the fire commissioner was not in court today, the da said he does need to show up for a preliminary hearing or she is going to have to drop the assault and battery case, that case is pushed until tomorrow. this new evidence is coming from the public defender's office and it could change things. don carmignani claims that garrett doty attacked him when he wouldn't clear out of a small encampment in front of his mother's house in the marina district earlier this month. the public defender said that don carmignani pepper sprayed him first. this video just released by the public vendors office shows a man alleged to be don carmignani walking toward a sidewalk holding something and the man immediately appears and covers himself with a jacket as if he is trying to protect himself. he scares off the man with the jacket, the public defender's office is saying there are eight different police reports saying that somebody with the same description as don carmignani , indicating he was the aggressor. the public

defender's office believes he is the person in this video taken in november 2021, he is hitting another man, who police believe is don carmignani, he walks up and sprays him with something. >> the first thing that mr. garrett doty does when he realizes it is mr. don carmignani coming at him, he ducks out of the way with his coat covering his head. implying he knows and has been subjected to the violence of the bear spray in prior incidents. >> in the original case against don carmignani's alleged at s her he was not able to testify today. he was asked about the latest revelations from the public defender's office, this is what she had to say.

it comes to the road. they are 11 and 30, 11 wins and 30 losses when it comes to the last regular-season on the road. not great. both teams have done a great job of protecting home-court in this series. steve kerr was asked about their struggles on the road but he was staying optimistic. >> i look at games one and two in sacramento, and despite not playing very well , especially offensively and turning it over, we gave ourselves a chance by defending in the half court, and i think that is what is different about the team right now. rather than saying well it has been this way all year, we are different now. we are much better defensively. >> reporter: i like the way he is looking at things right now. he also says the warriors have to take care of the ball and rebound. the dubs took care of that game three and four, let's see if they can do it again in game five. fox was at practice

yesterday, he had a pad on that fractured finger but he said he is most likely going to play tonight. we mentioned there is a lot of purple around us, but we have seen a few warriors fans, we just talked to somebody who lived in san francisco, he moved to sacramento but he is supporting the warriors to the very end. >> it has been a roller coaster, you know? sacramento is a great team and they are putting up a great fight. it all comes down to this game, that is when the momentum is going to shift. i'm super excited about sacramento being in the playoffs after so long, but it's super exciting, everybody is supporting the team. i'm still wearing my warriors and i get yelled at all the time, but we are going for five this year. that stands for downtown common area here in sacramento. for the fans who are looking to come out, you are looking at about $200 for the cheapest tickets

we can do that, just now chokes. >> is a possible to change the heart and mind of an officer who thinks that way? >> when you see this kind of rhetoric and hate speech, can you really undo that? that is a hard one. that is a hard one. i don't know. i would like to think you can to some degree. to some extent. but, what we are seeing here is clearly individuals who are harboring some deeply rooted personal issues, i think. those are some systemic issues hat they have to er: would it for you some of those back on the streets and 8 trust them? >> do i trust them to go back on the street and protect the

community ? based upon what is written here, i would say that trust has been breached. >> reporter: when he took the job, chief ford said white men made up a vast majority of the force, while the city's population is 55% black and latino. diversifying the department is one of his priorities. >> we are all comfortable with that which we know and the inverse is also true, that which we don't know creates instant discomfort, we have to be enal about going after those communities that have been underserved at finding value in them and serving and protecting them at the same threshold that we all do in other communities. we are going to correct those mistakes and move forward and do it in a very meaningful way. >> reporter: 38 of 99 officers, more than a third of antioch pd are under investigation and on paid administrative leave. the chief has reorganized the force and is making it work for now.

if needed, he will call in help from surrounding agencies. >> we do have a diverse workforce, is the city still in a position where we have the number of personnel to keep the city safe around the clock? absolutely. >> reporter: what can you say about your trust in the remaining officers? >> i'm going to say pointblank, the bulk of the officers in this organization have been great. they are hard-working officers, that is the first thing that i noticed when i got to this organization, their commitment to the profession. there's a lot of dedicated men and women who work here and really take this serious in terms of public safety. i have to trust them because there is work to be done. and policing is the ultimate team sport. >> reporter: he came to antioch after 33 years with san francisco police, the racist text messages were sent before he was hired. today is his one-year anniversary on the job in antioch. this doesn't have to be your bottle, you can walk

deliver groceries to more than 13,000 households, 72% of the people getting help our older adults. each bag has at least 60% fresh fruits and vegetables but, now that program is in danger. joining me to talk about what you can do to help out in your community, seth harris . what is happening? why is it in jeopardy? >> thank you for having me. the program serves over 30,000 participants each week as mentioned, and when the driver comes and picks up groceries from any of our locations, they are picking up bags of fresh produce, spinach, onions, green onions, garlic , and delivering directly to the doors of program participants, people who likely wouldn't come to the food bank directly to get food in many cases. so these participants, they might be a senior in a wheelchair with mobility challenges, it might be a mother with young children , that has transportation charges with

work and a lot of other commitments going on. but, not only are the drivers delivering groceries, they are creating connections and building the community. >> when i did the drive in november and much of december, i went away from the experience thinking people are not only fed physically but spiritually and emotionally as well. what is the payoff going right to their door and giving them what they need? >> absolutely, there are many folks who have barriers, there might be things getting in the way like commitments, schedule constraints, disabilities, ysic it accessible is one of our goals. >> so, why is it in jeopardy? what is it about what goes on that makes it in jeopardy right now? >> for the last 3 years, we had to deal with the change of landscape after the shelter in place went into effect. many

weather. >> temperatures are warming up for much of the bay area, except for the coast, the marine layer has kept the warm air further away. the warm air will continue for another day, and once this peaks tomorrow, we are still going to be above average, especially inland as we finish the work week friday and heading into the weekend. for the bay area, 15 to 20 degrees above average on thursday afternoon, 10 to 15 degrees above average around the bay but barely above normal around the coast. friday we wi bring ck down a little bit, can still see siica what is pical.a little bit of a change on saturday especially around the bay and even on the coast, below average temperatures. once the pattern shifts, which is going to happen sunday with breezy conditions and a cooldown, it'll kick in monday, we will see an unsettled weather pattern shaping up next week with a chance of showers

tuesday, wednesday and thursday. that is typically what we see in the month of may if we get any rain. it is not going to amount to a lot but you will watch the pollen in the atmosphere, no such luck in the weekend , we are locked into the medium to high category all the way through sunday. looking outside, there is that compressed but stubborn marine layer, the fog is making his way through the golden gate. we did hit a high in san francisco earlier today, in the mid-70s right now in oakland with temperatures further inland in the low to mid 80s. if you are heading out to the giants game this weekend, the temperatures are going to be about where they are right now by 5:00 but down to 60 degrees for the first pitch . if you are going a little bit further to the south, you will be participating in the warriors watch party as they take on the sacramento kings, they have similar temperatures around 60

degrees with temperatures steadily coasting down into the 50s. we are tracking some fog tonight around the bay but that should dissipate quickly and we will warm up from a decent start, temperatures in the low to mid 50s in most locations, the cooler spots in the upper 40s. high temperatures tomorrow, mid 60s along the coast, but otherwise 80s and 90s, san jose close to a record. the warmest spots around brentwood reaching up to 93, but nowhere near that warmth around the bay. mostly 80s for the north bay until you go farther north where you will find a few spots around 90 degrees on 27 april. the temperature drop is kicking and already for san francisco and oakland especially through the weekend, but we won't get to below average until early next week. we have a couple of days with rain chances in the forecast, not likely to amount
