. a battle over the rainbow lights for pride. why they are at odds over the colorful display. from kpix, this is the late news with sara donchey on cbs news bay area. hello, i'm sara donchey. th colorful kick off to pride weekend will light up the night sky tomorrow. former house speaker nancy pelosi will be on hand for the grand lighting display titled "welcome" now, a battle is brewing between its creators and an artist that insists they copied her work. here is a shot of each, side by side. tonight we spoke to both

parties. >> reporter: to some it might look like beams of light but fo some, this is her signature work. inspired by a real life rainbow she saw dancing across pond in massachusetts and spurred to life later by the election of president barack obama. >> i relate very much because i am mix raced like barack obama and i think a lot of people of color were just jubilent to finally see something like this >> reporter: titled global rainbow, first displaying the light insulation in 2009, projecting across downtown manhattan on martin luther king day. >> i just wanted to do a work that had nothing to do with division. i wanted to do with work that had everything to do with inclusion and togetherness >> she took her work all over the world tauting it as a symbo of diversity until someone told her about a display in san

francisco, lasers called welcome. >> i was very upset. i was like this is my work. like what is going on? and, and it was, honestly had always been a drea of mine to present my global rainbow in san francisco. so, i was kind of double whammy. >> reporter: it was presented b illuminate, the nonprofit behin the bay lights, a massive led light sculpture that sparkled along the san francisco bay bridge. she reached out to its founder adamant they credit her for the pride display. which sh says she has a copy the right to. >> she is wrong. it is not anywhere near what she has ever done. >> reporter: ben davis says he did nothing wrong and points to the group's website that list a

an artist that came before us. little consolation to her who says she lawyered up and sent letters. >> i was like no. i am not a historical contributor. it is m work. >> i think many works in the relm of art can be considered similar, does someone own the right to take a laser beam, tur it into color and say that is mine and no one else in the world can do it? i don't think it. >> ideas are not protected unde the law but the way an artist expresses them can be. >> it is the difference between again, the idea. and lasers an something that is going beyond that that is expression that is something that the artist has created that goes beyond that mere idea. >> if he does not credit me as

the artist of this work, i will take him to court because i wil not accept this. i just won't. >> well, illuminate is set to debut "welcome" tomorrow night. they note this year's display should have double the amount o lasers as last. you might remember gilbert baker. the man responsible for the pride flag, the rainbow flag, he made sure the symbol o love and inclusion, rather, could never be used for profit whefn it was the san francisco pride committee trying to copyright it. he wanted everyon to use it to express themselves we turn now to oakland for disturbing story. a man that ma have been delivering flowers to an apartment was shot and kille outside of the building. we talked to neighbors who was seconds away from getting caugh in the middle. >> many that live in the apartment building on 26th street are still shaken by what happened. those that i talked

with say everything moved so fast after the two men got into some sort of confrontation. >> one really loud bang immediately followed by the victim, you know, screaming, help me. >> reporter: chris was just seconds away from being in the line of fire. he was out walkin his dog, just around 6:30 on wednesday night. as soon as he entered his apartment building he heard the sound of a gunshot >> it happened really quick. like, the altercation started down the street apparently ther was a little bit of a disagreement between two people it just escalated, you know, really fast. >> kpix obtained this footage from one of the residents looking down on the incident after the victim was shot. he was seen laying on the ground being helped by several bystanders. >> from the shot to the time he became unresponsive it was abou two minutes. it was very, it wa grim from the get go. >> according to the oakland

police department, officers treated the victim until medica personnel arrived. he was later pronounced dead. the victim was delivering flowers and made a comment to a man passing by. th verbal exchange ended with the victim throwing the vase and th suspect firing a gun. bret was about to walk out the door afte the incident unfolded. >> it is kind of scary. i walk out to the store right here all of the time. i kind of, it hits me when i am trying to think, could it happen to me? it is not, not a good feeling. >> reporter: those living at this intersection of 26th and telegraph say for the most part it is a fairly quiet neighborhood. this incident serves as a reminder to many that crime can happen any time anywhere. >> you know, you can not contro where crime is. so, all you can do or the way i look at it is, like, always keeping your had o a swivel and being aware of you surroundings. >> reporter: investigators are

still looking around the circumstances around the shooting. anyone with information is asked to call th oakland police department. we have breaking news just in the from san francisco right now. a deadly shooting at the powell street b.a.r.t station. paramedics rushed the victim to the hospital but were told he died there. no arrests. the police did not say what led up to the shooting but they said they did think it was targeted. safety is something that b.a.r. officials have been thinking a lot about, lately. the b.a.r.t board approved a pay raise for police officers to try to win back riders. that stems from a survey where riders said they want more officers patrolling training to make them feel safer. >> safe to say it has been a busy 24 hours for the warriors with a new big name headed to the bay and their latest draft pick decided. vern is here to break it all down for us. a lot of reaction from different camp on this today >> 97 this own building >> yeah. >> there was a lot of reaction on what happened. the warriors, they are on the clock way befor

weekend into next week. if you are ready for summertime temperatures, you just have to be patient. the six to 10 day out look from the prediction center takes us through late june and july. taking us all of the way through the fourth of july holiday and both show a good chance of above normal temperatures. specifically for inland parts of the bay area. not going to warm up that much around the bay. if you are read for 80s, 90s showing up, you will have to wait. just above 6 degrees in san jose. that is th warm spot on the map. the fog, spreading out. widespread as we start the day on friday. fog an low cloud cover jumbled together. a gray start nonetheless. backing up to the coast. sunshine, inland, along the coast you are going to have a hard time shaking that fog an low cloud cover. temperatures tonight, dropping down to the lower to middle 50s. highs tomorrow, a good four or five degrees below average around th

bay. several degrees, close to 15 degrees below normal for inland parts. closer, near 60 along the coast, upper 60s, 70s down the peninsula and the sout end of the bay. lower to middle 70s. the temperatures inland in the east bay. near 70 much of the try valley, the warmest spots hitting the middle 70s. 60s around the bay, also, 60s for the north bay. the coolest location for inland spots because the fog will be more stubborn. now, heading out to the game against the diamondbacks, the temperatures will be cool. layer up. game time at 7:15. it is going to be in the upper 50s at that point. the fog will spread out. plenty of that june gloom hanging out. temperatures on the cool side a you would expect in june. a modest little warm up around th bay. only 3 degrees worth heading through the next severa days of san francisco and

. a lot of transit agencies have been struggling for years since the pandemic, basically, to get people riding again. the are pulling out all of the stop to boost their ridership. all you need is taylor swift. her stop generated 43,000 additiona bus and rail rides. atlanta saw three times the typical number of rail riders while she was in town. philadelphia preemptively hopped on board pushing public transit for people wanting to see taylor there. vta, are you listening, hello? because taylo is bringing her ares tour to levi's stadium next month. we all make mistakes at work.
