behind. they say, though, they don't want to point fingers. they just want solutions. >> we are here tonight because we think that a quality education is what our whole city needs to be focused on. we are here because that should be our number one priority as educators and families and elected officials. wian to blic education and pus

here is what's happening around the bay. a man was arrested after detectives found explosives and drugs in his house. a bomb squad arrived at gunderson and arrested the man. he lived there with his wife and two children. the man accused of brutally attacking a hot dog vendor outside sap center was arrested in san jose. reyes is out on bail tonight. senator diane feinstein being treated in the hospital with shingles. she expects to make a full recovery and hopes to return to the senate later this month. for more on those stories and to catch up on all around the bay area, go to kpix.com. we will talk a little bit of weather. here is how it looked in truckee today. blue skies. sun. and a lot of snow.

we updated this. a warning. they are anticipating anywhere from, well, several inches of snow below around 2,000 to 3,000 feet in elevation to several feet in snow. if you are planning to head up to the mountains, do it tomorrow. or don't do it. once you get up there, you will be stuck until maybe tuesday. it will be another really active weekend in the sierra. around the bay area, cool temperatures, patchy fog as we head through the rest of tonight. passing clouds overhead tomorrow. no moisture until we hit the weekend. another weekend with the pretty good rain chance. let's take a look at futurecast. patchy fog. that will diminish. quite a bit of sunshine mid- morning to mid afternoon. but the clouds will start to thicken. we'll see rain chances approaching before the sun comes up on saturday. but the rain doesn't actually move in until mid-morning for the north bay. and rain will move quickly across the bay area from late morning into early afternoon.

brief heavy downpours with gusty winds. the fact they will be brief means we should be able to avoid flooding potential. snow at the higher elevation. snow line with the first batch of rain likely around 2500 feet. it will be hit or miss activity. but more rain will move in saturday night. this time around, the snow levels drop down to around 2,000 feet. maybe down to 1500 feet. that batch of rain slides through, while most of us are sleeping and off and on showers will be with us throughout the day on sunday. it will not rain everywhere all the time on sunday. if you have some outdoor stuff you want to get done, might be able to squeeze it in. but be very flexible. total rainfall in general, we are talking a half inch to an inch of rain as we head through the weekend. some spots may overachieve on that just a little bit. just another good soaking rainfall with a minimal flood threat should help to put more of a dent in the long term drought situation. and there is more rain to come. we are getting a little break in the action tuesday and wednesday of next week, but the six to ten day outlook and the eight to 14 day outlook from

the climate prediction center taking us to march madness. going to show a significant chance. looking at mount diablo. nighttime shot. temperature ins the 40s across the board. a mix of 30s and 40s on the map by early tomorrow morning. those temperatures are going to try to rebound. but we are going to end up a couple of degrees today. the warmest spots struggling up to around 60 degrees. that's the best we will do the next several days. temperatures are going to hit only the low to mid 50s . generally a wet cold weekend. a two day dry break tuesday and wednesday is not going to last too long. late next week, another storm system will be headed our way. showers in the forecast on thursday. those might hang out until thursday night into friday. a lot of questions far down the line.

a licensed medical cannabis store. >> reporter: luke scarmaza represents the end of an era. he is the last known californian to serve time for a federal medical cannabis charge. it has been 20 days since he was released from federal prison and he is still adjusting back to his life in modesto. >> making a chicken salad for lunch. something i really didn't get the choice to do while i was in prison. >> reporter: he crunches up doritos to top his salad. a trick he picked up serving 15 years of a 22 year federal sentence. in 2004, he and his business partner opened the first licensed medical cannabis store in the central valley. >> we knew we were going to get some pushback because the central valley is a little more conservative. especially back then. but we couldn't imagine what ended up happening. >> reporter: at first, he was a huge success due to the monopoly for his business. and it quickly turned into a passion, helping people going

through intense treatments, ease their pain. >> there was some loose regulation, but there wasn't anything like in black and white of exactly how you were supposed to operate. so, the kind of route that we took was let's go over and beyond on like regulation. and then when the city realized what they had done, they called the federal government in. >> reporter: medicinal cannabis has been legal in california since 1996 and recreationally since 2018. but distribution of cannabis remains illegal under federal law and carries a mandatory minimum sentence of 20 years. just what he received. >> how did we do everything right and follow all the state laws and do everything that we were supposed to do? and then be found guilty of a charge that was going to put us in prison for 20 plus years? >> reporter: over the next 15 years he was transferred to several federal prisons across the country. an experience he describes as traumatic but the worst part was being away from his

daughter who is now 20 years old. >> what's up baby? >> hey father. >> it wasn't that i felt like we were wrongly convicted. i just felt like it was an injustice for the amount of time that we received on a first time drug offense. >> reporter: he was considered for clemency by president trump. but passed over. scarmaza is calling for it to be legalized federally. >> it is not right. it is an injustice that continues to happen today. >> reporter: upon his relief, the judge in his case wrote a 29 page opinion that could set significant precedent for cannabis offenders moving forward. something he says may even be more impactful for others than a pardon would have been for himself. up next, the halftime show at the louisville virginia tech game got a little ugly. the incident that
