the circulation, on again, off again showers. we are not done with this until we finish tomorrow. we will probably see more widespread rain the first part of wednesday. we will look at that in more detail and i will show you what happens when it leaves coming up in the complete forecast. the attorney for the man accused of killing cash app founder bob lee addressed the drugs found in his system. anne makovec is talking about whethe it can play a role in the case. >> it will. nina momeni her client appeared in court. his arraignment was continued for a third time. here he is inside o the courtroom. it was a quick appearance with the judge ina hiattorn ll ead noldg f t thcase. prosecutors meni stabbed lee to death on april 4th after a dispute over momeni's sister. court document

indicated momeni was concerned she was doing drugs with lee. w got the medical examiner's report which showed lee died from his stab wounds. it showed he had alcohol, cocaine and ketamine in his system. momeni' lawyer says it will play a role in the case. >> bob lee's system is like the walgreens of recreational drugs >> san francisco district attorney brooke jenkins said that she is used to defense attorneys attacking the victim and that the toxicology results won't change the charges. >> regardless of whether somebody has or has not done drugs, that does not give someone a license to kill them. we are going to continue course with the facts that we know because we believe that regardless of whatever that toxicology report may show, tha mr. momeni is guilty of murder. >> in the united states you hav the right to a speedy trial. th d.a. says that men's momeni can delay the arraignment as long m

live, defense attorney and former prosorbrass. you heard the two perspectives. you have momeni's attorney talking about bob lee having a lot of drugs in his system, showing their hand there. then brooke jenkins saying what he has in his system does not in a begin the fact that he is dead and was murdered. how does this get handled. >> from a prosecution standpoin you do not want the plot to thicken. and it is thickening. and it gives context to the defense. brook jenkins is correct. defense attorneys ofte will blame the victim. but that's too broad a brush. what defense attorney does is you want to make things more complicated. we want to add mor complexity to the case. we want to ask questions to raise a reasonable doubt to have a jury sa y,what know about bob lee. it makes the victim in the case less

relatable that he has ingested all the drugs. did he have a drug problem, one time? how often did he ingest drugs. what does that mean in terms of the conflict with mr. momeni and what type of person was he. so far the narrative from the prosecutor is that he is a successful hard working so of infidelity with mr. momeni's sister but all we know is sun. inge by mr. lee. that does add a layer of complication. from a prosecution point of vie -- >> go ahead. why does this make a difference. forgive me, i cut you off. >> not at all. why does it make a difference? why does bob lee partying and ingesting drugs ad any level of complication? the truth is it doesn't mean a person deserves to be murdered and that person is somehow less of a victim because they have a

drug problem or a partying habit. in the end, prosecutors are trying to keep the distractions to a minimum. it's not the preferred scenario to have this medical examiner's report. from d.a. perspective, not what they were hoping for but can be overcome. from a defense perspective where it looks like you have motive, opportunity and a murder weapon and now another angle on the story, something that makes the story not quite so simple, it's in those details that a reasonable doubt can sometimes exist. that's what a defense attorney will look for. >> that's what they will go for for sure knowing that a jury wiar thank you so much. we will have continuing coverage on air on cbs news bay area and all the time on kpix.cher stories we are

following from around the bay, prosecutors declined to file murder charges against the private security guard who police say shot and killed a shoplifter at a walgreens last week. d.a. brooke jenkins said there is evidence that the security guard acted in self-defense. last night community activists gathered in front of the walgreens store to remember banko brown, the man that was shot and died in the violence. nordstrom says they will close the store at west field mall in san francisco. another blow to the area. it has been there since 1988. they confirm that they will not renew the lease this year. they plan to shut this summer. not the only part of bad news. the nordstrom rack across the street, that is also going to shut. this is the latest in the string of retail closures affecting the downtown area. west field sent us a statement that they are frustrated. the downtown area i deteriorating. we urged the cit

month of special stories celebrating you, the community and the history and televisions of our beautiful aaip community and raise awareness about the alarming incidents of hate. the national coalition stop aapi hate says they got more than 11,000 reports of hate incident across the country over the course of the pandemic. so, how do we stop it? rally around eac other? keep each other safe and protect each other? one solutio is happening on the streets of oakland's chinatown. >> reporter: a deterrence by walking. this group puts in the steps everyday to keep the community safe. >> stewards of the community in a sense. they make people feel safe, comfortable. with all of the things that the community has been through the last coupl of years, it relaxes everybody. >> reporter: mark low considers

himself new to oakland. his passion for keeping oakland's chinatown safe is just as strong. >> wanting to do something to help the chinese community, i was active in san francisco where i grew up as a kid. this was a way to give back. >> reporter: the foot patrol is sponsored by the city. members gather for their walk and they are known for the orange uniforms and established deep connections with oakland's chinatown residents, business owners and the oakland police. these relationships and the visibility played a part in thwarting crime and makes the difference for safer streets. h hasn't seen a significant crime event on patrol for months. >> more trusted than regular police officers. more stuff use to happen a year ago on our routes than happens now. >> reporter: mark may not speak chinese but he formed a relationship through luna, the unofficial mascot. >> luna helped a lot. she got i

the community before i did. she doesn't speak chinese either. she is cuter than i am. >> reporter: the group consider themselves an extra layer of eyes and ears in a community sparked by hate. they are not afraid to step in. they thwarte harassment by using their quick with it. >> most of the our role as deterrents, having cameras, cal the police immediately, making noise. >> reporter: mark describes an incident where an elderly asian man was being harassed and the group stepped in. >> the volunteers ran to the scene of the crime. it was kind of dangerous. i stayed back wit luna and contacted the cops. we were able to corner the perpetrator until the cops got there. >> reporter: the tactics appear to work. store owners say they feel safer when they see the

it seems pro sports teams are leaving the area, a women's pro soccer team is moving in. the national soccer league awarded the expansion right to the 14th team to a bay area investment group. four soccer legends are part of the effort. the team will likely share the san jose earthquake stadium. what will it mean to have a pro women's team in the bay. >> reporter: alexis has been playing soccer since she was 4. she is 15 and captain of the club team with the san jose rush. alexa said soccer is like

therapy to her. it remind her where she came from and where she can go. >> when i step on the field, it brings me a lot of memories. when i was little and, like, what the future tells me. i can be better. >> reporter: alex ex has seen professional women soccer matches on tv and would love to get to that level. her favorite player. >> alex morgan. >> reporter: when she heard the area was getting a professional team, she couldn't believe it. >> wow. i found it surprising. think it's cool. pretty cool. >> reporter: the nwsl team is expected to kick off next year. the san jose rush coaches say having the team in the bay will inspire a whole generation of girls like alexa only take up soccer but see firsthan where the sport can take them.

>> it's a win-win situation. wh doesn't want to go to a stadium and see a professional -- professional soccer girls. girl and mamas and the little girls have their own idols. >> reporter: alexa told me watching the women teams on tv is an inspiration. she can't imagine what it would feel like to see them in person, especially her favorite player, alex morgan. >> would love to watch her, som day. >> reporter: until that day, alexa says she will continue leading the club teamworking on her skills to hopefully one day join the ranks of those professional athletes. two major women's pro socce teams called the area home in the past, cyber rays and gold pride. a bay area nonprofit needs your help. where these toys and hopefully a lot more
