this is cbs news bay area with reed cowan. >> we start off the top with this breaking news, this is a three alarm brush fire burning in east san jose, firefighters battling that 30 acre fire, we do understand that structures are threatened right now. this is near clayton road and via de la vista in east san jose, we are watching that closely. potentially hazardous chemicals found in an east bay neighborhood, now we understand there is some good news and some relief.

the story out of our nation's capital, former president trump facing criminal charges related to january 6 and alleged attempts to overturn the 2020 election, what is next in this latest indictment? and robbers targeting pg&e crews, and how oakland police are being called upon to help. good afternoon, let's start in san pablo where the bomb squad is investigating a hazmat situation, likely you've heard about this, it forced a lot of you to spend outside your homes overnight, at hotels and other places. >> reporter: yes, some of them are allowed back in, we got that news this afternoon that the evacuation order has been reduced. people living on minor avenue, 11th street and palmer avenue were allowed to return home, and those living on staten and john avenue are allowed home for one hour each . under police escort, they are allowed to get home and get anything they might need for the continued evacuation. crews have been removing

chemicals from a backyard shed on staten avenue all day, firefighters say the homeowner passed away about six months ago and his brother has been trying to clean the property when he found hundreds of chemicals in that backyard shed. something smelled weird and he called 911. firefighters said the chemicals have been improperly stored for years in various containers and boxes. hazmat teams arrived and labeled this a major hazmat incident yesterday but at this point they still don't know exactly what the chemicals are just yet. >> it could cause a chemical reaction and due to the improper storage, we have a lot of different chemicals stored together. we are trying to mitigate having any type of large chemical reaction which could be confused as an explosion. >> reporter: the people who are evacuated are gathering at the gym at contra costa community college, the red cross is helping. the goal is to make sure that everybody is back i the end of the day today , but

that depends on the progress that hazmat teams are able to make in the next few hours. sending good vibes to them. >> and gratitude for our first responders as always. thank you so much. this was the scene in san jose this morning where a construction crew hit a two inch gas line under the concrete. this is over near chapman street near park avenue and 880. a few houses had to be evacuated, the area was closed off as they worked to get that under control. fire crews were on standby at the scene as well. san jose's mayor just proposed a new ordinance that is aimed at keeping students safe from theft and drug use, that is affecting an eastside school. it is related to an uptick in vehicles near the campus where school is going on, if this ordinance passes, this would prohibit encampments and anybody living in a vehicle within 150 feet of that property line of licensed schools like preschools and day cares and k-12 schools. >> we are supporting this crucial common sense education

to ensure that all families are safe and secure. prioritizing the future of our city by creating a secure school environment for all of our schools in the city of san jose. >> that is alfredo, potentially a future leader in san jose, the city is working to expand state parking sites where unhoused neighbors can have access to bathrooms and showers and as well is getting help from job training and case management. governor newsom is sending chp officers into oakland after the mayor and police talked about this on the 3:00 pm broadcast, they need help to control the crime. that help is on the way. oakland robberies are up 22% compared to last year and pg&e crews are victims of robberies . they are being targeted mainly for their tools, personal items like wallets, cell phones while they are out trying to keep the lights on. the president of the oakland police officers

association tells us they are up to eight off-duty officers assigned to protect the workers every day. >> we are in a situation where folks don't have basic utilities because we are unable to provide an umbrella of protection for pg&e to fix the problem. this should be a call to city officials that we've got significant challenges around public safety . >> a spokesperson for the union that represents pg&e workers says while oakland is the only city where the company is doing this, they might hire officers in other cities including san francisco and in richmond. of course the big developing story out of washington dc, former president trump leading not guilty to federal charges alleged actions to overturn the 2020 election. natalie brand has the latest. >> reporter: donald trump arrived in washington dc and traveled by motorcade to a federal courthouse, this is his first court appearance to face unprecedented charges related to the january 6

capital attack and what prosecutors allege was a sweeping scheme to overturn the 2020 election, trump pleaded not guilty to four felony counts including conspiracy to defraud the united states and conspiracy to obstruct an official proceeding. outside the courthouse, security is tight , the city even pulling snowplows out of storage to bolster the fence line. on the sidewalk outside of the courthouse, there are both supporters of the former president and those demonstrating against him . some people even traveling from out of state to be here for this historic hearing. trump himself weighed in ahead of the hearing, saying he is going to washington to be arrested for having challenged a corrupt , rigged and stolen election. >> essentially, his defense is going to be, i fully had the right content to contest the election that i knew or was convinced was rigged. part of the challenge here is to prove that this was in fact a fraud.

>> reporter: jack smith said he is seeking a speedy trial that trumps legal team has signaled they will seek delays as the former president now faces charges in three separate cases. >> a lot of you are wondering about the other part of the story, mr. trump is the only person charged in this particular case but prosecutors do reference all of those pages in the indictment, six yet unnamed co-conspirators, most of them are lawyers that they say mr. trump plotted with. back to the breaking news, we want to get you back to the brushfire burning in east san jose, the chopper is just getting to the scene, firefighters say it's about 30 acres burned right now but we also understand, and we hate to hear this part of the story, structures are threatened. and where there are structures, there are people. for those of you who are affected by this, this is near clayton road and via de la vista road, we are watching this very closely, you

can see those first responders on the road in the midst of the fire line, heavy smoke . and the structures on the right, that is a home right on the edge of what looks like a cliff of smoke and flames. we know those first responders are trying to make sure that anybody who is in the home gets out and gets to safety . we will be watching this one closely, we know that is a neighborhood and there are people that are affected. we will be over that scene right now in east san jose, we will monitor the situation. still ahead, we are going to take you to the north bay for the effort to preserve a massive tree with a lot of history. fog and low cloud cover has been extremely stubborn, just a few glimmers of sunshine over san francisco today, we are going to see a big change for the weekend, details on that warm-up coming up. no time to spare, how the

the story of the remarkable resilience of our forests. >> reporter: 150 years ago, this redwood forest was clear-cut all the way down to the ground but one tree survived and it may be providing inspiration that can be the salvation of all these trees. people visit the town to enjoy the fun of the russian river but it is the backdrop of majestic redwood trees that gives it its beauty. as he walks through the forest, just stumps name is apropos to the setting because the huge tree stumps he passes are evidence of the clearcut logging that went on here in the 1800s. >> it would have been remarkably different, and i know it affected people back then even, because what people started thinking about , how to do things differently. >> reporter: but even now, the ancient trees live on, other full-sized redwoods have

sprouted out of their stumps and roots, carrying on a genetic resilience that is simply breathtaking. >> this is what they call a fairy ring. they are ringing this spot , this was a giant redwood that sat here , probably the size of that opening. >> reporter: it is hard to imagine a tree that massive, most of the current trees are only a century or two old, but there is one that stands out, literally. this is measuring 270 feet tall with a diameter of 16 feet. it is said to be the tallest tree in sonoma county and almost certainly the oldest. with estimates around 2000 years. >> it's constantly growing , but, 140 years ago, it was a spectacularly beautiful tree. >> and somehow it survived. >> somehow through everything that happened here, it survived. >> reporter: no one knows why it was the only tree left standing, but it's persistence

is inspiring an effort to preserve it in the forest around it. the lance owner, a timber company has agreed to sell the 394 acre forest to the save the redwoods league for $6.5 million , the money must be raised by september 29 and the conservationists are hoping that a tree that was alive during the roman empire will help them do it. >> i think we are lucky. we are lucky because a tree like that gives us a sense of all awe. >> the money will be donated to the county for preservation and eventually the creation of a new park so the public can experience its majestic beauty. >> if you want more information about the fundraising drive, you can go to savetheredwoods. org. you can see the burn scar,

it is about 30 acres consumed, look how close it got to the structures, you can see the rooftops. to the left where they had to save it, to the right, you can see there is smoke and fire, they are risking their lives to save that area. this is in the area of clayton road and via de la vista presuming income you can see the burn scars go literally right up to the edge of the homes, but it looks like there's some wind here in the battle, that is the fact that we don't see any structures that have been burned. we are watching this one closely, we know the first responders are out there in the heat working on that fire. let's bring in paul heggen. we can see the smoke in the direction of the smoke, what does that say about the condition? >> the good news is the wind is not particularly strong at the temperatures aren't very strong as well. only in the low

70s, this is another perspective on the clayton fire. we are looking across from carol drive. you can see the smoke being produced by this fire but the conditions are favorable with the cool temperatures and relatively light wind, that will aid the crew to get a handle on this and battle against it, potentially impacting any structures. at least some good news but they have their work cut out for them. you saw from the overhead view, some of the red streaks where it has been dropped around the perimeter. they still have plenty of daylight to work with. let's take a look at what you need to know as we head into the weekend, plenty of low cloud cover, fog and even patchy drizzle for the rest of tonight. the temperatures are going to warm-up once the fog retreats tomorrow. close to normal on friday, then the heat returns for the weekend, the temperatures peek on sunday , then we are back to near

average for tuesday and the rest of the week , and you can see the roller coaster ride as we look at livermore for the next several days. then a sharp drop of 15 degrees from monday to tuesday, we will see the rest of next week either near or within a few degrees on either side of what is normal for this time of year. in terms of the air quality, there has been smoke in the atmosphere, again, around san francisco and generally around the bay and the coast, you haven't seen any of it because of the fog. a little bit of hayes and the horizon, the air quality has been generally fine , this has been drifting down from the flat fire in oregon. the next wave of smoke is going to mostly stay off shore, a similar trend as we head into the weekend on saturday which means the air quality is only going to be impacted by the increasing weight of the atmosphere, the heat dome tends to trap urban pollution, so air quality goes into the moderate category for everybody. but i don't think it's going to get any worse. this is of you right

now as we look out from the top of black mountain, seeing the fog in the distance. the temperature is 61 downtown, 64 in oakland, inland temperatures mostly in the 70s and the warm spot is santa rosa, 80 degrees on august 3. it is unusual, and it's not going to last very long. the fog will not last long, the temperatures will warm up quickly , around the bay, it'll take a little bit longer for the sunshine to breakthrough. along the coast, no such luck. another great day on friday. highs tomorrow closer to what is normal, 60s along the coast , mostly 70s down the peninsula and around the south end of the bay, close to 80 degrees in san jose. mostly 80s for the tri-valley, delta gets a little bit warmer, potentially up to the mid-90s already tomorrow. 70s for san francisco and oakland and low to mid 80s for the north bay, close to normal for this time of year. the

temperatures will peak on sunday then we drop off quickly through next week, back to near or slightly below average temperatures by tuesday, wednesday and thursday. temperatures inland will be significantly warmer, close to 90 in san jose on sunday and 90s for much of the north bay on sunday and close to 100 degrees for the delta for the second half of the weekend. but, this heatwave is going to be brief. this is the volkswagen red and gold report. >> after having a day off on wednesday, the 49ers were back on the practice field today as they continue to ramp up for next week's joint practices and of course the preseason openers to talk about at the raiders. the 49ers are the only ones who needed a break from practice, kyle shanahan is known to work nonstop during camp, every minute accounted for, even the minutes he came to us. >> right now the coaches are waiting for me to start a sprint straight over here, i

let's get back to that breaking news from the top of this broadcast, this brush fire burning in east san jose, these are life teachers from our chopper and you can see, large plume of smoke just behind that. we know from what we saw there was a burn scar, there are structures threatened. the reason you see those lines is because it's in an area where it can be precarious. this is video earlier from where the firefight was on the ground, from what we could see. firefighters say it is about 30 acres . we are understanding there are some structures in that area near clayton road and east san jose. we also understand that we have the opportunity to talk to one of

our firefighters there. we will be on this, we will be staying on top of this and bring you updates as soon as we get them, but for now, the brushfire is threatening structures near clayton road. let's bring in our guest, we have breaking news, so sometimes it takes a minute to get things queued up. we have somebody from cal fire talking to us. what do you know about this fire in east san jose? >> good afternoon, my name is chelsea burkett, i'm a public information officer, currently we have multiple resources in route and at the scene of the incident, pretty significant of ground and air resources, and we are about 60 acres right now. >> so, the last time we talked, it was 30 acres, this has jumped up to 60, is that contributed to the wind? >> i believe it has a lot to do

with the vegetation in the area and we started to see a significant increase in fuel drying out throughout the state , and that is a big contributor to the situation up there. >> we know the men and women who are firefighters and first responders who are working hard on this over the last hour or so, we have been able to see rooftops near those burn scars, what can you tell us about the evacuations? >> currently there is some threat to the homes in the area, and we are working with law enforcement to ensure that citizens in the area are aware of the situation and are able to evacuate if they feel the need to. >> so, right now evacuation is not mandatory but we are in the awareness phase and giving the residents the choice? >> i believe that we have officers in the area and possibly chp, i don't have further information on that. >> so this is indicative of what we are seeing right now

all over the bay area, we have a lot of fuel on the ground coming up from the soil and we are at tinderbox, i know we use that phrase quite a bit, but it is dry out there as we see the smoke rising, that is the message for everybody , right? >> that is correct, that is important for everyone to be aware of their surroundings, make sure they are preparing themselves in the event that they need to evacuate. we have some great information and ways for you to prepare. >> we also see a large jet flying over, we anticipate the red and white indicates that could possibly be dropping some fire retardant as we look at that image right now on tv? >> we have a significant amount of air and ground resources, there are air tankers in the area as well as helicopters. >> we appreciate it, we will let you get back to work.
