district attorney to release video of the encounter. between banko brown and the armed security guard who tried to stop them for shoplifting. describing banko as a black transgender man who was an organizer with the young freedom center, struggling with homelessness for years. julia arroyo was among the crowd who marched to city hall on sunday. >> we proved to this black tank cent young man as we say it is all of us collectively as a community in san francisco as we prove to him that he was not safe. that he was not safe to go inside that store. >> reporter: this past weekend, brooke jenkins said the guard would not be charged with murder, citing evidence of reasonable self-defense. her office is not releasing the video because it's a part of the investigation. >> unfortunately i are this

happened. >> reporter: supervisor matt dorsey whose district includes walgreens on market said he plans to have conversations with the d.a. and chief bill scott, before deciding how he'll vote on the board resolution, urging release of the video on tuesday. i understand the d.a.'s concerns about publicly releasing video evidence while there is an investigation underway. that's the practice i've seen the police department do in the past when it is in the public interest. in fact that's sfpd's standard procedure for officer involved shootings, having worked in investigative offices for most of my career. i'm generally inclined to refer to investigators. >> you know, black youth deserves to feel safe in san francisco and poor and trans youth deserve to feel safe in this city. that's what we want to happen here. >> reporter: a similar sentiment in new york as hundreds of people protested the death of 30-year-old jordan

neely, choked to death on the subway a few nights e minutes. nhattan district attorney said their investigation is ongoing. redwood city police are investigating a shooting that happened early this morning on redwood avenue. a man opened fire on a group of people drinking on the sidewalk around 4:30 hitting five of them including a 16-year-old. all were taken to the hospital with serious, but non-life threatening. no word on a motive or an arrest. in washington tonight, dianne feinstein's absent from the u.s. senate is stalling an ethics to impose an ethics code on the supreme court. it all happened after finding out justice clarence failed to disclose potential failed of interest when he declined to testify at a hearing on the matter. now the judiciary senate committee wants to subpoena roberts to testify, but they need her vote. feinstein has been absent since

she came down with a case of shingles and her allies are getting impatient. >> i want to treat dianne feinstein fairly. i want to be sensitive to her family situation and her personal situation, and i don't want to say she's going to be put under more pressure than others have been in the past. but the bottom line is the business of the committee and the senate is affected by her absence. >> they want to replace feinstein's seat in next year's election has heated up. hosting a meet and greet in san francisco. adam schiff and barbara lee also running. there are republicans in california, but one hasn't been elected to the senate here since pete wilson in 1988. we've been reporting on so-called food deserts here in the bay area. they're places that lack basic food resources like neighborhood grocery store. typically in lower income communities. but thanks to programs like the weekly farmers' market in west oakland, people are getting

help. devin fehely has more. >> reporter: this area has been neglected for many years. >> reporter: each sunday the west oakland farmers market transforms this area into an oasis of fresh fruit and vegetables. in a neighborhood known as a food desert. >> it's a any,owing mmun d a ve diverse community. yet there is not a lot of places for people to hang out, so the farmers' market will serve as this community gathering place. >> reporter: the west oakland farmers' market is nearing their one-year anniversary and flourishing. and the business partner want to build on that foundation with a food haul. >> we want the farmers' market to have synergy with the food haul and be an incubator. you know, several of the vendors here have expressed interest in becoming a part of that. >> reporter: where the farmers' market is basically a pop-up, the food hall, which is scheduled to open this fall, they would have more permanence

and would feature cafes. the plan is to feed the body and nourish the economy and the soul of the west oakland community. >> the food hall is an extension i feel with the farmers' market, but more of a permanent place. other news, the oakland teachers strike will continue tomorrow. it will be the third day on the picket line after another failed day of negotiations. the district has moved a bit on compensation demands, but the union says they have not addressed their so-called common good items like grand spending, housing for homeless students. mental health services, and subsidized transportation. >> the reason why we have expanded the scope of what we're bargaining because the job has become different. the needs of our students have become different. so we're seeing high rates of learning, sociolearning support that's needed for students. >> and the superintendent says she agrees with the issues that are being raised, but the money

is not there to support everything the union wants. meanwhile down in san jose, controlling crowd celebrating cinco de mayo is being called racist and unconstitutional. >> as len ramirez reports, there is now an investigation into why offramps to east san jose were shut down. san jose police have used a variety of methods to try to control the crowds celebrating cinco de mayo. but this year's tactics of block several freeway offramps in the east san jose in the downtown are being condemned and investigated. >> some of the information that we've seen and read so far from cal trans is that they believe that their orders or their charge was specifically to stop people from the east side from going into downtown san jose. if that's not racism, i don't know what it is. maybe it's geographic red lining. maybe it's a stigma on the entire east side on any particular race or ethnicity. whatever it

is, it is unacceptable. >> reporter: announcing several diversions would be taken place over the cinco de mayo weekend. over a statement they defended the tactic, "traffic diversions not only facilitate the flow of traffic, but also reduce the likelihood of disturbances that can escalate into violence. closing off sections of the city had consequences for david hernandez who held a festival to benefit the homeless." >> a lot of the 87 exits were closed. a lot of the participants were coming from south san jose, having a hard time getting here. so yeah, it definitely affected our participation. >> reporter: david betancourt has cruised his low rider in san jose since 1976, saying it is tough for people cruising their cars, but worse on the people who live on this side of town. >> how they get home from work and how do they go pick up their children if they have to pick up their children and how they get around. blocking off the streets is more of an inconvenience for the citizens of san jose. >> reporter: although traffic

hunter park will be closed this week for wildfire training. fire departments from three nearby cities will be preparing for wildfire season. this will happen on monday, saturday, from 9:00 to 4:30. people can expect to see trucks and hear equipment as well as see helicopters landing and taking off. while they'll be doing it in mostly good weather except for tomorrow. >> yeah, except for a limited window tomorrow morning where the sky will be gray for the morning. it will look like there is another weather system coming through and there will be light rain. so let's look at that first. then we're going to move on because the monday morning rain is not the most exciting part of the forecast.

it's the warmup that's coming our way towards the end of the week. but first, yeah, first alert doppler will see a lot of rain on the coast and the futurecast will pick up a lot of rain there and bring that forward, trying to pull out the details on this. it is barely making their way into the sonoma county line by 2:00 in the morning. you see the light showers there? well watch this, there's the 2:00 hour. we just kind of take it through the morning and it doesn't hold much into anything. but if you get a drop of rain on the windshield tomorrow, that'll be it. it wouldn't be the kind of rain to slow things down really. it shouldn't any way by a whole lot if you look at the rainfall totals. it's barely enough to measure and doesn't show up here for the forecast. anything more than a hundredth of an inch of rain. so that's it from 2:00 a.m. through about 9:00 in the morning by the time it clears the south bay and a few clouds left over tomorrow. the daytime highs will warm up to the mid to upper 60s. we will go to 68 in san jose and the upper 60s in concord. a look at the forecast as we go to the 6 to 10-day forecast and

look at that map that will show you the degree of confidence, the warmup coming in that period and a big bull's eye were included in that. if we wanted to get specifics, well, we'll be above average that we can start looking at how far above average might we be? this is focused on saturday. saturday will be kind of the peak. if we take the map that's colored now to show you where we are in terms of below or below average that we have been below average for a while. let's let that play forward on sunday, monday, tuesday, wednesday, thursday, it'll start going red and orange and by saturday, it's at the deepest shades. coming for a close up look to put some numbers on there. in general, most of us from 10 to 12 degrees above average by the time we get there. and let's see what that actually looks like for the daytime highs. those are saturday's numbers. now we're seeing the potential for some 90s to come back on saturday with livermore, concord. 86 for san jose and santa rosa. we'll go in order because that's still several

days away. we'll start out the seven-day forecast and show you tomorrow we're still doing the mid-60s. not a whole lot of change here just yet. but as we look towards the wednesday, thursday time frame, we'll see that warmup coming in. san francisco and oakland is up first. oakland, by the time you get to friday, you're looking at 80s. and you're going to 86 in the south bay valley. there is a noticeable jump. san jose, look at the line there from friday to saturday. so friday is the day that you're going to notice this. from 69 on thursday to 78 on friday and then you jump to 86. so there is like a two-day period there where we take some big steps in the numbers. the inland east bay numbers is a good example of that. by thursday it's 73. by friday, it's still really nice at 81. by saturday, you jump right to 90. so that's where the forecast stands for now. noticeably warm to downright, i think we call 90 degrees hot at this point. i think that's probably fair. i know it'll probably get hotter than that, but we're
