much for joining us. it has happened again. another report of a freeway shooting. this time, it is on highway 24 in the east bay. >> today's incident, noon, broad daylight. westbound 24 in lafayette, as you mentioned. highway patrol had to close down the freeway from 680 to the tunnel to look for evidence. when our photographer got to the scene, they said there were two cars firing shots at each other. the witness says, their car was actually rammed by one of the alleged shooters. we are still waiting for confirmation from chp. but the two cars continued driving. as far as we know, no arrests have been made. here, you see the officers looking for evidence there on 24. the closure lasted about half an hour. the cars are stacked up behind those police cars. luckily, those delays have dissipated by the most part for this hour. this is the second

alleged rolling gunbattle in less than two weeks. on july 14th, and eight-year-old was shot in oakland. a child is recovering from serious injuries. that same day, a woman was shot in the leg. she was driving on 101 and then meedonto 280 when she was shot the driver behind her. no arrests have been made in that case either. plans have been made for more freeway cameras. caltrans says it has already installed 130, along 580. they have already established a highway violence task force to analyze shooting data and figure out where to send additional patrol. we are awaiting more details on today's shooting in lafayette. we will bring the latest to you on the evening edition. meanwhile, and east bay fire department is trying to get rid of its own chief. here is the back story. firefighters

gave a vote of no confidence to chief angel montoya. the union accuses him of what they call desertion and dereliction of critical duties. they say he spends most of his time at his home in orange county. richmond firefighters of local 188 issued a statement saying his refusal to address pressing safety issues, unwillingness to meet and confer, and his excessive absence, as they say from the city of richmond, make him incapable of running a safe, functional, and cost-effective fire department. the union says, montoya was missing for several recent emergencies. we all remember that threat of a mudslide during our winter storms. we reached out to the chief. so far, we are still waiting to get an answer from him and his side of the story. the vallejo city council has declared a state of emergency because it's police department is so understaffed. watch. >> this proclamation is going to allow certain things to

happen a little bit quicker. it is not going to bypass certain obligations we have with meet and confer, but there are also other avenues of staffing that have been used . >> all right. you talk about a staffing problem. get this. there are 51 openings in vallejo police department. 51. they are actively trying to recruit, but the police department has a take a long time to get somebody hired. meanwhile, businesses who need that safety say they have been trying to get that safety into their own hands and say police need to step out. >> to this day, have never seen a cop, door-to-door to the business owners to get bigger ties with the community. see what is going on. really being engaged. >> okay. that is tony diaz, our business owner. what could happen? they could take over in vallejo up the city cannot get more officers hired. 51

openings, still. we know critics are calling on alameda's district attorney saying she is too violent when it comes to violent crimes. now, a bear area police chief is stepping up. he has written a impassioned letter to pamela price asking for more in a case against one accused of armed robberies. you can see why those sentence enhancements exist in the whole place. >> reporter: this is the shopping center where that armed robbery happened. two women both robbed at gunpoint by a man the police chief says was a convicted felon, was on parole, and was wearing a ankle monitor at the time. >> the facts in this case are very troubling. trainer the chief has been with them since 2014 and was founded in 2020. for the first time in his law enforcement career, he says he

was forced to publicly disagree with the district attorney's office. >> i did not feel like i was speaking out against her. i felt like it was a communication for getting her to consider the charges that i thought were relevant. >> reporter: this all stems from two incidents on sunday, may 21st. police say, this man, 21-year-old colby berry from fremont , violently attacked one woman in an attempt to steal her purse and when he was unsuccessful targeted another woman, robbing her at gunpoint. the chief says shortly after they identified berry as a suspect, he had already been convicted of multiple felonies and was wearing an ankle monitor at the time of the robberies. they asked for sentencing enhancement that would add additional jail time if he were convicted. >> i always thought the enhancements would be filed because they apply and it seems like they are meant for a

circumstance just like this., but the chief says, district attorney pamela price did not file the enhanced charges against berry, prompting him to write a letter on july fixed asking price to reconsider saying that they are, quote, necessary tools to safeguard the public against an individual who poses a clear danger to their safety. the district attorney's office were not respond to multiple requests for comment in this case. but district attorney price does not prefer automatically adding enhancement and instead prefers diversion programs. >> anytime we can diverge someone from the criminal justice system, that is a goal. because it has been racially biased. >> reporter: berry is still being held on $350,000 bail. his next court appearance is set for august 11th. >> katie, thank you. so this debate about sentencing enhancement has come up with some really high profile cases set by price's office. price

did send two charges in that murder case against jasper's alleged killers. that was issued on 880 in 2021. but price remove that condition of special circumstances. meanwhile, the family of blake moz, who you will remember was that home depot loss prevention employee , a suspected shoplifter back in the month of april. they are angry and upset with her decision to pursue lesser charges in that case. the suspect is facing murder charges without any special circumstances or enhancements. we are following the federal reserve. they have raised interest rates yet again by another quarter of a percentage point. this is the highest rate in more than two decades. the fed says, inflation is at a 3% rate, and they want to bring it down to

2%. the chairman will decide whether to raise that once again in september. likely, you're starting to see this pop-up on your social media feed today. hunter biden, the president's son was expected to accept a deal but turned a lot of heads when he pleaded not guilty and set. what happens now? well, the judge in the case said she had concerns over the proposed deal. she gave the two sides to come up with a new agreement. meanwhile, president joe biden says he loves and supports his son. house republicans promised to continue their investigations. we know you're getting your first look at the 49ers in training camp. we look towards the preseason right here on cbs news bay area. maybe a touch of all. we have not back down from yesterday's toasty readings, especially inland. temperatures are ru

in the seven-day forecast. it is nice as we finished july and head into early august. the six to ten-day outlook keeps us in that near or maybe slightly below average pattern, but there is more uncertainty as we look further down the line. the 14-day outlook edges the trend a little closer to us. there is disagreement with the various long-range models. some say we are in for a return of the direct influence of the heat dome in august and the first full week of that month. others say, hang on. it will keep us air-conditioned to some extent as we head into the month of august. we will keep an eye on both possibilities. it is beyond the scope of the seven-day forecast. right now, we are looking at air quality that is good. a lot of green dots. that is nice to see. every once and a while a little fog -- a little fog. a little smoke will drip down and mix with the fog. that is coming down from southwestern oregon.

it is not producing the volume that it was even late last week. not as much of an impact from that. blue skies. looking nice. temperature there is just below 80 degrees. 90 degrees further inland. 90th a hotspot in livermore. temperatures stand in the mid 60s in san francisco. a couple degrees more around the bay. some of that will be evident already as we head into this evening at the giants and a's take on each other in the second game of the battle the bad oracle park. plan uncle, somewhat breezy conditions. a deeper marine layer means a bigger push of that fog into the inland valleys to begin the day on thursday. even with a deeper marine layer, it will not take long for that part retreat out of those inland valleys. temperatures tonight are dropping down to mostly the mid to upper 50s. maybe a couple degrees below average for late july. similarly, high temperatures will be below

average. mid-to-upper 60s in san francisco and oakland for 70 down the peninsula and mostly 80s inland. just the very hottest spots approaching 90 degrees. if we stay below 90 for those hotspots, you're just fine in late july. not much of a change in temperatures in san francisco and oakland of the next few days. a little bit of a baby warm-up push us back to average temperatures. same thing further inland. mid-to-upper 80s for most parts of the north bay. the tryvalley and delta are getting up to the low 90s, but just barely. that is a few degrees above normal. even along the coast, you should hit the 60s a couple of days this weekend. reed? still ahead, making a battery that lasts forever? we have a look at the inside work being done right now at the bay to innovate. and here is a look to the outside before we head to break. it is our beautiful golden gate bridge. all, my gosh. i am looking at it from the wrong side. i do know where
