dig into the felony charges, what they mean and what is next. that's the big story. good afternoon. i'm reed cowan. let's talk about it. former president donald trump entered a courtroom and pleaded not guilty to 34 counties. they are all felonies in the hush money investigation. after that, you see it, it was wheels up. he left new york to return to florida. he is expected to give a statement later this evening. michael george has the latest from the manhattan criminal court. >> reporter: former president trump is heading home to florida after leaving the courthouse a short time ago. hundreds of protesters here as well are starting to head home. no reports of violent incidents. today in court we finally started to learn the details of the case that will be known as the people versus donald trump. a somber looking former president trump entered court to face criminal charges in connection with hush money payments made to an adult film star in 2016. he pled not guilty to 34 felony counts

related to falsifying business records. >> he is frustrated, upset but motivated. >> reporter: during the court hearing, the judge told trump to refrain from social media posts after messages critical of the prosecutor. manhattan district attorney alvin bragg spoke to the media afterwards. >> the defendant repeatedly made false statements on new york business records. these are felony crimes in new york state. no matter who you are. >> reporter: across from the courthouse, police tried to separate pro and anti-trump protesters. they don't have a permit. police can declare an unlawful assembly if it gets out of hands. marjorie taylor greene called the proceedings an injustice. >> donald j. trump is innocent. this is election interference. >> reporter: antitrump demonstators say justice is a

long time coming. >> it's satisfying as a new yorker to see him finally see the inside of a courtroom and face a judge like every other criminal. >> reporter: trump's lawyers will fight the prosecution in court. once back in florida, he plans to hold a rally with invited guests at his mar-a-lago estate. trump called this a political prosecution, it's important to note that the decision as to whether or not there is enough evidence to criminally charge him was not made by a d.a. or judge but by 23 regular citizens in the grand jury. reporting in manhattan, michael george. reed, back to you. >> thank you. a live look at the airport in west palm beach, florida. former president trump is set to give remarks in a couple of hours. 500 prominent supporters have been invited for this. again, it bears mentioning a conviction would not prevent him from running for the presidency in 2024. we dug into the charges. trump faces a

total of 34 counts of falsifying business records in the first-degree. all of those charges of class e felonies. what does that mean? that's the lowest level of felony in the state of new york. i can tell you the next court hearing is scheduled for december with a potential trial scheduled for january. of course, that would easily change. delay is something that we know happens in court situations. we will watch that closely. it's a lot for us to sort through. we lien on people experts in our community. joining me is david mccuen. so, you read the charges. you have seen what is being said about it. what do you say to the accusation, the criticism that they had this for seven years and there is nothing new here. >> what you will see tonight is when donald trump is in mar-a-lago, he will make political highway of 34 class e felonies, the lowest class of felony according to new york state law as you mentioned on the lead in. he will try to tie together all of this as a

massive witch hunt. he will talk about the federal prosecutor jack smith, he will talk about what is happening in georgia, potential cases, other cases in washington, d.c. as well as in the state of new york. that gives, if you will, donald trump the political hay. if this is the start of what could be a series of indictments, this is a legal pebble. this is what you will see the homecoming for the homecoming king. he will come home to the home team and rally the base. this is him securing the republican nomination from what we saw today despite the hijinks, the personality around him and someone not clearly to be commander in chief. this is in his wheelhouse from what we saw based on these charges. this gives the legal team a lot of running room between now and december. >> what does this do to the other potential indictments, the other potential cases, the

document case, the georgia accusations of election interference in the state of georgia, does this take the wind out of those potential indictments. >> it doesn't take the wind out of those but it does allow donald trump the running room to join them together as a political witch hunt. it doesn't take the legal wind out of them because they are different. any federal legal charges would face a federal sentencing minimums. they are more grievous, involving the secret documents as well as election interference. when you read the indictments and you look at 16 pages of charge after charge and you read the 12 pages of statement of facts, there is nothing we didn't know here. there is no news here in terms of what we have known the last seven years. that gives trump running room on this particular instance. he looked somber, shell shocked this afternoon when he came in the courtroom. but beyond that, he will go straight into his place where he will run, if you will, on the football field as a hero

and rally his base. he has the plurality of folks in the gop primary season. that will be problematic because he will suck up the wind and oxygen and that will hurt people like governor desantis, asa hutchison and others because it's donald trump's republican party even with the 34 class e felony indictments over his head. >> marjorie taylor greene was saying donald trump did nothing wrong. he is innocent. she did an interview that i saw sitting with somebody inside of a car likening donald trump to jesus and nelson mandela. what about this rises to the level of illegality. talk to us about the case that has to be made about illegality. >> what has to happen, first let me talk about marjorie taylor greene. she looks like she is auditioning to be the vice president for donald trump or on his ticket. if you look at the legal case laid out by

the d.a., by bragg today, he is making a leap from those class e felonies to federal campaign finance law. this is really sticky in terms of constitutional rights, first amendment violations, in terms of what campaigns do. hush money is not, if you will, an illegal act. so, it's the categoryzation of what that looks like. you have a trump organization trial that is coming up later this month. you have other elements of other things that make donald trump's april difficult but i think the onus, once we read the charges in the daytime will fall on the prosecution as it should but gives donald trump running room to keep going here. this is history making what happened today. it's stunning. at the same time it's also a place where donald trump can tie everything together as the victim. this is the exact place he has been running for 30 years, 40 years when you look back on his legal career, real

estate development career and how he has up is the politics as the new norm. this is grievance and grievance again that is energized by donald trump. that will help him at least in the near term. the politics can turn over by next week if there is subsequent indictments some place else. in that case, we have your phone number. we appreciate your time this afternoon. thank you so much, professor david mccuen. politicians on both sides of the aisle are weighing in. anne makovec is following that part of the story. this is fascinating. >> reporter: former president trump has support within the republican party. kevin mccarthy went after the district attorney saying he is trying to interfere with the 2024 election. >> it's sad when you have different forms of justice. the idea that this is only going to perpetuate further. this is an individual, a d.a. of a borough, not a state attorney

general. something looked at before. to take it to this level really to campaign and say you want to indict the president in the system the way it is -- >> reporter: but republican support is not universal. mitt romney released a statement saying i believe president's character and conduct make him unfit for office. even so i believe the new york prosecutor stretched to reach felony criminal charges in order to fit a political agenda. on the other side, barbara lee running for senate released a statement saying this is unprecedented moment we face as a nation. we must ensure now more than ever that our country's rule of law is upheld and applied to all of those that break the law regardless of their status or position of power. political responses as we might imagine are falling on party lines. but politicians on both sides are calling for calm and speaking out against any potential

daniels. he is heading back to mar-a-lago where he is expected to make a statement at that podium that we showed you later this evening. we are watching it and will have more information at 5:00. we hope you tune in. other stories from around the bay, there is a new memorial at the millbrae history museum honoring 44 people that died on pan am flight 7. the plane crashed into the pacific ocean a few hours after taking off in november of 1957 heading to hawaii. investigators were never able to figure out what caused the plane to go down but so many people remember and pay tribute. san francisco announced it will require inspections tore buildings built after 1998 taller than 15 stories. as you look at the picture, it may apply to several. this comes after a series of storms that caused damage throughout the city. the damage included high winds causing glass windows to break and toss debris around in the downtown area. here is how it will work. under the new

the time of day where you would hit daytime highs. the numbers range from like the low to mid-50s. average this out, they are about 10 below average for this time of year. i don't think anybody is thinking about that. we got used to that. mid- to upper-50s is what we do this time of year. it's not. we should be approaching 70 if you are inland. you should be well in the mid-60s in the bay. numbers like that are getting here after we get two weak weather systems that bring us rain to the end of this week. by next week we will get a warm up. if you look at the first one, that one arrives in time for friday morning. we are close enough now that the high resolution forecast models are in like for the whole thing. we can time it out. it's friday morning. as we go into midnight through the early morning hours, 4:00 a.m., we are seeing the most widespread rain across the bay. 7:00 a.m. a chance of a shower. then 10:00 a.m., it's

done. that is the friday rain. if you look at the totals, not a lot. a little more in the north bay. maybe .3 of an inch of rain. one of those where you get less than .10 from the golden gate south. it gets breezy perhaps but it doesn't look like a significant windmaker. most of the energy is going too far north. there is another chance sunday. then even with that, we are still going to be warmer. here is how it plays out in the temperatures. inland valleys, 69 would be the average. we will get there then some by easter sunday, the mid-70s. that will feel nice. a while since wednesday time highs in the 70s around here. morning lows back down for another cold start. let's not overlook this. the mornings are cold, 35 degrees for the north bay valleys. low to mid-40s for everybody else. the daytime highs we warm back to a couple of degrees above where we have been. a slow increase starting

the high stakes ahead. >> reporter: we take a look at the standings, it's close in the 5th to 10th spot. warriors are tied in the fifth spot. you don't want to be seventh or lower. one loss or two losses can take you out of it all. we have to think that okc will be playing hard. they are 10th. they want to make sure that they have a spot in the play in. there are reports that andrew wiggins could be coming back soon. this is according to multiple reports from espn and the athletic. he missed more than 20 games attending to a family matter. wiggins is planning to attend the game tonight. he could play in one of the two road games after tonight. we are going to have to wait and see but we have seen the impact that andrew wiggins has on the court. a lot of fans are hoping that he will be able to come back before the end of the regular season. but there are a lot of fans that are sending their thoughts to andrew wiggins and a lot of people rallying behind him.
