to two misdemeanor tax charges after a judge raises concerns about the agreement between the president's son and the justice department. aliens on earth? a former intelligence officer testified on capitol hill about the country's ufo program. the evidence he says points to extraterrestrials on this planet. and disappointing draw. the u.s. women's soccer team need a win after ending its latest match against the netherlands in a draw. we'll have a full recap. good morning, and good to be with you. i'm anne-marie green. the plea agreement between hunter biden and the department of justice has fallen apart after a federal judge raised concerns about the scope of the deal. the president's son has now pleaded not guilty to two misdemeanor tax crimes. prosecutors and defense attorneys must now get together and provide the judge with additional information prior to her deciding whether to approve the plea agreement. jarred hill is here in new york with the latest on all of this.

good morning. >> reporter: good morning, anne-marie. you know, this agreement could have ended hunter biden's legal woes, but now his future is again in jeopardy. hunter biden flashed a smile as he walked out of the delaware federal courthouse wednesday after his plea deal with the department of justice came to a halt. >> plea agreements fall apart every day in federal court. but they don't fall apart in high-prorofile cases like this based on such fundamental misunderstandings. >> reporter: the president's son was set to plead guilty to two misdemeanor tax charges with a plan for prosecutors to recommend probation. he was also expected to enter a diversion deal to resolve a felony gun possession charge. but trump-appointed federal judge mary ellen noraika said she felt she was being asked to rubber stamp an agreement she had concerns about and questioned if the resolution to the gun charge was even constitutional. hunter biden's lawyers and trump-appointed u.s. attorney david weiss also disagree on

whether the deal would prevent him from being charged with other possible crimes in the future. >> if there's someme other investigation pending somewhere else, there's really no mechanism for the government to protect the defendant against that in this kind of plea agreement. >> reporter: the 53-year-old entered a not guilty plea in court yesterday, though the deal could still happen. both parties have 30 days to address the judge's concerns before she issues her decision. now the political fallout around all this cannot be ignored. again, top republicans saw this deal initially as evidence of as they saw it a double standard in the justice system. meanwhile, the white house is reiterating the independence of the doj while saying president biden supports his son individually. back to you. >> all right. we'll surely be talking about this today. jarred hill in new york. thank you. the dangerous heat wave that has scorched the southwest and other parts of the country is now moving into the central and eastern u.s.

more than 170 million americans are under heat alerts. susan elizabeth littlefield from our minneapolis station reports on how the brutal heat is affecting life from coast to coast. >> reporter: oppressive high temperatures are hovering over the midwest. >> pretty hot. it's cooking. >> reporter: it felt like 100 degrees in minneapolis. >> everyone thinks of the cold but the summers get hot and humid, too. >> reporter: in the southwest, temperatures in phoenix have been at or above 110 degrees for 27 days. texas and surrounding states reported a spike in heat-related hospitalizations this month. heat is especially a concern for agriculture workers like t.j. coffey. >> these animals, they're or livelihood. we have to make sure they're safe and alive. >> reporter: the heat wave stretching all the way to florida. cristian benevides is in miami beach monitoring water temperatures. >> reporter: in south florida, the water is so hot beachgoers say it's not cooling them off.

they say it's like a hot tub. 50 miles south of here in the upper florida keys, water temperatures hit 101.1 degrees. if confirmed, it could be the highest sea surface temperature ever recorded. researchers are worried about the damage to the fragile coral reefs. >> in south florida we lose that protection, that barrier from hurricanes. >> reporter: out atlanta, high school football practices already started for the brookwood broncos. >> it was above 92, then we shut down practice altogether. we go inside. we get in the air conditioning. so our players are safe. >> that was susan elizabeth littlefield reporting. an investigation is now under way in new york city as part of a large construction crane -- after, rather, part of a large construction crane caught fire and crashed to the ground. nine civilians and three firefighters suffered minor injuries yesterday during morning rush hour. officials say the crane was on top of a highrise building

lifting 16 tons of concrete when a fire started in its engine compartment. a section of the crane crashed into a building across the street as debris rained down 45 stories to the street below. authorities say the crane, the building under construction, and the neighboring building are all structurally stable and not in danger of collapsing. soldiers in niger claim to have overthrown the country's democratically elected president. the group announced on state television late yesterday that it is taking over the west african country. this all comes a day after the president's guards surrounded his palace and detained president mohammed bazum. he wrote on social media that democracy will be saved. hundreds of people took to the streets of the capital protesting against the coup before the soldiers' announcement. secretary of state antony blinken said that the u.s. supports the ousted president. a jury in london acquitted actor kevin spacey of sexually assaulting four men. after more than 12 hours of

deliberation, he was found not guilty on the charges dating from 2001 to 2013. outside the courthouse on his 64th birthday, he fought back tears and said he was humbled and grateful to the jury. back in the u.s., there was some startling testimony on capitol hill about ufos. former military and intelligence community personnel appeared before the house committee yesterday to testify about their apparent close encounters with unidentified objects. natalie brand has more. we have nothing close to it -- >> reporter: retired navy commander david fravor testified before congress about an encounter he cannot explain. a strange tic tac-shaped object he saw during a training mission in 2004. >> the technology that we faced was far superior than anything that we had. >> reporter: lawmakers on capitol hill are digging into the national security concerns

for unleashing his k9 on a truck driver who was surrendering to officials. body camera video shows the july 4th incident, and it began when the truck driver failed to stop for a vehicle inspection by state troopers leading to a chase. after the vehicle stopped, troopers told circleville officer ryan speakman to hold the dog back, but he did not. the truck driver was treated at a hospital. the "los angeles times" says six people were arrested after two deadly shootings along scenic overlooks in southern california. a 32-year-old man was found dead in his car saturday after it crashed in pasadena. police say that he was shot several times during what's believed to be a robbery. on monday about 40 miles away in another town a man and woman were found shot to death inside their car. investigators say the suspects are part of a violent street gang. and the nfl network says quarterback aaron rodgers and the new york jets agreed to a new two-year, $75 million guaranteed contract.
