killed at a jehovah's witness hall. officers could be seen entering the building last night shortly after shots were fired. an unspecifi numr of oers were wounded, and police say they believe there was only one shooter who may be among the dead. jarred hill is here in new york with more on this breaking story. good morning. >> reporter: awful situation here, anne-marie. we don't know a motive yet in this shooting here in germany, but authorities are expected to give an update later on today. the country's chancellor calling this a brutal act of violence. video shows what appears to be a gunman shooting outside of a building used by jehova's witnesses in hamburg, germany. [ sirens ] ambulances then race to the area. police storm the three-story building looking for the suspect. a police spokesman says officers found victims on the ground floor and heard shots from an upper floor. he says they found someone who

had been fatally shot who may be the shooter and there was no indication a suspect was on the run. officers led those inside to safety. and used police tape to cordon off the area as they investigate. the shooting in germany's second largest city brought a large number of emergency responders to the building just after 9:15 thursday night. [ sirens ] a witness said she heard four bursts of gunshots and saw someone in the building running from the ground floor to the second floor. another man says he saw someone enter through a window and heard at least 25 shots before police arrived, and one final shot rang out. again, authorities are not looking for any other suspects in the shooting, but still really, really difficult situation there. hopefully get some more answers in the next couple of hours. >> indeed. this is supposed to be a sanctuary, a place where you know you're going to be safe. jarred hill in new york. thank you. the first of two atmospheric rivers is moving into california this morning.

the storm caused damage in san jose last night knocking down trees and power to several neighborhoods. police warned people who live in camps along the water banks that their lives could be in danger. >> we want them to be safe so they and pets and belongings can go to the community center. if needed, we will open additional evacuation centers. we want to make sure everybody's safe. >> there are concerns heavy rain could lead to flooding as the state continues to dig out from recent storms. new york city prosecutions could be close to filing criminal charges against former president donald trump. a source familiar with the matter confirms the manhattan district attorney invited trump to appear before the grand jury. it's an investigating hush-money payment to stormy daniels during the 2016 presidential campaign. now if he's charged, it would be the first ever indictment of a former president. in a statement trump said that he did absolutely nothing wrong and calmed the investigation a political witch hunt.

florida governor ron desantis is reportedly preparing to run for president in 2024. citing two people familiar with the matter, "the washington post" says desantis has indicated privately that he intends to be a candidate. a pro-desantis super pac called never back down announced its formation yesterday. he is scheduled to promote his n he has not said publically where for the fourth time in just under a month a train belonging to norfolk southern derailed yesterday in calhoun county, alabama. more than 30 cars went off the tracks. officials said there was no risk to the public. the derailment came just hours before the ceo of norfolk southern testified before a senate committee. he faced questions about the toxic train derailment in east palestine and its impact on the area. roxana saberi has more.

>> reporter: norfolk southern ceo told senators his company is for for last month's toxic train derailment in east palestine, ohio, and pledged $20 million to the region and residents. >> we're going to be there for as long as it takes to help east palestine thrive and recover. >> reporter: norfolk southern has announced several voluntary safety upgrades, but earlier this month a bipartisan group of senators unveiled a new rail safety bill. >> will you commit to supporting the bipartisan railway safety act and help restore the public's trust in your company? >> sor of provisions that we would absolutely support. >> reporter: those include tighter standards for tank cars the railroads don't own, expanded hazardous materials training for first responders, and standards for detectors used to spot problems along the track. republican senators also criticized the responsiveness of the epa. the agency recently paused the removal of toxic soil to confirm facilities that process the soil

are federally compliant. >> we expect waste to be moving perhaps as soon as today to other facilities. >> reporter: several east palestine residents attended the hearing including homeowner erin stauffer. >> our property values are nothing right now. even if we didn't feel safe and wanted to leave the area, i don't know how we would do it. >> reporter: back in east palestine, eric whiting doesn't trust testing and drinks only in tal wor you'd want rfk southernbuout? offe and i wld>>orter:r he hot roxana saberi, cbs news, east palestine, ohio. senate minority leader mitch mcconnell suffered a concussion when he fell at a washington, d.c., hotel wednesday night. a spokesman for the 81-year-old republican says that he is expected to remain in the hospital for a few days of observation and treatment.

mcconnell was at a reception at the waldorf astoria hotel when he tripped and fell. actor robert blake has died. his niece said that he died yesterday from heart disease at home in los angeles. black won an emmy for the 1970s series "beretta" where he played a detective who had a pet cockatoo. he also won praise for his performance in "in cold blood." later in real life he was acquitted of the 2001 murder of his wife, bonny lee bakley. ro bold. >>mi "ru" investigation. algabas attorney about the gun that fired and killed a cinematographer. and collision course. a large asteroid could smash into earth. we'll tell you when. this is the "cbs morning news." used in the deadly 2021 shooting on the movie set of "rust" was destroyed. the actor's lawyer told a judge yesterday that the state had destroyed the gun. baldwin and the film's weapons specialist have both been charged with involuntary manslaughter in the death of a cinematographer. the prosecutor says the gun exists and can be used as evidence. well, a large asteroid could be headed to earth, and a man convicted in a 1996 murder will learn his punishment. those are some of the headlines on the "morning newsstand." "the tribune idea "says paul flores will be sentence today -- sentenced today for the murder of cal poly student kristin smart. a judge convicted him of first-degree last october. a separate jury acquitted his father of helping him hide the body. he disappeared in 1996 after an off-campus party. flores was a fellow student. her body has never been found. >> it's been a long and winding trail is all i can see to reach

a conclusion, and that will be what's happening tomorrow when the judge pronounces sentencing. >> flores faces the possibility of life in prison without parole. "reuters" says as expected china's xi jinping secured a third five-year term as president. nearly 3,000 members of china's national people's congress voted unanimously for xi this morning. there were no other candidates. the 69-year-old chinese leader was already named to a third term as a general secretary of the ruling communist party's central committee in october. he did away with presidential term limits in 2018. and "usa today" reports on an asteroid as wide as a football field that could hit earth on valentine's day in the year 2046 according to nasa. this is animation from nasa of the asteroid. it was discovered last week at an observatory in chile.

here's a look at the forecast in some cities around the country. ♪ embattled new york lawmaker george santos could be in more trouble. a former roommate who was convicted of fraud says santos was the mastermind behind a credit card skimming operation in seattle in 2017. that's according to "politico" which obtained a sworn

declaration given to federal authorities. the roommate said he contacted authorities after seeing the congressman on tv. santos was previously questioned about the scheme but never charged. he's facing several investigations, though, related to his background and finances. a man in north carolina is facing multiple charges after he allegedly drove a car into wilmington international airport. the sheriff's office says the driver broke through a fence and was seen on the tarmac before crashing the car into the airport's terminal. that's where authorities detained him, and no one was injured. the first-ever launch of a 3d-printed rocket is set to blast off tomorrow. relativity space scrubbed the original test launch on wednesday due to fuel temperatures. the company hopes to use printed rockets to launch small satellites into earth's orbit at a lower cost. >> we need to prove that a 3d-printed rocket can survive the environments of a rocket's flight, making it through that will be the ultimate validation that our 3d-printed structures
