fight about family may be the center of this case. all that tackles san francisco's homeless problem. the details of the mayor's new problem -- plan. how the supreme court place to step in at the very last minute. good afternoon , i am ryan yamamoto in for reed cowan. ashley might point to a motive in the killing of tech executive bob lee. nima momeni is accused of killing the cash up founder during the early morning hours of april 4th in san francisco. those charging documents reveal an acquaintance between lee and momeni's sister. documents that specify how they knew each other. a witness is momeni had called lee early in the night and asked if his sister was doing drugs or anything inappropriate. his sister and brother-in-law did show up in court for his first court hearing. this is video of them outside of the courtroom. we just got our hand on the courtroom sketches, making it

hard symbol toward his family. justin andrews has more on the case and those explosive documents. >> there was so much buildup around today's scheduled arraignment. it's a less than five minutes for us to learn that it was actually pushed back. we did get our hands on the charging documents that were released to us by the court. here are some very key takeaways. one of them includes video that shows lee and momeni leaving the millennium hotel tower. at one point around 2:00 in the morning, the video shows them getting on an interview -- elevator together at the hotel. also, video shows both got into momeni's bmw. also revealing the murder weapon was a kitchen knife about four inches in length. document say it was found in the parking lot e lee found stabbed. the

director said this, after the >> today, the judge issued a nobel without prejudice order. he will remain in custody through april 25th. on april 25th, there will be ruling on the motion to detain -- >> april 25th is that new arraignment date. seeing momeni in court wearing the infamous all orange outfit. -- the legal partner who was representing momeni. that is why they requested the judge to push today's arraignment back. paul is on vacation wanted to be present today, and the judge granted that request. his sister was in court this -- he talked to him is that the court. >> he has support as to what occurred and did not occur, it will come out over time. >> those charging documents are obviously a lot to sort through. we continue to look

breed says funding has never been the main factor to getting things done. >> if we are able to make significant changes to our bureaucratic process, we can move in dealing with these challenges a lot faster. it is not just about money. >> the plan comes less than a year after the city passed an ordinance think it has the duty to provide shelter for every individual. they are calling for more shelter bed since they are easier to provide an offer a more immediate solution. while touring a new process for housing families, mayor breed says this is the right process. >> i can't wait to see the families are living here, the kids were hanging out in these places, having a good time, enjoying one another, and feeling safe and secure in a comfortable , beautiful place to call home. >> is for the ordinance the angst to guarantee shelter, the department of homeless and

supportive housing drafted a $1.5 billion plan, but then abandoned it, saying it would not be able to secure building sites for all the apartments they would need. ryan? >> showing homelessness is still the number one concern among san francisco residents. more than public safety, housing portability, and straight street cleanliness. the most significant trend when you look at previous years as the study rises of public safety as a main concern. when most people lose a job, they have unemployment benefits. not our states massive population of undocumented workers. now they are really in rallying state lawmakers. jose martinez traveled with them to the state capital. >> he joined about 30 of her -- other undocumented citizens on a bus. >> translator: i feel so happy i could be with this group to go to sacramento.

less than half of that. they say recession fears have been fueled by the banking crisis, including last months collapse of two large banks. the fed says that crisis is likely to push the nation into a mild recession later on this year. another grocery store set to close for good, this time it is the safeway at 350 bay street. it is a change that could be especially tough for those in the low income housing nearby. here is max darrow. >> reporter: with his regular safeway on the corner of the -- and fisherman's wharf, trips will still look a lot different. >> now i had to spend money to go elsewhere to shop. >> he is use to being able to walk to the store. >>now had to market street, or down there just to shop. >> even though there are other grocery options, he says he shops it safeway for the

prices. >> now i had to spend an extra one dollar or two dollars to go somewhere for shop. >> it is expensive, but i love living here. >> the grocery store has been a part of the community for decades. he says the concern sanders told us about our shared by many in the area. >> about 20,000 residents within a half-mile of the story. for those families, for those seniors, it will be more difficult to get affordable groceries. for residents in the neighborhood, particularly the hundreds of units of low income housing across the street, it is a big problem. >> unlike some other store closures, safeway does not attribute this closure to crime concerns. a spokesperson tells us the decision to close the store is and one we made lightly. we continuously evaluate the performance of our stores and occasionally , it is necessary to close locations that aren't meeting financial expectations. the area surrounding the safeway has struggled in recent years with

vacancies, and this won't help fix the situation. >> this will leave a big hole in the neighborhood. it will make it more difficult for other businesses that may have relied on traffic from people going to are coming from safeway. it really has impounding affects. we are launching a petition to bring in another affordable grocery store. >> san francisco attorney brooke jenkins is holding a press conference on bob lee's killing. >> they asked that we continue the chordate until she returns. the judge did go ahead and order without prejudice that he be held in custody without bail . on the 25th, we will revisit that motion where we will argue that he should remain in custody the entire time that this case is pending. at this time, i'm happy to answer any questions regarding procedures or anything else. >> can you talk about immunity?

we have seen some of the revelations about moments leading up to this. will it appear to be rather enraged for the victim ? for the relationship with his sister ? talking about what the motive is and -- >> at this time, that is still a part of this investigation. as you are aware, this investigation is still very much ongoing and act. what we have at this point, and what we have been willing to release to the public, it is the fact that mr. momeni does have a sister with whom was connected to mr. lee , and apparently is what connects the two men. at this time, we are not revealing any more than what is contained in our motion. >> in those documents, it talks about some sort of dispute. that is all in the court documents. can you speak to that at all? >> at this time, what we have revealed, mr. momeni and mr. lee were both at the millennium tower, which is where his sister provides resides with

her husband. in the early morning hours, they leave the millennium tower together. they are seen on video leaving the tower and getting into mr. momeni's vehicle. they then proceed to drive at is e bing takes place. >> was the kitchen knife taken from the tower? that we are releasing is that a kitchen knife was located near the scene of the stabbing. we are not revealing anymore at >> [ inaudible question ] >> i was not in court today and was not able to observe who was present. what i will say, it appears from the statements that mr. lee is somehow a friend of this woman , and that

is what the connection is between the two men. >> [ inaudible question ] >> at this time, it is still an ongoing investigation. that is all we are willing to reveal. >> the video shows mr. lee with something. it was documents or something. it looks like he was running with those. do you know if there was something taken from them? >> i am not aware of what video you have seen. the only video i'm aware that has been released is the one where he collapses. again, the facts as we have released our what

are in the detention motion. i just think you need to be very careful about any facts that are coming from somewhere else at this time. >> [ inaudible question ] >> at this time, all that is being released is what is contained in that motion. there appears to be discussion as to whether or not she used drugs between the two men. at this time, that is all we have released. >> can you speak to the message that she had texted him about the dispute? the one

that the defender had with the victim? and also, basically the detainer motion says that he stabbed him, which was deliberate and planned. that is in the detainer motion, and left him for dead. can you address those two? >> as to whether or not there was an argument, what it appears from her text message, there was some type of dispute between the two men. at least that he was upset with mr. lee about something prior to them leaving her residence, and that she was attempting to check on mr. lee the following morning. that would have been subsequent to his actual death. at the time of the stabbing, yes, it appears that he did leave mr. lee there at the scene. as you know, we have all viewed a video of mr. lee attempting to call 911,

atng tofit esulwitht. to that left to die. >> the issue of being deliberate because he took the kitchen knife with him. explain why that is important. >> it is important, because it is to whether or not we are proceeding with the theory of first-degree murder, which requires premeditation, or second degree, which is a crime of passion. we are still very much looking at first-degree. this is a person who was in his vehicle with a kitchen knife. that is not something most of us carry around at all times. this was something he intended to do. can we just clear up one small thing. on one page, it talks about the witness and the big in his hotel room. in the next paragraph , leaving to go into his apartment. what

has happened? did he have an apartment? was the department quick >> i did review that. that was an typo. they went to the witnesses apartment. anou >> i cannot. we have not alleged any prior convictions. that is as much as i can say. >> we don't normally identify who our witnesses are. one, it is a safety issue. we also have confidentiality concerns. again, i have tried to is very much an ongoing you must patient. we still have more interviews to conduct. we would rather not expose our witnesses to the public at this time.

>> i'm not aware at this time of whether or not he would have survived. >> all that i will say at this time, he had a lawyer prior to his arrest. at this time, san francisco police are continuing to conduct their investigation into what they need to. that is the most i could say. you would >> [ inaudible question ] >> i cannot comment to the nature of their relationship prior to that evening. like i said, we are only 10 days into this investigation. there is much more to us out. the police are actively investigating.

>> we know he called 911, is there any indication of anyone else? >> the only call that i'm aware of is to 911. >> that is my understanding. >> did he identified as -- >> no, he did not identify who stabbed him in that phone call. >> [ inaudible question ] >> unfortunately, unless we find evidence of that there witnesses, that is something that we would not become aware of, at least in the toxicology, given the time that it took to make that arrest. >> [ inaudible question ]

>> i will not reveal details of the ongoing investigation at this time. of course, the police are trying to speak with any relevant witnesses who have any information about what went on during the evening hours leading up to mr. lee stabbing. you know, they are attempting to get as much information as they can. >> the witnesses apartment, was that the one on -- >> no, it was a different apartment. >> was he at the nversa the sister? >> that was telephone cosa and mr. momeni that the witness overard.

>> simply , today, the arraignment did not take place. his attorney is not in town right now. they have asked for a continuance. in the meantime, the court did rule that he will be held in custody without bail until april 25th. at that time, his lawyer can oppose the detention motion. >> the motion talks about -- it is tough to tell who is who in that. does that make prosecution all the more difficult? >> what i will say, i believe we can identify who is who . certainly, we would love to have clear hd quality video that shows a crime. that is not always the case. do el rticar

we have significant evidence to believe that mr. momeni committed this crime and that we have proof beyond a reasonable doubt that he committed murder. committed murder. >> obviously, that fed into this. with what we know now and what people -- >> i think justifiably so at the time that this happened, people felt unrest, right? they felt even more concerned than they already are here in a city that has residents and business owners who have public safety as their top concern. they will take each and every day that they do not feel safe. that is something i very much acknowledge and understand how this will contribute to those families. i think now we know the facts and that this is somebody they

knew, this was a targeted killing, that it does not -- this is not indicative of the state of affairs here. that doesn't mean we still have a lot of work to do from the public safety standpoint. i still think mr. lee's murder fact there's into that equation. >> [ inaudible question ] >> that is what we believe, yes. i have not heard any response from him regarding his tweet, or my comments. >> yes. we issued a warrant.

my offices issued the warrant for his arrest, so the charges were filed immediately through that. >> [ inaudible question ] >> at which location? so what i offered thus far is that the two men left an apartment in millennium tower prior to the stabbing together. they got into his vehicle. he was driving. they ended up in the area of the stabbing. that is where they exited the vehicle. proximally five minutes later is where the stabbing took place. >> you're watching right now san francisco-based district attorney -- brooke jenkins . between the victim bob lee and the defendant, nima momeni is his sister. she did not give
