scandal. steven ford has only been chief for less than a year. he talked to our katie nielsen tonight over the phone and told her this was a difficult decision for him and his family but he does feel like he has made progress. he also put out a formal statement. part of it says he was grateful for the opportunity to serve and he mentioned his last day will be august 11th. now, all of this is happening as antioch police is being investigated by the fbi. that investigation uncovers dozens of racist and homophobic texts allegedly sent back and forth between officers for years. nearly half of the officers in the department have been put on leave because of it. now at the same time, we have learned chief ford is expected in court this week to testify about that scandal. ford was subpoenaed by criminal defense attorneys who say the department violated the racial justice act. several antioch police officers were also subpoenaed but at least five of them are fighting it saying they have industrial injuries

and cannot show up to court. the city has also been hit with a federal lawsuit for violating civil rights. andrea nakano spoke to some of the people going after the city about the chief's decision to step down. >> reporter: some believe chief steven ford was the right man to lead the department through this texting scandal but this news does not come to a surprise from one plaintiff we spoke to. >> just all the scrutiny and stuff coming into antioch police department. so everybody is trying to either run and get far away, or duck and hide. >> reporter: adam carpenter says he was arrested in november of 2020 for possessing a firearm. all the officers that made the arrest are implicated in the texting scandal. carpenter thought chief steven ford was different than the rest of the department. >> i was actually marching on the side of them at the last march. you know. to where it must be too much for him to

bear or overwhelming. >> reporter: chief ford came after the texting scandal came to light. shigufa khan who is also a plaintiff in the case believed the chief made great strides to mend relationships with the community. >> it is a sad day for the city of antioch. he was sort of our last hope. i mean, when he got hired to the job, he had a lot of positive initiatives, community engagement. respect. care. so him stepping down is just a slap in the face to the community. >> reporter: the charges against adam carpenter were dropped. the next court date in the texting scandal is.coming up friday. we also reached out to lamar thorpe to get his reaction. he declined an interview because he had not yet spoken to the chief himself. so the big question is what happens now to an already anemic department that is in

the middle of a major crisis? we spoke to district 2 councilmember mike barbanica who says even he was shocked by the news. he said it is the city manager's job to appoint a chief. but antioch city manager just resigned. his last day on the job was friday. the acting city manager could make the call, but the council will have to iron out all the details. >> it is very important to all of us to make sure that we immediately start this search to look for the right person for the job. whether that is someone on a temporary basis or long term, that remain to be seen. >> antioch city council will discuss the search when they meet next tuesday. now, our katie nielsen sat down for a one on one interview with chief ford back in april to talk about the scandal. at the time, he said he wanted to see the department through it. >> this doesn't have to be your battle. you can walk away. >> i can walk away now. but i

morning, police found a driver dead in his car. >> we have already returned foot patrols to many of our neighborhoods and we will be adding more officers in the near future. >> 57 homicides this year in oakland which is down from last year. we have heard a lot of people getting dropped from their home insurance because of the risk of wild fires. but one bay area family says they were dropped for an entirely new reason. a lot of us have never heard of it. and a lot of people hoping they would be a billionaire by now, but we are all out of luck. well, almost all of us. because someone just hit the power ball jackpot and it happened here in california. we'll tell you where. plus, some other people in the bay area also getting a piece of the pie. and an aggressive otter that managed to avoid being caught is serving as free advertising for some beach side businesses. and here it is. already after 11:00 at night, and you can still see it out there. all the haze. air quality is going

be the next billionaire after tonight's power ball drawing it's probably not you unless you bought your ticket in la. and even then, you are probably not watching this newscast right now. tom wait is in downtown la for us where one very lucky power ballplayer hit the billion dollar jackpot. >> reporter: we are in downtown la in the fashion district. and this is the store. appear to be a family owned store where this billion dollar ticket was sold. quite extraordinary. a very desolate section of the city at night. there's really no one out here right now. you can see the front of the store is closed. very non-descript shop. we understand this is the only billion dollar jackpot ticket that was sold. $1.08billion. that could be in 30 installments or they can take a lump sum payment of $558 million. there you have it. that is where some lucky person bought that ticket. and the family that perhaps owns that store also going to benefit

from that huge winning. >> oh my gosh, so excited for the winner. so excited for the store owner. now we don't know the winner's identity of course yet. but back here in the bay, three players still hit it big. where the first five numbers were a match. just not the power ball. still something to celebrate. one of the tickets was sold at this santa clara 7/11 store. two others were sold in san francisco and hayward. each worth nearly half a million dollars. again, something to be incredibly happy about. a lot of people in our state not so happy. they have been losing their insurance because of fire risk. but that is not the only reason. last week, we introduced you to people in berryessa estates in napa county. a lot of them lost their insurance because of high fire danger there. a viewer saw that story and reached out to us about their situation. their insurance was also dropped for an entirely different reason. wilson walker has the story from menlo park. >> oh yeah, we fell in love

hand side. you can see some hold houses. >> reporter: he is not aware of any other neighbors geting the same notice so he asked his provider what is considered old? >> any house built before 1970 they are rejecting just outright. >> yeah i think what we are seeing is insurance companies reacting to a lot of different forces. reacting to climate change. all the technology giving them a more vivid view of the homes they have been ensuring. >> reporter: amy bach is with an information source for consumers. she say it is industry is getting more cautious about which homes to insure and letters like this one are becoming more common. >> before the last year or so, i would have said to that homeowner don't worry about it. you'll find another insurance that will take you. but today, you know, the options just keep shrinking and shrinking so it is tough out there. >> yep, just shopping around. getting a bunch of quotes right

now. >> reporter: wendell says he is finding some options and not with outrageous prices. but he still can't understand how his perfectly normal home in the heart of the bay area would suddenly lose coverage. >> well, this was a surprise because we don't have a fire hazard. >> reporter: having a policy dropped because of the age of the home not unheard of, though more commonly associated with a place like san francisco where the home may be well over 100 years old. not 58. now insurers cannot-renew for just about any reason as long as they are not discriminating on the basis of gender or ethnicity. the only real requirement is that they provide the policyholder with 75 days notice. >> tough situation there. let's talk to darren because we have had our own weather situation. everybody is talking about the haze. >> yes. the fire burning in southwest oregon, it is

bringing smoke our way. if we switch to the live picture from a camera we have above the santa clara valley, you can see what the view looks like out there still. >> yeah. i know it's not the clearest camera you have ever seen. but it is even less high-def because of all the haze. >> i look at that and think what a perfect picture to illustrate what's happening. you see the imperfections. >> i do. i'm sorry. i'm negative. >> there is the inversion. >> you can see it. it is obvious. >> and look. wait until you see what happens next. i will show you what the air quality is like in san jose because san jose, our air quality is good. i am focusing on concord. we will bring in the chart. move the needle. thankfully, that needle doesn't have far to go. down on the ground, it has not gotten all that bad. we have an

air quality advisory. but at least for right now, most readings are in the moderate category. the next few days i will show you how the smoke is moving toward us. it will probably increase in concentration a bit. you know, we might fall into the unhealthy for sensitive groups for smoke. that would be the first time we have done it in a while and it is something we should start thinking about getting reoriented, too. considering what is going on across the rest of the country. let's talk about temperatures for a moment. what we did today should have been enjoyed. look at what the average daytime highs are this time of year. we will take a look at today's daytime highs. we will put those out the backside there. and now, you can see where we were. pretty much right on the mark. there is a pretty noticeable warmup coming our way. it will bring temperatures back to 100. there is a nice cooldown coming toward next week. we will get to that in a second. but this is the day

that need to be looked at. friday and saturday. both days actually have the heat advisory. it is not only livermore but all of the inland valleys. when we get to that map, you will see how some places are going to avoid the worst of this. in terms of that smoke coming our way, watch the flow in the atmosphere. see how it just keeps drifting over us? it's like there's a car pool lane and it is getting directed right into the bay. with high pressure in place, everything stagnates. all the while, smoke will be filtering in. high pressure is going to trap it. we are probably going to see the air quality get a little worse while the temperatures are going up. so this is a good time to pay attention to what's coming the next few days. tomorrow's daytime highs are already noticeably warmer. we just looked at the averages. you were much cooler than mid 90s today for the inland valleys. though friday and saturday are the warmest days, tomorrow is the day when you

will notice the change. that's when you step outside and go oh, it's gotten pretty warm. but the heat advisory doesn't go into effect until we get into friday morning. stays in effect until saturday night. there is that beautiful dividing line. if you are on this side of the hill, you got no issues. you'll have enough influence from the on shore breeze. it will get warm but not terribly hot. but if you are inland, that's why you have those colors shaded over your part of the bay. you can see how the center of heat has been wobbling around. that's where it was today. watch what happens the next two days. it just drifts back our way. and by the time we get into saturday, it is right where it was last weekend. the only difference is even if the location is the same as last weekend, the intensity is not quite as strong. so it won't get quite as hot but it will be close. san francisco and oakland. first oakland, you are going back to the upper 80s . we can take a look at the inland east bay. that is where you get near 100. but look at the cooldown as we saw. good looking numbers at least by the time we get to next week into
