our nation's airports. what you can expect today. landmark ruling. the supreme court guts affirmative action in college admissions. the fallout ahead. plus, an historic out-of-this-world trip. we'll take you inside virgin galactic's first commercial spaceflight. good morning. good to be with you. i'm wendy gillette in for anne-marie green. we begin this morning with the supreme court's monumental decision to strike down affirmative action in college admissions. in a 6 6-3 ruling,g, court saia use of race to help determine if someone gets into a school violates the constitution. it means colleges and universities will be forced to change their admissions policies. jarred hill is in new york with the latest. good morning. >> reporter: good morning, wendy. president biden says that he's directed the department of education to develop a list of best practices to help colleges stick to their commitments to racial diversity. supporters of the court's

ruling, though, say this is a step toward equality. [ chants ] dueling protests outside the supreme court thursday. the court powered by its conservative majority ended the use of race-based affirmative action in college admissions. >> you cannot explicitly use race as a factor in admissions. >> reporter: writing for the majority, chief justice john roberts said admissions policies at harvard university and the university of north carolina violated the 14th amendment's equal protection clause, saying in part, "the student must be treated based on his or her experiences as an individual, not on the basis of race." in a scathing dissent, justice ketanji brown jackson, the first black woman on the court, wrote, "with let them eat cake obliviousness the majority pulls the rip cord and announces colorblindness for all by legal fiat."

the cases were brought by conservative activist richard blum's admissions arguing the schools discriminated against white and asian applicants like calvin yang. >> it is my hope to see a renewed college admissions system that recognizes and rewards the multifaceted talents and diverse perspective that each individual can bring to the table. >> reporter: chief justice roberts wrote that universities can still consider the discussion of how race affected an applicant's life, say in an essay. a notion that justice sonia sotomayor called nothing but an attempt to put lipstick on a pig. president biden slammed the ruling. >> this is not normal. >> reporter: while republicans praised the decision as ending discrimination. so this ruling does not apply to military academies or end legacy admissions processes. meanwhile, on this final day before the court's summer recess, we could get two more big rulings. one on president biden's student loan forgiveness program, another on lgbtq protections.

back to you. >> we'll be watching. jarred hill in new york, thanks. many people are set to travel today as the long holiday weekend gets into full swing. aaa estimates nearly 51 million americans will travel by plane, train, car, or cruise. kris van cleave reports. >> reporter: the fourth of july holiday weekend has a potential record number of americans hoping for independence from travel troubles. >> it's a lot. hopefully we make our flight. >> hoping that i can get to florida without any delays. >> reporter: aaa predicts the number of holiday flyers will soar 11% over last year. but the rush comes as airlines recover from a series of storms that delayed about 45,000 flights and forced the cancelation of over 8,000 more since saturday. united airlines is the hardest hit, canceling around 14% of its flights, and in denver a sea of bags wait to be claimed as a flood of passengers try to get somewhere else. >> my phone dinged saying that

my flight was canceled. >> reporter: madeline hardy left new york city on amtrak, avoiding the airport. >> with what's going on i have to be taking the train. >> reporter: on the roads, more than 43 million are expected to drive, surpassing the pre-pandemic fourth of july record. with gas prices on average more than $1.30 a gallon cheaper than last year. welcome news for dennis sanhurst who's hauling a camper outside los angeles. >> definitely have a little more money now to spend on the tourist stuff. >> reporter: and this moment -- after a passenger from phoenix left her passport on that plane, these british airways pilots in the terminal got hold of the guys on the flight deck who dropped her purse out the cockpit window as they pushed back for departure. vacation saved. >> amazing. she's going to get her passport. >> reporter: the tsa expects friday to be its busiest day at airports, screening more than 2.8 million passengers. that could be a post-pandemic record.

united airlines says it has seen positive improvements and expects its delays and cancelation numbers to continue to decline weather permitting. kris van cleave, cbs news, phoenix. many of those hitting the road today will experience poor air quality from those canadian wildfires. this was the scene in washington, d.c., yesterday. it had some of the most polluted air in the world -- nearly a third of america's population is feeling at least some impact. >> it's like way foggier than it would be on a normal day. >> reporter: but you still wanted to make the trip today. >> yes. we want to see the monuments because this is our last full day here. >> meantime parts of the south are being gripped by a deadly heat wave. more than 44 million people are under an excessive heat warning. home video captured a driver overcome by heat. luckily he's okay. at least 13 have died in the state from heat-related illness.

turning to the dramatic arrest of a man who allegedly threatened to blow up former president barack obama's home in washington, d.c. federal law enforcement tells cbs news the suspect was also wanted for the january 6th attack on the u.s. capitol. jeff pegues reports. >> reporter: law enforcement officials tell cbs news that the 37-year-old was spotted in former president obama's washington neighborhood. when police approached he ran toward mr. obama's home before being arrested with multiple weapons and explosive materials. officials were concerned because he had been live streaming threats in recent days that have since been deleted. his conversion van parked nearby was adorned with american flags and the words "patriots win" written on one of the windows. he was being sought by the fbi and capitol police for his alleged role in the january 6th attacks. >> it's very troubling. any time you have an individual

who is focused on an event like january 6th who is in a vehicle, who has apparently the materials to make molotov cocktails and he's in the close proximity to a former president. >> reporter: taranto is from washington state, but sources telling us he's been in the d.c. area for some time living out of that conversion van, and he's been spotted at the d.c. jail where many of the january 6th defendants are being held. jeff pegues, cbs news, washington. a former florida sheriff's deputy has been found not guilty for failing to act during the mass shooting at marjorie stoneman douglas high school in 2018. 60-year-old scot peterson wept yesterday after a jury acquitted him on several charges including felony child neglect. he could have faced nearly 100 years in prison. 17 people died during the massacre. peterson was the only armed school resource officer on duty

the mostst wonderfulul timeme of the yeyear. live clalaritin cleaear. a southwest airlines plane landed safely at hollywood burbank airport after a bird strike. the flight from las vegas was on its final approach to land yesterday when the collision took place. the plane sustained minor damage. a dent could be seen in its nose. there were no reports of injuries. court documents reveal a confession in a double murder case in indiana. and there was thick smoke at a new york city landmark. those are some of the headlines on the "morning newsstand." the "new york post" reports on a fire at new york city's iconic tiffany's store. smoke poured out from under the building yesterday morning. authorities say the electrical fire started in an underground transformer. it did not spread to the store itself. there were no customers in the store at the time, but about 100 in the building were evacuated as a precaution. two people suffered minor injuries.

there was some smoke damage to the outside of the building, but no reports of damage inside. the "associated press" says newly released court documents reveal that an indiana man confessed to killing two teenage girls. during an april phone call while in prison, richard allen allegedly told his wife he killed 13-year-old abby williams and 14-year-old liberty german in 2017. their bodies were found near a hiking trail just outside their hometown of delphi. residents were surprised when allen was arrested and charged with two counts of murder in 2022. >> this town has known richard allen for a long time, working at cvs. we've all liked richard allen. so my feelings are that he's innocent until proven guilty. >> allen has pleaded not guilty. his lawyers say his confessions are unreliable due to his deteriorating mental and physical health. and "the washington post" reports on the death of martin
