4:31 am
night. at least two people were killed. more than 23,000 customers were without power or electricity, rather, throughout the state. one local tv station said two residents rode out the bad weather in a man hole. the storm also brought hail to central parts of the state as part of a larger system impacting millions of people across the central u.s. and this morning, americans still have full access to the widely used abortion pill mifepristone, but that could all change by tomorrow night, that is depending on the supreme court. jarred hill is in new york to explain all of this for us. good morning. >> reporter: good morning, anne-marie. this delay was kind of unusual here. the justices are not yet considering the merits of this case, should mifepristone be allowed -- rather, should they shake up the status quo while that bigger question moves its way through the courts. soon the u.s. supreme court could take its first major action on abortion since overturning roe versus wade last year.
4:32 am
yesterday, justice samuel alito extended a temporary pause keeping the abortion pill mifepristone available nationwide for at least two more days. it gives the high court more time to consider emergency requests from the biden administration, as well as drugmaker danko laboratories, looking to halt an appeals court ruling that imposed restrictions on the pill. >> for them to say on wednesday, actually, we need more time, it's all unusual. it suggests something is happening, we just don't know what. >> reporter: the standoff over mifepristone started when texas federal judge matthew kacsmaryk, a trump appointee, sided with a conservative legal group this month ruling that the fda improperly approved the medicine 23 years ago. last week, an appeals court said he went too far. it kept some restrictions in place. the biden administration argues that one judge cannot decide abortion policy for the entire country. the american medical association says the implications go beyond the issue of abortion.
4:33 am
>> we just think it's incredibly reckless to up-end our entire drug approval system in this country. >> reporter: the fda says since gaining its approval in 2000, more than five million pregnant people have ended their pregnancies with mifepristone. and yesterday gen biopro, the only manufacturer of the generic mifepristone filed a lawsuit against the fda in an effort to keep that medication on the market. back to you. >> jarred hill in new york. thank you. three people have been arrested in connection with a mass shooting at a sweet 16 birthday party in alabama. authorities say a 20-year-old man and two teenagers are charged with reckless murder after saturday's shooting. four people died, and 32 others were hurt. the girl who turned 16, alexis dowdell, said that she doesn't know the suspects or why they allegedly opening fire. >> i don't have no clue who they are at all. >> reporter: never heard of them before? they weren't invited? >> no. >> reporter: did you see them that night?
4:34 am
the lights were off. >> uh-huh. >> investigators say they can't talk about a motive right now as the investigation continues. and there are new developments in several other high-profile shootings in the u.s. the white 84-year-old kansas city man who shot a black teenager pleaded not guilty to two felony charges. authorities say an true lester shot 16-year-old ralph yarl who showed up at the wrong house to pick up his brothers. yarl is recovering. an upstate new york man will remain in jail on a charge of second-degree murder. kevin monahan allegedly shot and killed a 20-year-old woman saturday night as she and her friends pulled up in the wrong driveway. and in texas, a man was arrested after he allegedly shot and wunded two cheerleader who got into the wrong car. it happened tuesday in a grocery store parking lot near austin. one of the victims was taken to a hospital in critical condition. a possible bombshell in the federal criminal investigation into hunter biden's tax returns.

4:36 am
>> what we're doing is is being completely cooperative. >> reporter: that was biden two years ago after the department of justice opened an investigation into his finances. the fbi collected what it believed was sufficient evidence to charge biden with tax crimes. and last year sent findings to the u.s. attorney in delaware. since then, silence. why can't your client talk to us directly at this point? >> there are laws that provide protection to whistleblowers, and he has to navigate that. >> reporter: lytle sent this letter to congress claiming his client could provide information that would contradict sworn testimony by a senior political appointee. >> i promise to ensure that he's able to carry out his investigation. >> reporter: cbs news has learned that was attorney general merrick garland who gave testimony about the trump-appointed u.s. attorney in delaware conducting the hunter biden investigation. lytle says neither he nor his client are motivated by politics.
4:37 am
would you find any evidence or allegation of a political agenda? >> no. to him, the truth is one truth, and he wants to come forward with it. >> reporter: lytle told us the whistleblower has been with the irs for more than a decade, and has extensive documentation to support his allegations. >> the things he's been through are very well documented in emails and other communications with the department of justice. >> reporter: we asked mark lytle if there's a chance his client can only see his slice of the investigation and not the big picture. he said that's possible, but that his client had expressed his concerns to superiors a number of times before seeking whistleblower status. neither the irs, department of justice, or a lawyer for hunter biden would comment. jim axelrod, cbs news, new york. well, breaking overnight, one of the deadliest tragedies in years in yemen. officials say at least 78 people died and dozens of others were
